Intellectual property must be protected and respected by all, yes, but I don't think "defe defe", a common Twi phrase, is original to Kwame Eugene. I suspect we can find many songs, poems and other creative works containing the phrase that preceded his song, but I'm glad both parties have resolved the problem amicably.

The fact that a defendant has settled out of court does no mean in any way, shape or form that the plaintiff's case does not have or has legal merit. The standard is the law and not the fear or otherwise of the defendant. Many creative defendats may settle out of court to prevent the straineous legal process that could end up jeopardising the image of the artiste, their work and their promotional efforts. 2. Kwame Mickey and Stonebwoy never went to court and hence Kwame never won a legal suit against stonebwoy. There was an out of court settlement; Again, settlement is not a court decision and therefore is it not a legal precedent. 4. To successfully sue for a musical copyright claim, the plaintiff has to prove his claim with a musical manuscript or musical notation that proves the infringement. Thus, the defendant's work must have copied the melody, progression or some sort of original musical creation owned by the plaintiff.(CFAO Vs Achibold - 1964) 3. Concepts and ideas ( inspiration) are not copyrightable - Section 2 of the copyrights Act 2005, Act 690 4. To succeed in suing for the use of a word, the plaintiff must have registered the word as a trademark. Words of known are not copyrightable under Ghanaian law 5. A suit for the use of a creator's lyrics may be successful if it is proven to be Susbstantially copied. Thank you!
