When the probate fees is paid for getting probate from court. It is at the time of filing the probate documents before the court or before the judgement is pronounced. Secondly if there are 4 beneficiaries of probate & three beneficiaries are again the probate. If the plaintiff file for the probate. How much fees he need to pay whether it will be 1/4 th amount OR full probate fee amount which is max. to the extent of Rs 75000/-.

Sir Land of a person (A) acquired by Haryana government in2013and got compensation. A plot is also alloted as per scheme on payment But before the allotment of plot person(A) died in 2020 His son claimed for plot through petition on the basis of will regd in 2000 Inspite that :- That the land ancestral is ancestral and he has three sisters That the immovable can have the title without probate That what can be done if sisters don't reply Is the WILL can be declared invalid Or any other objections can be raised for the.considertion of application moved u/s 7 R 11 Kindly advise

Very good information. I am from Bangalore. My husband passed away in 2008. We had made a will together signed by both of us and 2 witnesses but it was not registered. According to the will a site was willed to my daughter. Now when she is trying to sell it customers are asking for my son's signature which he is refusing to sign. Sir my will has three witness and two beneficiaries (including me). One beneficiary and two witnesses have testified in court that will is valid and there is no objection. But 3rd witness is not appearing in court, I have requested him to appear in court but he is not coming, he has just sent an affidavit stating that he has seen the testator sign the will. What will happen? Will I get probate or will be rejected?

Mere Dadi ji ki death 2004 mei ho gyi and Dada ji ki 2021 mein. Mere father ne 2022 mein partition suit file kiya as both his parents died interstate...tab Mere chacha ne 1994 ki dadi ki will put up ki hai unregistered..but not probated neither executed till date. Dear sir, 1. If I am Plaintiff counsel files two Interlocutory applications(I.A) before court of law and was successfully served to the adverse party then in how much time impliedly or automatically the adverse party will have to reply about I.A application and after that it barred under the Limitation Act or under CPC. My I.A are pending from last one year in court suit file and pending for first hearing. 2. Although the court doesn't specify specific direction/order to reply file about I.A applications to other side. OR The time period will start or count from that date when the court grant explicit order to file reply about interlocutory applications if any to the adverse party. Like W.S is filed with in 90 days from the date of service summoned.

Sir, I have a query regarding ancestral property. If the ancestral property is orally partitioned or partitioned by panchnama or in general by any unregistered mode of partition then would it be considered as self-acquired property of different holders(brothers among whom the property is partitioned).

Is it possible that in Delhi or like places, without probate, the will as being adduced should be asked to be proved atleast by arresting witnesses?!!! As per evidence act also, no document is said to be proved when it's executant/ witnesses do not depose to this effect. If this happens, indirectly probate can also be seen there .

नमस्ते सर, वसीयत नामा के बारे में आपके माघीयम से जानना चाहता हु। १. मुझे मालूम ही नहीं है के मेरा पिताजी उनकी मिलकत मेरे बड़े भाई के नाम वीलनाम कर के गये है । लेकिन उसके वाणी वरतन से लग रहा है कि वीलनामा हुवा है । २.वीलनामा हुए है ऐसा अपने को कैसे मालूम पड़ेगा। बड़े भाई ने ऐ बात छुपाया है तो कैसे मालूम कर सकतें हैं। बड़े भाई को नोटीश देके जान सकते हैं के? ३. वीलनामा करके गया होगा तो पिताजी के मरण के बाद में कितना समय तक में वो प्रस्तुत करना पड़ता है । इसकी समय मरीयादा कितनी होती है। ४. मेरे केस में मेरा पिताजी के मरण के बाद में वारसाइ हुए है और मेरा नाम भी पिताजी की मिलकत में आगया है और भाई बहनों का सबका नाम दाखील होगया है। ५. क्या मिलकत में नाम दाखील हो ने के बाद भी मेरा बड़ा भाई वीलनामा प्रस्तुत करके मुझे मिलकत से बहार करसकते हैं? वो अकेला मिलकत का मालिक बन सकता है क्या? ऐसे केस में वीलनामा को कोर्ट में चेलेंज करसकते हैं क्या ?

I am in process of buying a Property in Mumbai . The actual owner were a Hindu Couple . The Husband died and the Society transferred the Shares in the name of his wife on his death . The couple had no Children and apparently no legal heirs. The wife ( The lady owner) made a regsitered will 10 years back and she also died and bequethed her Property on her young sister and brother in law . The Society transferred those shares in the name of this Couple but there is no probate to this will and society has transferred the shares without probate . How can I buy this Property from the existing couple without any Probate of the will ?? Will giving an advertisement in Newspaper suffice in absence of Probate to will ?? Please guide on a way out as I have Liked the Property and the couple are also honest but they do not have a Probate but only a Proper registered will which is also drafted by a lawyer with Doctor as one witness who has also expired . Request Guidance. Thanks in advance
