Thanks for commenting! If you submit an Intent to File, and subsequently file your official VA claim within a year, then your effective date will be the date VA received your Intent to File.

When I ETS'd April 2014 and filed a claim in July 2014, I signed a release of medical records to VA but they didn't get it apparently. I refiled about 24 months later in 2016 with a VSO and VA made the effective date the year I filed August 2016! What form do I need to request a correction of the effective date? I can't upload the docs to eBenefits under the original claim; it won't allow it.

Does the Veteran rate compensation the first month of discharge if they submitted their BDD and received a decision with an effective date of the day following discharge? For example, if the EAS was 30 Sep and the effective date of the claim is 1 Oct, will the Veteran receive their first check on 1 Nov (for Oct) or 1 Dec (for Dec)?

Does back pay apply to active duty members who filed a cliam while in service using the IDES program.

@the subliminal verses, generally speaking, VA will grant back pay to the date the claimed was fired with them after discharge. If a veteran files a claim for disability within one year of separation from service, the VA can grant benefits back to the date of the veteran’s discharge. I'm presently at 80% i filed for bi lateral (pes planus) flat feet with absolute clear evidence and records of a pre service exam, in service and exit exams of my flat feet going from mild asymptomatic (pes planus) to severe symptomatic with deformity but denied because i missed my C & P exam in 2000 within the 1 year exiting the service, is my effective date 2000?

@Trooth Serum, generally speaking, The VA will typically grant benefits effective the date of the veteran’s claim. The effective date for a reopened claim is the date that claim to reopen was filed.

I had 2 disabilities that were never included in my benefits that dated back to 2007. Today in 2019 i received a decision for those claims which were tinnitus and vertigo one rated at 10% and another at 30%. The effective dates say 2007, would that mean i get 12 years retroactive pay for those 2 contentions that were just granted? Today i have a rating of 90%...

@Jonathan Muniz VA, yes disability back pay is the monies owed to veterans from the effective date of their claim to the date they were granted those benefits.

Can an effective date be BEFORE the filing date? I was a dental assistant 1972 to 1976. In 2019 I found out the procedures they had me do resulted in "considerable" mercury exposure that resulted in permanent damage. Come to find out they changed procedures in 1985 because they realized it resulted in this mercury exposure. So, the government knew about my exposure some 35 years before I did, and they never notified me or checked up on me. I have been suffering major medical issues since 1975 and never knew why until now. Because of their negligence, is it possible to get an effective date back to 1985? I would have filed then if they had notified me. They knew. They should have told me.

I need a decision regarding my claim #24-647-995 in 1970. This claim that was processed as an educational solution for a mental disorder. For which payments were made from the VA. My claim was for mental health problems that were misdiagnosed. The decision I need is if my initial claim dated in 1970, is considered my date of original claim. Is that date used for my present claim? In addition to the above decision, the records I need are to documents in support of my claim as service connected. Those records are in AMHRR, processed into iPERMS for storage and future use. Then in 3-2 ORC’s have legal responsibility to maintain as an official governmental records in iPERMS which is prat of the AMHRR and as the umbrella for all the HR official military personnel file the OMPF is to preserve permanent documents pertaining to ENLISTMENT, APPOINTMENT, DUTY STATIONS, ASSIGNMENTS, TRAINING, QUALIFICATIONS, PERFORMANCE, AWARDS, MEDALS, DISCIPLINARY ACTIONS, INSURANCE, EMERGENCY DATA, SEPARATION, RETIREMENT, CASUALTY, AND ANY OTHER PERSONNEL ACTIONS. @Kenneth Strickland, the DoD can assign a disability rating upon separation from service based on the severity of the service member's conditions at the time of separation. You can appeal this rating if you do not agree, but it will be based solely on the severity of the condition at the time of separation. VA disability ratings are assigned after a service member is separated from the military, but these ratings can continually be updated to reflect any changes to the conditions over time.

What about unemployability I have seen veterans who got back years even 5 or more as an effective date and not when they filed.

Intent of file on 11/2018 Submit my PTSD claim on 04/2019 I was granted 30% PTSD combat on 07/2019 I felt under rated so I submit a supplement claim on 02/2020 I was granted 70% ptsd combat on 06/2020 back dated to 02/2020 Submit hlr for the compensation date that should been back dated to 11/2018 since the supplemental claim was submitted within the year window from my 30% rating.. however, my hlr was denied Submitted another supplemental claim to correct the effective date to go back to 11/2018

Mr. clean One because that’s the Social Security Administration rule ( you have to be disabled for 6 months and you get paid on your 6th month) different programs though. In this video they are talking about Veterans Compensation/ Disability benefits

My intent to file date was 9/17/18, filed claim 9/10/19 I was increased from 40 to 90. On my generate benefits letter in ebenefits, I have two effective dates. All my increases say effective dates 9/17/18 but my secondary claims say effective date 9/10/19. Will I receive back pay? And why would I have two effective dates ?

Tak S. I am an Air Force veteran. Concerning the effective day of claims, I hear that if I file on or before the 15th day of the month, the claim payment will be paid on that month; if file after the 15th day, and before the 15th day of the next month, the payment will be paid on the next month, for example, if I file on Sept 14, 2018, my claim payment will be paid no September 2018. Please tell if it is not true. Thank you very much.

Hello @Tak Shi, typically compensation will be awarded from the first of the month following receipt of the claim. So for example, if you filed a claim on September 10th you will be paid from October 1. Thanks for your question!
