For one, Biden has the unilateral power to use the Border patrol for the purpose of conducting initial determinations. While the BP obviously cannot grant asylum, they can be authorized by the President to pre-screen applicants and TURN AWAY anyone who clearly lacks evidence for their claim. It also should be obvious to you that just as easily as Biden used his Executive authority to reverse all of the effective policies that Trump instituted, he could just as easily reimplement them. Biden also uniquely possesses the power to negotiate a safe 3rd country agreement with Mexico just as we have one with Canada. Just that alone would eliminate 70%+ of the applicants who have cross since Biden took office. That brings us to the issue of the "got aways," both known and unknown. If nothing else, the more than three million "got aways" present an intolerable security risk to the American people, a risk that Biden could address by putting the national guard on the border. Lastly there is the issue of accommodations for those people. We know that strong policies such as these work to deter those who might otherwise game our asylum system in the hopes that once rooted in our society it will prove difficult for anyone to remove them down the road-assuming of course that they can't pressure Congress to outright grant them asylum at some point in the process. Given the incredibly high number of asylum claims that are ultimately rejected, we already know that our asylum system is being abused, but weak policies only encourage people to become more brazen about it. While together these policies would have given us the low rate of illegal immigration we saw under Trump, the question still remains as to what we should do with those who enter. The answer to that question is right under Biden's nose given all the prisons and decommissioned army bases he has on the books. Obviously the facilities would need some modification so they can freely come and go from their rooms, restricting their access to the interior of our country while their claims are pending only makes sense. I don't even need Biden to do all of these things because any effort he might finally get around to making would be a step in the right direction.
