the federal law against recording in courtrooms is what you are describing. What is being enacted here is the order, as set forth by the Supreme Court of the United States applying the Public Forum Doctrine and determining court houses are non-public forums, is that the Chief Justice, or Chief Judge, for any jurisdiction is within their authority to restrict recording anywhere within the courthouse, which many have drafted a court order addressing as such. Before you attempt the argument that Supreme court is not following the letter of the Constitution, the constitution also does not say filming or recording in public is an actual right, but rather an interpretation of the first amendment by that same Supereme Court.
@derekelliott60987 ай бұрын
@@joelgraham6820 Joel, I get your effort. If you are new to commenting on frauditor channels, they ae EXACTLY like sovcits. You can post 100s of case laws that are exactly intended for recording, speech, types of forums, etc. These crackheads wont listen. They spout jabberwocky; use irrelevant words and think those words are case law. It's fruitless. And as for frauditors: DMA is convicted of several federal crimes for frauditing. LIA has 15+ pending criminal cases with 9 restraining orders, Rogue nation just got indicted on 8 federal charges.... that's not even including Chilli and Sean Porter, let alone Erie County who is on federal probation for involvement in the capitol riot.
@SmittyAZ7 ай бұрын
@@joelgraham6820 In some places, the Judges actually write orders that you can't record people coming in and out of the courthouse. People have been arrested for being across the street, entirely off the courthouse property, but they can still view the courthouse. I'm sure you know that some people appealed, and guess what the higher courts ruled?
@joelgraham68207 ай бұрын
@@SmittyAZ I am aware of a case (the plaintiff name escapes me right now) from the early 90s I believe, where it was appealled the charge of filming the courthouse from the sidewalk. I can't recall if it was heard at the State Supreme Court level, or if SCOTUS heard the case. The result, and quite correctly, was that the plaintiff was lawful in recording the outside of the courthouse from the side walk. They went on to give reasoning of the decision, which was easy to follow, even for a frauditor. They ruled that, when examined through the Public Forum Docturine, the outside of the courthouse, from the sidewalk, was determined to be a "traditional public forum" and traditionally a location, that being a public sidewalk, that the public exercised their freedom of speech, the actual freedom courts extended to include photography in the US. If I recall further in that case, the justices compared the differences of photographing from outside the courthouse, a traditional public forum, to the interior of the courthouse, a non-public forum, even going as far to explain the rules within the individual state operated Courthouses were under the rulings of the Chief Justices, or Chief Judges, of each district court, who could issue court orders to restrict photography, and related activities, within the individual Courthouses under their jurisdictions.

The problem is, as always, public servants who assume ownership of public facilities and believe any policy they decide to create becomes enforceable. These are not private businesses and yet the constant excuse from LEOs for violating the constitution is well it is the policy of so and so and they are the administrators of the building so that trumps the constitution. The laws for conduct in public places are under the guidlines from the constitution and are not subject to the whims of some egotistical bureaucrat. It is so infuriating to see a security or law enforcement officer shaking a piece of paper at someone as though so it is written so shall it be.

Court Houses are trouble all over the country. Typically judges try to prohibit all filming in court houses. Need to see written Judge's Order. Many judges think they own publicly funded buildings. There may be state court rules or laws about filming in court houses. Filming in federal court houses is a nightmare.
@tontoepstein68607 ай бұрын
Of what relevance is it that a building is publicly funded? It's irrelevant. A courthouse exists for a specific purpose. There are written rules. If you don't like it, then tough titties. If you want to see film, then go buy a ticket to see an Aquaman movie.
