Besides that, not knowing the difference between public and private property, how a trespass works with an initial warning and the Texas statute for having to ID are all basic knowledge that a cadet should know. I believe QI protects them from ignorance of a law, not the rights they swear an oath to protect leaving the academy.

I got through to Carthage City Hall by calling the police department and saying that I was having trouble reaching them. The dispatcher transferred me to the city hall where I spoke to a nice lady, and I told her about the mistake they had made in their treatment of Mr. Gray. I told her I hoped people weren't being too abusive to her, but people don't like hearing about Constitutional violations and unjust treatment of anyone (but especially Mr. Gray, at this point) let alone a veteran that is advocating for his fellow veterans. We had a nice, short conversation and everything was cordial, while at the same time I let her know "We the people....." are NOT happy.

Right. The US Supreme Court ruling regarding "qualified immunity" says that police are entitled to it when they don't know or understand the law. It was SUPPOSED to be a protective device but has been abused. Police absolutely DO NOT have qualified immunity when they violate well established civil rights and KNOW they are doing so. @@ianbattles7290 Exactly, it'd be great to have this playbook available in court. I can't comment on an internal investigation but I've found absolutely no wrong doing on my own part. However, I will issue a general empty apology (that doesn't acknowledge guilt), give a token payout (with a comprehensive non-disclosure agreement attached) and promise to do some additional training of a vague nature at an unspecified point in the future. Then once the case is over I'll go defame the other party in the press, and if they try and defend themselves I'll punish them for breaking their NDA.

Worse. 38.02 in Texas is settled caselaw…Turner vs.Driver violation. There is no excuse, no qualified immunity. Fifth circuit has settled case law on this issue. They are flucked if jeff decides to take it all the way.

CM: "Well, just talked about being public property, as long as he's not harrassing or bothering people, I don't know if we can do anything. When will the day come when these public servants and the officer and how will they be held accountable? Is it about education and that they should have more education. In my perspective, it is about completely ordinary qualities and knowledge of the law that they should have. It is a scandal, the officer's expansiveness and misinterpretation of a law that he should have known from his first day on the job. The obstinate officer's ignorance and misinterpretation is completely unreasonable and his threats of arrest are completely wrong. He has no respect for the citizen's rights. Think how many years he has been on the job, and think how many years he has violated citizens' rights. He should be fired, his is not fit for the job and has not taken the trouble to learn the law that every officer should be able to do when he takes up his job. Try listening to these public servants, maybe the man has a leading position and he talks like an ignorant teenager and a gossip bitch. The little man in the lobby is a liar, he lies and exaggerates.
