Why Pahadi People of Kumaon and Garhwal Cannot Get Bhu Kanoon The Pahadi people of Kumaon and Garhwal, regions located in the Indian state of Uttarakhand, have long struggled to gain recognition and legal rights over their ancestral lands. This struggle is rooted in a complex history marked by the erasure of their historical and cultural narratives, largely due to the manipulations and interventions of external powers such as the British, as well as the strategic actions of certain ethnic groups like the Rais and Limbus. This essay delves into the intricate history of these regions, exploring how the Bhutias and Khas Aryas were sidelined and how the British Empire's favoritism towards the Limbus played a crucial role in altering the socio-political landscape, ultimately impacting the tribal status of the Pahadi people. Erasure of Bhutia and Khas Arya History by Rais and Limbus The Rais and Limbus, two ethnic groups from eastern Nepal, played a significant role in the historical dynamics of the region. Originally refugees from Sichuan province in China, they migrated to northern Tibet and then settled in eastern Nepal during the 17th century. As they integrated into the local societies, they sought to establish a stronger presence and identity. One way they achieved this was by aligning themselves with the British colonial powers. Iman Singh Chemjong, a prominent Limbu historian, was instrumental in fabricating connections between the Limbus and the ancient Kirat dynasty. This fabricated narrative helped the Limbus claim indigenous status, overshadowing the rich histories of the Bhutias and Khas Aryas. The Bhutias, who had long been rulers in the Sikkim region, and the Khas Aryas, historically significant in Nepal and northern India, saw their histories systematically erased and marginalized. The British, always on the lookout for reliable local allies to strengthen their colonial rule, found the Limbus to be useful collaborators. The Limbus, in return for British support, helped in undermining the influence of the Bhutias and Khas Aryas. This mutual alliance allowed the British to solidify their control over the region, with the Limbus often acting as intermediaries. British Favoritism and Its Impact The British Empire's strategic favoritism towards the Limbus had long-lasting repercussions. The Limbus aided the British in their geopolitical objectives, including incorporating Sikkim into the British Empire. This cooperation was rewarded with preferential treatment, further entrenching the Limbus' position in the socio-political hierarchy at the expense of the Bhutias and Khas Aryas. In contrast, the Bhutias and Khas Aryas, who had a more adversarial relationship with the British, found themselves increasingly marginalized. Their resistance to British colonial policies and their historical significance were downplayed or outright ignored in official records. This systematic neglect contributed to the erosion of their historical narratives and cultural identities. The Plight of Uttarakhand's Pahadi People The erasure of historical narratives did not remain confined to the regions of Nepal and Sikkim. The Pahadi people of Kumaon and Garhwal, primarily consisting of Kumaonis, Garhwalis, and Jaunsari (Khas Aryans), also suffered from this historical revisionism. The rich and diverse history of these communities, deeply rooted in their land and traditions, was overshadowed by the fabricated narratives propagated by the Limbus and supported by the British. This historical erasure has had tangible consequences for the Pahadi people. Despite their longstanding presence and cultural significance in the region, they have struggled to gain recognition as a tribal community. This lack of recognition has, in turn, impeded their ability to secure legal rights and protections for their ancestral lands, known as "Bhu Kanoon." Without tribal status, the Pahadi people cannot benefit from the various socio-economic and political advantages that such recognition confers. This includes access to reserved jobs, educational opportunities, and legal frameworks designed to protect their land rights and cultural heritage. The absence of these protections leaves the Pahadi communities vulnerable to land encroachments and cultural dilution, further exacerbating their marginalization.
