@@ajagule Wrong. You don't have to win the FCT to be elected, though a win in the FCT counts as a state win. For example, if a candidate wins 23 states + FCT, it will count as 24. As such, Tinubu is in the clear.

It is a political interpretation to say that FCT is like any other state and so it's not mandatory. Question, why did the constitution not say 25% of valid votes in 2/3 of the states AND LAGOS or AND Adamawa or AND Bauchi, or AND RIVERS, This is a simple thing, you don't need to be a lawyer to see this clearly. The FCT is mandatory.

I'm strongly resisting the urge to point out your glaring error sarcastically. What would warrant LAGOS or ADAMAWA or BAUCHI or RIVERS to be specially mentioned has you have claimed? when the "... all the States in the Federation ..." bit of the section 134 takes care of that? Clearly the FCT is not a state like Lagos or Adamawa, although in some ways, it does function like a state, most especially in a national election for the president that will represent every inch and corner of the country. ONE person gets ONE vote. So, to simply put, who is doing the voting? Citizens who have been deemed eligible to vote. Where can you find these citizens and where can they vote? in each of all the 36 states and the FCT.

There is nothing like 37th state.sec 134 is very specific for the purposes of election. Candidates must win FCT with 25% of the total votes cast therein. If fct has been interpreted to be a state by constitution does not still change a thing. The wordings of the sec 134 is and ....AND in the FCT. Fct whether as a state or not has been given that special status.

Abuja cannot determine who wins the Presidency of Nigeria. If that’s the case then millions of people would have been disenfranchised in the political process. The constitution didn’t say “Must” but said “and Abuja. Tinubu didn’t have to win Abuja to be the President of Nigeria..

You must get 2/3 of 24 states... But when you have 23 States and 25% in Abuja you can include it as a state to make it up to 24 states for you to be declared a winner... Meaning that section 299 is to make Abuja as a state when the candidate did not meet the requirement of 24 states you can include the FCT to it to make it 24... That's if. The FCT is not a state meaning in 299 you must still meet up the requirement of 25%... I'm not a lawyer what do I know 😎

Falana is a respected SAN. As the matter has become sub-prejudice, he drew back in his interpretation. That is ok. The interpretation of Abuja as 37th state will actually have further implications in future. Abuja will seek to have other structures that states have apart from area councils. If Abuja is just a 37th state, it cannot be producing just one Senator. They will need to provide 3 senators just as other states. On the other hand, treating Abuja as special could mean that as the host of the President, at least 25% of Abuja residents should welcome you by voting for you as the President. As most constitutions in Nigeria were not written out of true constitutional conference, it is unclear why the condition for winning mentioned 36 states AND Abuja. There is a good argument that would require that at least 25% of the President's host should vote for him.

Mr Falana's reasoning appears pedestrian. If all the votes cast in Nigeria is equal, then there is absolutely no need for a quarter vote in 2/3 states to be declared a winner. A simple majority will suffice. That clause for Abuja is there for a reason.

Abuja is the only state where the president is the Governor. So it is expected that the President as Governor should at least get 25% in the FCT.

You guys should just make this make sense. Why can’t the constitution use non controversial sentences? If the FCT’s status of being treated as a state also applies to that provision, why couldn’t the writers just write “25% of 2/3 of all states” since we can assume that FCT is equally a state or put a caveat to explain that FCT is to be treated as a state. Alternatively, it could have read “25% of 2/3 of all states including the FCT”. Why create unnecessary confusion? I thought the constitution should be read by everyone with clear understanding? Why do one need to go for interpretation of the constitution? Yet people are told that ignorance of law is not an excuse?

The 25% Abuja argument is not a 3rd condition b4 declaring the victor. It is part of the 2nd condition. Therefore it is only deemed necessary by the constitution to include adding FCT so no snake lawyer will use that as a technical loophole. However, this inevitability means the requirement is 25% of 2/3 37 sub national territories within Nigeria, the 36 states and FCT.

