Just to help lang po kung bakit nagkakagulo ang mga authors with regards to the interpretation of Section 109 (P). This is also just my humble opinion po para lang maintindihan all sides. I hope makatulong din. Tax Code prevails over RR this is conclusive, However, under the law we follow this principle of Operative Fact Doctrine, under this doctrine despite the fact na ang Administrative Rules and Regulation ay in conflict with the statutory law the law will still recognize its existence bago ito madeclare na unconstitutional. In short lahat ng act na sumunod sa RR despite it's unconstitutionality will be generally considered valid as a matter of equity consideration. This also means na hanggat walang magquestion ng RR the BIR may still apply it and the people are bound to follow it. (this is probably the basis of other authorities) Although wala pa pong definite ruling when it comes to this specific provision, this principle po is used by the Supreme Court in almost all unconstitutional laws especially in Film Development Council v. Colon Heritage Realty, so open pa po talaga sya for discussion of whether the court will apply this in this particular provision if may magquestion man sa RR. Anyway I'm a law student po and I watch your videos sir kasi very informative nya for my tax subject and madali intindihin compared sa mga books namin in law school. Thank you so much sir!

Na-confuse din po ako regarding Sec. 109(P) sir because of interpretations of some authors. However, there is actually jurisprudence regarding the conflict between statutes and regulations. In the case of Fort Bonifacio Development Corporation v. CIR, (G.R. No. 175707, November 19, 2014) the Supreme Court ruled that: "The rules and regulations that administrative agencies promulgate, which are the product of a delegated legislative power to create new and additional legal provisions that have the effect of law, should be within the scope of the statutory authority granted by the legislature to the objects and purposes of the law, and should not be in contradiction to, but in conformity with, the standards prescribed by law. To be valid, an administrative rule or regulation must conform, not contradict, the provisions of the enabling law. An implementing rule or regulation cannot modify, expand, or subtract from the law it is intended to implement. Any rule that is not consistent with the statute itself is null and void. While administrative agencies, such as the Bureau of Internal Revenue, may issue regulations to implement statutes, they are without authority to limit the scope of the statute to less than what it provides, or extend or expand the statute beyond its terms, or in any way modify explicit provisions of the law. Indeed, a quasi-judicial body or an administrative agency for that matter cannot amend an act of Congress. Hence, in case of a discrepancy between the basic law and an interpretative or administrative ruling, the basic law prevails." Therefore, in my own humble opinion, the thresholds to be used are those in conformity with the letters of the law, i.e. 1,500,000 and 2,500,000 respectively. *please do correct me if im wrong hehe im open to constructive criticisms naman thank you :)

JE B.C. hindi kasi tayo pwede mag-add or delete and assume. If ano provided by law, yun lang. "house and lot and other residential dwellings" ang nasa list, not "residential lot" only.so if wala sa list ng vat exempt, magiging vatable na dapat.tnx

Dapat real estate dealer si taxpayer-seller #2.irrespective of #1 however, very clear naman na if what was sold ay "residential" at pasok sa exemption, then exempt parin otherwise walang silbi listahan natin ng vat exempt items. The vat registration will apply to those items not specifically exempt under the law

Shanesse magkaiba naman yung right ni BIR to adjust "zonal values" versus pag-set ng "vat threshold". Si legislative branch (Congress) ang may right as to the latter. Don't be confused with the 2. Nonetheless, as emphasized in my discussion, you can choose the P1,919,500 and P3,199,200 if doon ka comfortable. Thanks
