I think the passenger is not liable. But the employer of the driver will be liable vicariously on the basis of master-servant. Since the owner of the cab has hired the driver. And driver is his serving driving and he is the master under whose direction and control the driver is working. Also the act is committed in his employment hours.

Basically this maxim means voluntarily act se koi injury hoti hai to defence nahi le sakte, consent has been used for voluntarily.
