Thanks for your question. If you sometimes use the full name apart from the acronym and vice-versa, for proper protection you would need two separate applications, one for the full name and one for the acronym.

Thanks for your comments and question. I cannot provide too many specifics in this forum for a variety of reasons. But I can say that generally, it is safest if you wait for USPTO approval and for the period of publication in the public record to pass before you invest in the mark. Many businesses begin using or planning to use the trademark prior to then, but there is some additional risk that that time and funds you invest will lost if there is a problem with the trademark application.

The deadline for all maintenance filings is always calculated from the date the registration is issued, not the application date or the filing of the evidence. You cannot add goods to the application once filed, but you can always file an additional application for the same mark for use with other goods or services.

Also, if you file for the text only trademark, you cannot later at a graphic element to that filing, but you can file a separate application later to cover the logo. That would be the advisable strategy since you want to file the first application as soon as possible generally and since generally protecting the plain text is more important than protecting the graphics.

I really appreciate your videos which are so helpful to me in navigation through the process of trademark registration. So my main concern is that while the trademark office is "handling" my application, I was to be sure that I can move forward with production of my product. Also, how safe is it to hire a logo artist who will have to have the name an any art used in the trademark, before filing the trademark? Can I submit it as a name only and add a graphic element later? Thank you.

I would like to start my own sportswear company online, however I just discovered there is another small online business that is doing the same with a name similar to what I wish to call mine, but that company name isn't trademarked. I would hate to just trademark my name and completely steal that company's thunder so I figured maybe I could abbreviate my name and just used the name I wanted to use, in the logo. For example, you have a clothing line called LRG which stands for Lifted Research Group but LRG is what it is known by. Should I just use the name I intended to use before or can I just abbreviate it and use my cool logo with the words spelled out in it?

If you apply for a trademark for a name of a business can you use the first letters in each work to abbreviate the name for example "Your House My House" would i be able to use "YHMH" or do i have to apply for both the full name and the abbreviations?

Can someone apply to "Trademark" your Registered "Service mark"???
@makingtrademarksbloom11 жыл бұрын
Technically, no. A registration for a design only covers that exact design. For more information, search for my IPelton blog post "Trademark Tip: Words vs. Logo".

any idea if i want to trademark my website domain name which has a logo + text, do i need to file 2 trademarks requests? 1 for text and the other one for the logo with the text name? for example, amazon.com/ Amazon LLC will be text name where as the Amazon text logo with the arrow sign will be another request? is that true?

Generally (I cannot provide specific advice here) for best protection brand owners should file two separate applications: one for just the name (a "standard character" trademark) and one for the the logo. For more details see www.erikpelton.com/2012/01/30/trademark-tip-words-vs-logo/

oh by the way, if the trademark - a "standard character" trademark is dead not own by me, does that mean i can trademark that dead name itself?