@@basseysvilleshow1676 “And FCT” does not mean it is a separate condition. “And”means it is part of the 2nd condition. Abuja citizens are not superior than others states citizens. Furthermore, it will make no common/intellectual/political/constitutional sense for a candidate to win popular vote and 25% of more than 26 states excluding FCT and be denied victory otherwise everyone should just run to Abuja and vote because just the 25% Abuja supersedes the rest of the states. Historically, Abuja has been treated as a state even though no one says “Abuja state” so the constitution will be wrong if it writes 2/3 of 37 states and leave it as such

@@basseysvilleshow1676 Secondly, if you walk into a room of 36 women and 1 man, you will salute the room as “hello ladies AND Gentleman”. But if you say “Hello ladies” only, thinking it’s just 1 man and there is no need to add gentleman, technically you did not acknowledge the man in the room. If there is any legal litigation, the man can legally claim whatever you said after “hello ladies” has nothing to do with him. This is why it is necessary for the constitution to spell out FCT as part of the equation so no lawyer takes advantage of FCT not mentioned.

Abuja was made by cutting parts of states around them. They don't get to elect governors in Abuja but you get to do so in your state. So are you special? Mk we day think before we talk please 🙏. Olisa Agbakoba raised this issue of the Abuja FCT status in our constitution in one of the previous interview he had with the media. Now the law that INEC ignored and turned their face against is now pursing Nigeria.

The issue of 25% win in Abuja has been addressed in 2007 btw yaradua and buhari where the judges affirmed that buhari didn't get 25% so can't be declared winner, so what is the controversy about this issue. Are going to change the law because of buhari.

This is very simple , 24 states is not at least two thirds of 37 states...if you assume Abuja is a state.. therefore at least two thirds is 25 states since state is not divisible. Tinubu has not meet this requirement. But Abuja is not a state , it does not have a governor and must therefore be treated specially. Abuja is a melting point of all Nigerians and it is only logical that a president should be able to secure 25% of votes in this special territory.

Even if Abuja is classified as a state following section 299, it is required that to become a president of Nigeria, the candidate must win FCT as well as 2/3 of 36 states which is 24 states. The constitution should have said 2/3 of 37 states to establish the equality. Otherwise, 2/3 of 36 has to be gotten and FCT separately.

Lol, people that have never practice law in their life are arguing with a SAN of more than 30 yearI don’t know what is so special with Abuja that you think a candidate must win 25% in it to become president of Nigeria, infact when in doubt the judges can call for record of discussion while the constitution was been put together, one of the people involved in writing the discussion already said the intention of the law was not to give Abuja a special status, it was specifically brought up during their discussion, but they will rile you up and you will be disappointed and sad when the court rules you don’t have to win Abuja.

If Abuja was meant to be regarded as a state according to the constitution, it would have read 'INCLUDING Abuja', not "AND Abuja". For instance, there are 27 people sitting at a table, 26 are green, one is purple, the constitution says to win a competition, you must get one vote each from 17 green people AND the purple person. Simply means one vote from 17 green people PLUS one from the purple person. If the purpose was to consider the purple person as part of the green people, the wording of the constitution would have been that in order to win the competition, you must score one vote each from 17 green people, INCLUDING the purple person. INCLUDING means that for the purpose of the competition, the purple person is regarded as a green person and may or may not be included in a total of 17 to win. AND means you must get 17 green people AND one purple person for a total of 18. It's called common sense.

There are 37 people, 36 male and one female. The defining factor is people, a female is not more important than a female. Therefore, FCT is not more important than a state because there are no special people living in FCT.

False. Nigeria as 1 entity operates as 36 states and a federal capital territory. And so, your example should actually be worded as (assuming you're serving a table) "to win the competition, you must serve at least 2/3 of all 26 green persons and purple person sitting at the table." Section 134 (2b) ... he has not less than one-quarter of the votes cast at the election in each of at least two-thirds of ALL the States in the Federation AND the Federal Capital Territory, Abuja.

According to the constitution of Nigeria, the FCT-Abuja is not a state. But even if we treat it like a state, the president is the highest political official who works out of the FCT(since there is no governor of FCT). As a result, the president must obtain the support of the FCT citizens (by receiving at least 25% of their votes). The FCT is the president's seat of power and serves as the nation's capital, from which the president leads the country. The president therefore must receive at least 25% of the votes cast in the FCT, as required by the constitution. It is inappropriate for a king to reign from a location where he has very little acceptance or enjoys little support. The requirements of the FCT are clearly stated in the constitution, otherwise, it would have been silent and regarded it as just another state. The mention of FCT in section-134 is critical, making it a mandatory requirement. Therefore, in addition to gaining widespread support on a national level and from the states, the president must also win support from the FCT in order to effectively rule and preside from there.

your interpretations are more of emotional. In UK London is a different party from the PM. Washington DC was democratic when Trump was in power. The president of Nigeria appoints minister of FCT regardless of which party wins it. PDP has always won senate seats in FCT. So your point is mute. If this was a requirement, then candidates would have focused on FCT.

