I am gobsmacked. I had a job at a fast food restaurant when I was 17 years old. I often had to close the restaurant and clean up. This sometimes meant that I would not leave until 1 AM. The alarm clock rang at 6 AM for school. Some days, I would fall asleep on the bus or in class. My point is that a sleepy teenager is not a criminal just because they are sleepy. What this judge did goes well into the realm of criminal behavior. I believe he should be indicted for these crimes.

I think when the judge admitted he was doing "his own version of scared straight" or whatever, that's telling. He absolutely should have known what he was doing was over the line. Knowing he did this mock trial like this makes it worse! I wouldn't be surprised if most all of the students there WERE scared as hell by what was going on... THE WHOLE CLASS should sue the hell out of the judge for how fed up this was. He WAS TRYING to scare the hell out of ALL OF THEM, just because this one person was drowsy, because he's an fing nutjob and needs to be in jail for this gross an abuse of authority. This should qualify as false arrest and child abuse under threat of violence. And that goes for the whole class, because all of them were implicitly threatened with use of force if they did anything other than shut up and comply. When it comes to the other court officers, I think that their best defense is to also claim being the victims via intimidation of some sort. Or just abject incompetence and stupidity.

Hence there was absolutely no legal grounds to arrest the girl. Meaning this was a Kidnapping, among many other felony offense. This is a clear case of an adult, in a position of authority, with tremendous power, emotionally abusing a child. This type of abusive behaviour rarely occurs in isolation. What if she refused or attempted to fight being put in handcuffs? She 100% would have been charged with at the very least contempt of court. They may not be able to remove the judge from the bench over this, but whomever put the cuffs on her needs to be fired. You have a right to refuse orders that are unconstitutional. The worst part of this, in my opinion, is making her change into jail clothes. Its all bad, but if she just had to put the jail OVER her clothes that not nearly as bad as forcing 15 year old to strip and put on a jail uniform. I would be furious if this happened to my kid without being forced to put on a jail uniform. I would be out for blood if they were forced to strip. Absolutely disgusting.

I taught school for 30 years. If a child fell asleep, I let them sleep, figuring they must need it. I never allowed that child to be woken unless it was time to go home. Parent would be informed and child would be encouraged to get more sleep. SLEEPING SHOULD NOT BE A PUNISHABLE OFFENSE!

Judges need to have significant authority to maintain order during court sessions. You definitely don’t want a courtroom turning into a Jerry Springer scene. Imagine if a criminal defendant started threatening the jurors-situations like that require a judge to step in and regain control. One of the ways a judge can do this is by temporarily jailing someone, which can also happen if a witness refuses to answer a question. In that case, you could be jailed until you provide an answer in court or until the trial concludes. With great power comes great responsibility, and in this instance, the judge clearly abused that power. Reigning in power is a bit too much, but yes, we need accountability as no one is above the law, not even judges.

Why the asterisk? Because there are limits, you're not allowed to yell 'fire' in a crowded theater just for fun, and you can't incite violence against others. When a witness refuses to answer a question, they remain silent, which is the opposite of speech. Of course, there's the Fifth Amendment, which protects against self-incrimination. But if that’s the reason for remaining silent, the District Attorney (DA) might offer immunity for that specific offense, or at least a much lighter sentence. If a witness is uncooperative(legal term is hostile), a judge can order them to answer and might even allow an attorney to lead the witness, which is usually not permitted. I think the original comment in this video is better interpreted as camera = live stream vs security camera? The presence of the live stream does complicate things in both directions imo. The media is able to move faster, in theory more people can see and call out injustice. But there's also the performance aspect the lawsuit is accusing him of. If his small group of regular viewers self-select into an echo chamber (ex: over minor disagreements in how he does stuff), it could normalize problems over time (in the minds of both judge and viewer), and it could get slowly worse until a harder line is crossed. I think the live streams are more good than bad, but since I also consume the content as entertainment it's hard for me to know if I'm being objective about it... I suppose the issue should be discussed in ongoing ethics education? (sorry tldr)
