This was just a business venture for him. One he became so invested in that he found it necessary to commit fraud in service of it. This fraud has been noted as high up as The Hague tribunal. The reality is that Ecuador is severely polluted by oil operations, but Petroecuador has never accounted for its share of the clean up. Instead, it has even expanded its operation. Texaco/Chevron handled theirs (and were certified by the Ecuadorian government), but Donziger would have you believe that they handled it wrong and this caused all of the trouble.

He or his Gibraltar shell company owes Chevron money from a judgment against him but claims he cannot afford it. He was ordered to turn over his phone and laptop so they could verify this by searching his assets. His concern is that would violate attorney-client privilege because he presumably also has case files on those devices. My instinct is to side with him on this as it feels a bit more than necessary, but that doesn’t change the other facts of the matter. Anyways, he is a lawyer not a journalist, so I am not sure his “sources” would be an issue. He should want all his sources known. I can’t think of many acceptable reasons to use anonymous witnesses in court.

Nice how you think Chevron just assassinates witnesses. The fallout from that would not be worth the case. Fun fact: Pablo Fajardo, Donziger’s Ecuadoran lead attorney, was caught trying to pin his brother’s murder on Chevron. The reality is that Fajardo had already filed a police report for the incident in which he identifies the attackers as acquaintances of his brother and never mentions Chevron. In the report, he acknowledges that it was a senseless alcohol fueled attack.

I don’t know the reason the phone and laptop were supposedly needed for this. What I do know is that Donziger definitely had complex finances, so it’d be hard to speculate. He collected big name investors for the lawsuit, established a shell company or two in Gibraltar to collect the court’s reward and disperse the money to the plaintiffs and to give himself and his investors their cut. He was holding assets in at least two different countries and using lots of money that is only his on loan.

It was a weird one cuz BP just made all the damn oil drop from the top of the water and it broke up and dispersed across the whole gulf and back out into the worlds water. It wasn't as "in your face" as some of these messes, it wasn't close to shore, it didn't kill indigenous people or ruin their livelihood, but it was a lot of oil that got away, and more importantly, that damn dispersant was probably the worst way to handle it, but it was generally considered a success since no one could see it, and since no one saw or remembered it just wasnt a big deal, or rather, no one cares now.

I was an industrial welder for a time. I travelled around working on industrial sites in the U.S. Even here the big corps' only concern is covering up pollution, putting down anybody who tries to blow the whistle at any cost, and putting money in their own pockets. Most industrial sites are located on major waterways...their pollution goes directly into our Earth's most vital and vulnerable resource and the poison reaches us all-humans, non-human animals, plants, nothing is unaffected. "Dark Money" by Jane Mayer and "Confessions Of An Economic Hitman" by John Perkins are invaluable reads for understanding how our world's financial systems, corporations, and militaries all collaborate to keep their systems intact...we have to learn about and understand our enemies if we will ever have any hope of standing up against them effectively.

They actually did clean up their share after they left and got their cleanup certified by the Ecuadorian government. Many of those ugly pictures are of fresh crude that, most likely, Petroecuador spilled. Ecuador’s oil company has had thousands of spills since Texaco ended their operations. This is even shown in this video where the lawyer objects to being shown “fresh crude”. Fresh crude would’ve been collected for profit, not left behind. Looks a lot like a Petroecuador spill.

The Hague ruled in Chevron’s favor, no nation has agreed to enforce Ecuador’s ruling, and the extent of the fraud Donziger committed to get his judgment is by obvious to anyone who bothers to give Chevron a chance. The reality is that Texaco completed its cleanup two decades ago, and Petroecuador has been neglecting theirs and polluting up a storm ever since they took over in 1992. Probably all the ugly images you see in this video are from them. There is no chance Petroecuador is going to stop polluting, because the economy depends on what they do, and there is no chance Chevron is going to pay Ecuador for what they are actively doing to themselves.

He went so far as to publish reports in their names. The evidence of fraud involved is way too extensive to cover in a short youtube comment. Note that the ugly black oil spills you see in this video are guaranteed to be almost all *current* Petroecuador operations. They have one of the worst environmental records out there and have been the majority shareholder in Ecuador’s oil program since 1976. They’re not all robotic and corporate in this one, lol. It’s personal. They are indignant, and rightfully so. On route to winning his judgement, Donziger went as far as to falsify reports by his own experts. There is a deposition video showing one of these guys explaining that every Texaco site he inspected was properly cleaned (this is the *plaintiff’s* expert) and that he did not author a report attributed to him saying otherwise. And that’s just one of many other examples of Donziger committing fraud. The reality is that Petroecuador has been polluting like there’s no tomorrow since Texaco finished its cleanup and left, and Donziger is trying to make a buck by blaming what they did on Chevron. Chevron’s reaction to this is awesome to watch. It is uncharacteristically personal for a corporation, and Donziger earned every bit of it.

We have recorded testimony of Donziger’s own experts and documentary evidence Petroecuador’s activities and agreements with Texaco. Everything I provided is part of the record. That same tribunal that you mention where Guerra testified ruled against Donziger. Guerra served mostly to provide a narrative. The case against Donziger goes light years beyond Guerra’s testimony.

I've seen it, smelled it, and touched it first hand. Regardless if the human rights lawyer in this case committed fraud or not, at the end of the day, both of the oil companies still dumped a massive amount of pollution. @@romanianfps Of course there is still oil pollution in Ecuador. It’s there for three reasons: 1. Ecuador is still drilling through its own oil company, Petroecuador, and it has a far bigger operation than TexPet ever did. This company has had thousands of spills in the 2000s alone and possesses a record Chevron would never get away with. 2. Texaco only ever agreed to clean up a share proportionate to its share of the consortium. It did its cleanup, but Petroecuador neglected to complete all of theirs. In fact, Donziger and Fajardo actually went as far as to obstruct Petroecuador’s cleanup (of sites they agreed to handle) so they could maintain some pollution for their “toxic tours”. (BTW, there were cleanups prior to Texaco’s exit. It wasn’t just a last minute “fix what we did” but something handled when they were done with a site.) 3. The cleanup involves, impart, mixing waste with stabilizers (such as certain soils or cement) to prevent it from spreading and burying them in a concentrated area. If you take a soil sample in the center of those areas, you’re going to see some residual petroleum. This is the protocol agreed on, and unless (maybe) you’re growing food right on top of these areas, it’s not going to harm you. If the video you’re talking about is the one with the cylindrical dirt samples, then that would either fall into category 3. Those samples are not to test for the presence of those wastes but to demarcate the boundaries of the pit. Once they do that, they can take samples varying distances outside of those boundaries to see how much, if any, contamination leaked. It was, in fact, on this last point that Donziger forged reports by his experts, because they were unwilling to report the type of leakage he needed for his case.