Whether you argue for or against that FCT is a state, it still does not take away the law that 25% is compulsory. That is why it is clearly mentioned that to win the presidential election, the candidate must win 1. The majority of lawful votes 2. 25% of lawful votes cast in 24 states AND the FCT. Those who cite section 299 to support their argument that the FCT is a state are still incorrect because the constitution says a candidate must have 25% in the FCT. Note: There is a conjunctive emphasis( AND )on the FCT to show clearly that winning 25% there is compulsory. Since 1999 from Obasanjo to Buhari, they all got 25% of FCT votes. Nigeria will automatically become a banana republic if Tinubu is allowed to rubbish our constitution, because of selfish ambition. He can not be sworn in on the basis of illegality.

Mathematically and technically if you assume FCT as a state, which originally you can't, 2/3 of 36 states and FCT (i.e 37) means 24.66.. Where is the decimal?????? Which state will be less than whole???This is so clear and does not need any complex debate. It is 24 states and FCT. Using "AND" means a separate inclusion to the 24 of the 36 states. You get 25% of 24 states and 25% of FCT. Chai Africa!!!

Falana, I don't believe you. The constitution is written for Nigerians to understand and not to confused the citizens. If an institution required six credits and mathematics, what does it mean? The word (AND) is mandatory being the central seat of all the federated units of the federal Republic of Nigeria. That's what it mean. All other past president has met the requirements except Tinubu, and Tinubu cannot be an exception. The constitution must be obeyed.

If Abuja is taken as the 37th state as you clearly stated, it's ok. Now let's accept without conceding that Abuja is a state. What did section 299b say? It says that the president of the federal republic of Nigeria shall exercise the powers of the governor of FCT. Now, since FCT is a state, and the president is the governor of the FCT, what is the criteria for Electing the governor of a state in Nigeria? I know, majority of votes, and at least, 25% in at least 2/3rd in LGA of the state. Here lies wisdom... And common sense is not actually common. FCT 25% is a must, not an option.

I am not a lawyer but common sense tells you that Abuja is given a special status because it is owned by all Nigeria. So a presidential candidate must get 25% in Abuja in order to be declared a winner of the presidential election on. On the other hand, the clause that says that Abuja should be treated as a state, simply means that Abuja be allocated resources and other things just like any other state. Very simple.

Anyone can express his/her opinion , but at the end of the trial the real interpretation of the matter at issue will be decided by the judges Falana use to act as an objective voice in various political issues in Nigeria, but the tendentiousness of his position on the matter at issue is patently evident . We were told it is is illegal to voice opinions on matters that are subjudice . Nigerians have lost hope in the entire judicial system, especially our SCI ( Supreme Cult of Injustice) a purchasable, compromisable and incorrigible body of men. Hell will frost over if the apex court overturned Tinubu's alleged victory at the polls .

Falana got it wrong. Abuja is not a state. The Nigerian construction doesn't recognise Abuja as a state but as a Federal capital territory. Falana can't change the constitution. The section 134 should have said 2/3 of all the states in the Federation without separating the Federal capital territory Abuja.

FC territory is not a state. It does not have any local governments. The President is the governor of FCT. You cannot treat Abuja as a state. It doesn't have institutional components of a state.

Interpretation are different, the previous supreme court interpretation is different from the current situation.

Nigeria has 36 States and FCT as a special jurisdiction (FCT)is not a state,Femi Falana don't know where's to belong .....he has to be neutral.

Not right! A state must have not less than 3 senators. A Governor and state assembly.

Abuja cannot and is never a state, there are 36 states and a capital in Nigeria. If Abuja is a state, who is the governor? Mr senior advocate

I don’t know why this is still a subject of debate. Section 134 couldn’t be clearer. Two third of the Staes AND Abuja. 25% of votes in 24 States and Abuja. So the winner must, by law, score 25% of votes in Abuja. Simple.

Do we have a governor and state of assembly members in Abuja? Abuja is never a state. If Abuja is a state that means we have 37 states in Nigeria contrary to to the general knowledge of 36 states in Nigeria. When Lagos state was the country capital it used to have governors, national and state assembly members but the case of Abuja is quite different. But it's left to the judiciary to interpret this controversial issue correctly without any prejudice or favour.

Falana is a human rights lawyer not an election litigation expert..experts have already spoken on the matter, the decision rests with the apex court.
