You can use the paper verification option described on the "Identity verification for trademark filers" webpage: www.uspto.gov/trademarks/apply/identity-verification. No social security number is required.

@@USPTOvideo I tried to send the verification paper but the notary asks me SSN. In fact, I am not a US citizen and remotely operate my limited liability company, Please advise how can I verify my identity.

@@wissamal-samman1332 You may want to print out the paper verification instructions and show them to the notary. A social security number is not required. Two forms of ID, one of which is a picture ID, are sufficient. Check out the list of acceptable forms of identification found on page 4 of the instructions: www.uspto.gov/sites/default/files/documents/TM-id-verification-form-instructions.pdf You might also consider hiring a U.S.-licensed attorney to handle your trademark matters before the USPTO. If you hire an attorney to represent you, you won't need to go through the verification process yourself, but can instead rely on the attorney (who will already have a verified account with the USPTO) to handle your filings. Although a U.S.-licensed attorney is required if your LLC's principal place of business is outside the USA, it is optional if your principal place of business is inside the USA and its territories. Based on your question, it sounds like your LLC may be based in the United States. If you’re a trademark owner living outside the United States, you can complete the online verification process through ID.me, but you will need to participate in a video call with an ID.me Trusted Referee. help.id.me/hc/en-us/articles/360052242853-What-is-an-ID-me-Trusted-Referee-video-call- Follow these instructions: 1) Log in to your USPTO.gov account: my.uspto.gov/ 2) Go to the Trademark account ID verification page or select any TEAS form link 3) Choose your filing role (trademark owner, U.S.-licensed attorney, Canadian attorney/agent) 4) Select “Verify with ID.me” and begin the identity verification process Follow the prompts on the ID.me website and select “I don’t live in the United States” when asked to choose a verification method The ID.me website has step-by-step instructions on verifying if you don’t live in the United States: help.id.me/hc/en-us/articles/4415907236375

I need some guidence to create and verify my account on ID.me verification, I am living outside of USA but i have US california LLC , And i don't have SSN or ITIN how can someone help me on this? I am really in a problem

Please remember that you are not required to verify your identity if you are represented by a U.S.-licensed attorney. And also remember that foreign-domiciled trademark owners filing trademark documents with the USPTO *must* be represented by a U.S.-licensed attorney. As you'll see on the "Hiring a U.S.-licensed attorney" webpage, "foreign-domiciled" is defined as "an entity’s principal place of business (headquarters) where the entity’s senior executives or officers ordinarily direct and control the entity’s activities." This is overly burdensome for startup businesses who cannot afford proper legal counsel or IP attorneys. How do businesses get around this when a mark is owned by a business entity?! The CEO is not the owner of the mark. The natural hierarchy for startups without in-house counsel would be to delegate an administrative task like this to operations or a business affairs manager or paralegal. Expand this role to include other company officers, not just the individual owner or an attorney. The way USPTO pushes attorneys services is very scammy and unethical!

If your business's primary place of business is in the United States or its territories, you do not need to have an attorney represent you before the office. As the owner of the business, you can represent yourself. The USPTO often recommends hiring an experienced trademark attorney, as the trademark registration process is actually a legal proceeding and not a simple administrative task, but counsel is not required for U.S-domiciled businesses. Also please be aware that there is no need or way to "get around" the requirement. To cut down on fraud against the office, the USPTO requires all filers to verify that they are who they say they are. That filer might be an individual trademark owner, a person with legal authority to bind the trademark owner (such as a corporate officer of a company), or a U.S.-licensed attorney or Canadian attorney/agent representing the trademark owner. Note that ID verification is not tied to a company or law firm. It is tied to a person. That allows a trademark owner to file multiple applications for multiple companies that they run. And it allows attorneys to represent multiple clients. In your case, it sounds like you are the CEO of your own company. Even though you do not own the trademark (your company does), you can legally bind the company. So once you are verified, you can submit an application on behalf of your company. To learn more about identity verification, be sure to check out the "Identity verification for trademark filers" webpage: www.uspto.gov/trademarks/apply/identity-verification. You might also take a look at the "Trademark user roles" page: www.uspto.gov/trademarks/apply/trademark-user-roles. In particular, the "Non-attorney trademark preparation or filing entities" section notes that under the USPTO rules of practice, non-attorneys (which can be interpreted to include operations or business managers) are not authorized to practice law, so therefore are not allowed to represent owners in trademark filings.
