For anyone wondering why would Nintendo want to keep all of this old assets locked away from the public, the answer is simple: international copyright law dictates that any knowledge that becomes available to the public without a patent qualifies as "State-of-the-art", meaning that such knowledge (theoretically) becomes part of the big box that is humanity's development on the matter the now publicly available invention is. For more info you can check the pdf available on the following link www.wipo.int/meetings/es/doc_details.jsp?doc_id=287699 Most likely Nintendo has not patented a lot of the stuff that was leaked and, since it is now state-of-the-art because of the leak, they'll have a harder time trying to sue anybody who might create anything based on the leaked assets.

This pertains to patents, which is very different from copyright. Prior art/state of the art states that a patent cannot be substantially similar in an obvious way to previous inventions. Art and other things cannot be patented. Mechanisms and procedures are the only things that can be patented. While the knowledge of the assets is uncopyrightable (all facts are free knowledge), the actual execution of the assets, characters, and other copyrightable features are all copyright by Nintento. They have no harder time suing someone now then they would have had before, if anything they would have an easier time since they could say the person actually saw the material. If the material was still secret it would be highly likely the person just reinvented it without knowing.

Of course nobody (I think) is going to be stupid enough to try and patent a 1:1 copy of any leaked asset. But they can very easily "modify" certain things here and there to make it seem original enough (think of a chinese knock off). "they could say the person actually saw the material" Ok, and how are they goint to prove the defendant actually saw that? Just saying "it became public" is not a very plausible argument, even more so, they'd have to demostrate they actually did what they are claiming they did and, while not impossible, doing so in almost every single possible case doesn't sound too economic, either.

@@BakingSoda4U Couple things: You can't patent a creative work, that's what copyright is for. As far as I can tell patents allow modification (in novel/new ways) to produce new inventions. Copyright can forbid modification. You cannot take an image of a Disney character and add four extra hands, nor could you take the character (not the image, the character itself) and put it in your book. Chinese knock-offs as you put it do infringe on copyright (and trademark) law in the majority of cases. The publicity of this event is massive, everyone knows about it as far as the copyright lawyers care. There was a lawsuit not long ago between I think Taylor Swift and another artist on a very small portion of a song (about 10 beats or so). The justification was the original had 10 million views on KZbin, so they said Taylor Swift unknowingly copied the work. This leak has well over 10 million views if you add all of it up. Nintendo doesn't really care about economic viability when it comes to this stuff. They're really vindictive about fan games etc.

You DO NOT need to register for copyright in the VAST majority of countries, including Japan, USA, China, etc. This material is copyrighted by Nintendo and they can prove that they own and created it. Look up automatic copyright for more information. Copyright registration just proves that you have created it by putting it in some government database. It does not change your rights to the work in any way whatsoever.

These aren't multiple hacks. They're slowly distributing 2TBs of hacked data. The guy who got taken to court got the space world leaks from another source. One guy hacked Nintendo and stole 2TBs of SNES, N64, GameCube and Wii data. He got jailed for it (and for possession of CP) Basically, the guy distributed those 2TBs among several people in case people would get jailed. The task they got is to slowly release the leaks one by one. One of the prominent Pokemon leakers actually came forward about this and confirmed it, while claiming he regretted it and stepping down from his position as a prominent Pokemon leaker. For anyone interested, the GC and Wii data doesn't encompass the games, but mostly E3 notes and presentations for investors. Also the entire process of how a Wii is built from start to finish.

They don't "keep getting hacked", this was all stolen a while ago, and has been being leaked in parts. The person who stole the stuff has been in jail for a while, but others who had access to his stuff has been slowly releasing it.

That’s basically impossible... not only does any large company like that have backups in place but any modern software project is using Git for version control which means each dev working on it has a full copy of the project including its fully history on their computer.

Since they are beta designs they probably dont have copyright for many of these things and thus have a hard time combatting things like emulation if the assets are used. Plys it wasnt just old designs if the got into servers with confidential files like the old designs imagine what sort of things they could take fron the company like secret upcoming projects. Which its not cool to do to those who work on the game. Cause most of them put their heart and soul into it just to have someone take every little secret in it an just post it online.

If you wanted free games, you could do it with much easier ways. What we have here are leaks of the source code, things people would find much more valuable for understanding prototype builds, the inner-workings of games (none new) that we all love. Can't say it's a good thing to hack these, but people do get excited about new information coming to light. We just were not supposed to see that, and well, Ninendo obviously has the right to not just put their source code out in the open.

Elaborate: Fan games that Nintendo takes down are usually something they are making. There are many rom hacks and fan games out there that they just dont bother with. But some get taken down Eg - Mario Royale. They made a similar multiplayer in SMM2.

copyright law, they have to step down on it, otherwise they would lose their copyright, that's why, for example, copyrighted music on YT gets struck all the time. If you ignore it, you lose the right to sue people for it, because you either hold your copyright against everyone, or none, but not just selected individuals. And because all those old stuff is still within their copyright, they have to protect it...law is weird

Well, you're actually right about one thing, Story Time: There HAS IN FACT been a Luigi Hack Reveal of Luigi in Super Mario 64, from the Statue saying "L is real 2401" meaning 24 years and 1 month before it was released. Basically, Nintendo predicted when it would happen, without giving away too much information.

yeah, as far as i know the leaks that have been happening this year are also from the 2018 zammis leak. allegedly the full leak is around 2.1 terabytes and is being slowly released by a few of his friends. it's sad to hear but yeah

2401, It's a typo, they meant 2014 because there is also a 4 in 64, now take the 6 from 64 and add it to 2014. YOU. GET. 2020. BOOM, mystery solved, the hackers waited until this year to reveal that Luigi was in SM64.

One missed detail. The department that was leaked was not directly Nintendo. It was iQue, which is known for being Nintendo's hardware pals. The games had to be rebuilt for a console released in China that stored the games on the console itself, instead of cartridges.

I don’t think that people hacked Nintendo to find the files for Luigi and more in Mario 64, they just extracted the files on an emulator, and looked extremely deep until they put them together piece by piece.

I use a “three step” verification. Meaning the third “layer” of security after the first two is a prepaid card for online shopping. I keep the card around 80 bucks at max, so I can afford the majority of the online product, but if the datas are stolen it’s not a loss I can’t recover from. The only downside is sometimes I can’t buy everything instantaneously everything, but having to wait some a bunch of days can actually be positive.

I will never understand what's so bad about letting the fans knew what the games originally looked like. I mean, it's clear that it could harm someone if he had leaked games that will come out in the future. But since he only showed us stuff from the past that did not became reality... I'm kind of curious as to how the damages from these things are calculated. Is there a breakdown of lost earnings and reasoning for why the hack caused those earnings to be lost? Cost of tracking down and apprehending the person? (In that case, would just announcing the hack immediately mean you're not doing any damage?). Cost of managing a PR response? Or are they doing something silly like counting the cost of improving their security afterwards...
