For everyone getting confused between rights test and essence of rights test 1. Highly recommend you to read pg 10-13 of Nagraj judgement and last 4 pages of IR Coelho iudgement. 2. For those who will not read the same, just understand this - rights test means evaluating a provision or law or amendment against a right expressly mentioned in the constitution. While essence of rights test means that the court can invalidate a new law/amendment/provision if it violates certain fundamental principles which even though are not expressly mentioned in the text of the constitution and even though they cannot be pegged to a certain article of the constitution - these fundamental principles are significant as they give coherence to the Constitution.

Its means any act and regulations which Violets the fundamental rights of citizens or even violets the basic structure of Constitution are placed in 9th schedule before 1973 then they are immune from judiaciary!.They cannnot be challenged in the court..
