My son is a vet and is 100% Disabled non-service connected with Aid and Assistance. Now after taking Benzos for several years we are told that he is Addictive, will have Dementia, and must continue taking Benzos for 6-12 more months. The VA Dr said he must be stable (no Anxiety attacks) prior to tapering off Benzodiazepines . She did say he will have Dementia, already has Severe memory loss. Has back pain. Is he entitled to anything more which would put him over 100%? Does he need to be examined by the state for a disability rating on his back. Does his current memory loss or Dementia mean any higher financial gain?

After I got back from combat, I hurt my back on duty. The doctor said I couldn't lift more than 5 pounds so I couldn't do my job. I was in physical therapy for my back injury and psychological therapy for some PTSD issues. My first sergeant said he would do me a favor and let me out early with my honorable discharge and my gi bill. I later found out he gave me an under honorable conditions(general) discharge and I should've gotten an honorable medical discharge with a disability rating and I didn't get my gi bill. That was over 20 years ago. Since then, I have developed several conditions as a result of my in service issues like sleep disorders, sleep apnea, anxiety and depression. @Veterans_Lawyer2 жыл бұрын
VA decisions are not binding on SSA, just as SSA disability determinations aren’t binding on VA. That is both good and bad, depending on whether the other agency issued a favorable or unfavorable decision. But, you can always submit one agency’s decision in your case to their other agency as evidence for them to consider when deciding your case. So, it’s helpful evidence but not an automatic win just because the other one found you disabled.

Seriously if it wasn't true than why did my fiancee friend blow his brains out for getting denied benefits. He was having a lot of personal problems but getting denied was the the tipping point. He was getting the run-around and after a couple years gets denied! He was getting treatment for his PTSD and was even told by his doctor that he had PTSD but when it came to getting monetary benefits the VA doctors told him the complete opposite, that he didn't have PTSD anymore and that was the reason why he was denied for monetary benefits! The VA knows how sensitive veterans are but yet they take advantage of the fact that these guys will do anything they're told because they were trained to follows orders and not to question anything. That's exactly what happened to my fiancee too and he struggles on a daily basis to conform. I can't convince him to get out of the room because he hates crowded places, can't go on a drive because he flips out over a speed bump! Over everything! Because driving around reminds him of being in the humvee!

@@elizabethresendiz2979 look, if your fiance killed himself then he should have been admitted to a psychiatric hospital where he would have gotten the help he needed. money does not cure mental problems nore does it create them. putting denied benefits on the reason someone is mentally ill or suicidal or actually killing themselves is just tryingh to blanket the real problem onto a fake problem. i am mentally ill. i have hurt myself many times and i have been hospitalized many times also. i get benefits, money from those benefits and i try to stop my benefits. i am trying to get a disability rating removed from my record. multiple sclerosis. i feel i was misdiagnosed. a doctor believed i actually have it. i am going to appointments to prove i do not have it. i even stopped the medication for it. currently i am 100% p&t and people tell me to leave it alone and i am golden with that rating. if i poke at my file i will open a lower rating. i dont care about money. i only care about getting treatment for my mental illness. if you care more about money than treatment then your mind is in the wrong place because money will not cure your medical contitions.

@@UNKNOWN-le2tu @discomfortably i I want to make it clear that my fiancee didn't take his life over this, I don't know if I made it clear but I said my fiancee's friend took his life because he had survival's guilt, I said personal problems because I didn't want to get into detail, the VA knew this, they knew that he was looking for any reason to take his life and they gave it to him. That's the reason why Im angry! He got help alright not exactly the help he needed though. Now back to my fiancee, he was also taken advantage of by the VA, he's the type of person though if you tell him that he didn't qualify, he's done and over with fighting back, he trusts everyone has his best interest at heart when in reality they don't. I don't feel like repeating myself but what pisses me off is that the VA made it impossible for my fiancee to get a job, even if he wanted to I don't think he would make it on a 8-5 job. The problem is hes not getting nearly enough to even cover fucking rent, and yet the VA has the audacity to say that his PTSD is not related to the military. That he already had that problem prior to joining the military. They're a bunch of idiots. If that wasn't the only problem we have, when he was on the process to getting a fucking housing voucher, the VA gave him the wrong address to one of the appointments and this was almost the last step prior to receiving a housing voucher, we couldn't even get ahold of the stupid bitch that was supposed to be helping him, she disconnected her phone. I don't understand why people always go straight to the conclusion that it's just about the fucking money! It's not just the money it's your livelyhood now your stuck with less than a months worth of rent and you have to live with it! What about all the other expenses who's going to pay for that! That's me! Trust me he doesn't give a shit about money, he could care less if he was homeless.

@@elizabethresendiz2979 im confused. is your fiance still around. look if so i can help if you really want the help. if you listen to people who complain about the way things are then you will go nowhee. in order to be rated for va service connected disability you need 3 things. a current diagnosis, current symptoms and a nexus connecting the diagnosis to military service. if what you say is true then im guessing you have 2 of the 3, current symptoms and a current diagnosis. all you need is a nexus which is a letter. do not listen to some doctors opinion about the nexus. doctors cannot give you a nexus letter. thats why we make copies of our stuff when we discharge. you need to listen to the right people with the right and proper help and information, not just opinion. if someone gives you an opinion that you should get compensation or you deserve something then when you do not get it you will complain about how much the establishment sucks. when all you were missing was a key piece of information you were never told about needing. the system is not flawed. it works. do you want to know the real truth about ptsd, the real medical truth, what the medical doctors know and are taught about it. i can send you a pdf copy of the dsm 5 that covers the diagnostic criteria of all mental disorders, even ptsd. that book is a medical book and the hard cover copy costs $200. i happen to have it in pdf format also. i can send it to you.
