The question is...what would have happened if you were black... :/

@eb37256 жыл бұрын

• 如果警察盘问过多,且没有正当理由,可以问“Am I being detained or am I free to go?”。
“从另外一个State来”,并不是reasonable doubt或者probable cause,所以被ask to step out of the car甚至do a search完全是违法的,即使他是K9 Unit。

He was doing an unconstitutional search of your vehicle btw. Never let them it gives them a chance to plant things. Look up videos of cops planting evidence it actually happens.

I think that road is a " Forfeiture Corridor. " The Police department makes money off of drug forfeitures. They stop out-of-town cars , check for drugs or big amount of cash , and then impound them for a small reason . It really makes a lot of money for the State government~~!!! ----------------------------------------------------------------------------------------------------
If you guys ever got pulled over again and knowing for sure that you haven't done nothing wrong while the police requests to see your id or even search your vehicle, just ask - am I being detained? Yes? On what bases? If the police cannot give you an adequate reason, keep asking -am I free to go then? The police will probably say no, then ask him again the first question and dont answer any question from him or hand in any id or documents as long as you are positive that you have done nothing wrong. Eventually, the police will realize that harrassing you based on your looks and race is a mistake and a waste of time. Help yourself with the first amendment of constitution. Knowledge grants you power.

We knew for sure that he didn't have the right to tell us to get out of the car or search the car, but we didn't feel like we were being harassed or bullied, so we just decided to comply and leave with just a warning. If his attitude was different, I definitely wouldn't have let him search anything, but I could tell this guy was good and meant no harm.
@Smiletony006 жыл бұрын
If you got nothing to hide, then just do what the officer said. Of course you are absolutely correct on “officers do not have the right to search your car or ask you to step out for no reason” but I think that just makes the officers think you are hiding something, just my thought!
I think the police didn’t have any reasonable suspicion , not to mention probable cause. In my opinion, the police behavior was “illegal search,” which means the police violated your right to the privacy.
Man, I am sorry for what happened. I don't think there was anything to worry. Normally you don't need to step out for searching, just simply for speeding. I got pulled over for traveling at 82mph in New York State and California. What happened was you were rolling your camera, taping him and traveling from Colorado. Also, you guys all look like Teenagers. As long as you guys stayed cooperative and mutually respective, the cops are usually very nice and polite. Better yet, get a Radar detector to avoid such trouble but they are illegal in Virginia, and WV.

I don't think it's legal for cops to search you and ask you guys to step out of the car without sufficient evidence before the search. You could have filed an official complaint against this cop and win.
Cops can't search your car without reasonable cause. You can't physically stop them. But you can say I don't consent to this search. Sometimes, even if they do find something illegal in your car, that search can be found to be illegal - if the officer didn't have reasonable cause. Also some times cops plant stuff or their drug tests come up with false positives! So I suggest donr't let cops search your car. Or at least verbally refuse to give them permission.
