My mom had a stroke while she was in the hospital and no doctor came or called when requested at the time when she had left-sided weakness. It wasn't until 14 hours later that a PA decide to show up and then found that she had left sided weakness and at that time decided to do an MRI. Indeed, she was diagnosed with stroke to the right brain. If the doctor had responded right away, the damage would not be as severe. But unfortunately this did not happen at New York Presbyterian Queens. And nobody wants to take responsibility and no attorney wants to take this case. Who can I consult with? Who is able to help? Is there still justice anymore??? Or is justice only limited to the elite and the powerful?

My apologies for the long winded post, but I felt compelled to respond. I'm a sonographer (ultrasound technologist); a Radiologist works at a facility and reads the imaging scans performed by the imaging technologists. Those scans are ordered by the referring doctor (in this case the OB/Gyn doctor) who medically consults with the patient. A Radiologist does not order scans or consult with a patient directly, the patient's doctor does that. A sonographer scans the patient at the facility, not the Radiologist themselves. Unless I'm missing something with this particular case. Now an appendix ultrasound is not typically ordered on an adult because it can be extremely hard to visualize and is not sensitive to a positive finding. A different modality is generally considered if appendicitis is a main concern. A CT or an MRI since she's pregnant are the best modalities for concern for appendicitis. It appears that a gynecological scan was ordered, which ultrasound is a great modality for. This includes the ovaries (right ovary being in the right lower quadrant). Now, IF an appendix ultrasound was also ordered, then yes, the Radiologist SHOULD have mentioned if the appendix was seen or not in his report. However it looks like this was solely a gynecological ultrasound that was ordered and the images presented did not show any abnormality in the right lower quadrant. A full grown adult can have a very abnormal infected appendix and still may not show signs of that on an ultrasound, because there can be a lot of gas, bowel and body fat that obscures it and it cannot penetrate through gas like CT or MRI scans can do. I find it very strange the Radiologist was found initially most liable in this case because he read what was presented to him on a gynecological scan. He cannot comment on the appendix if an appendix ultrasound was not ordered. I don't feel the Radiologist made a mistake here. The OB/Gyn doctor should have read that report, and when realizing it was not a gynecological or pregnancy concern, should have considered other sources of this pain and sent the patient to the ER. Love these videos; very interesting, insightful and informative!

Yes that is very insightful post. I would have to go back and look over the trial transcripts to see what type of sonogram was ordered.

Off topic but what happens when a defendant in a car accident lawsuit switched their insurance and is not cooperating with their previous insurance that they had when they caused the accident?
@AttorneyArkady Жыл бұрын
That scan actually be good for you bc their answer will be stricken and they will be precluded from testifying at trial. The insurance they had at the time of the crash will still have to pay

Not sure if you are still reading comnents but in hopes you are.....My mother was in a nursing home with dementia. She was seen by the RN for weight loss of almost 20lbs in a month. They noted to monitor intake. 5 dsys after this she was seen because she wouldn't wake up. They told me she likely had a UTI and did a urine test (we woukd wait 48 hrs for results) and left for the day. i called for EMS and hospital found she had severe hypernatremia. She died 3 weeks later. Is this malpractice considering the PA worked on a regular basis with elderly and i would assume should know symptoms for dehydration? I later got her records and found they gave her no assistance with eating or drinking for a month prior to this even though her intake notes clearly state she required it.

It seems like she's 50%-75% at fault. I had a ruptured appendix, and I went immediately to the ER. I'm not sure how to blame the doctor or the radiologist. Everyone knows if you are in pain, go to the ER immediately. My opinion of course.... I think since a baby was lost, they settled. The radiologist lawyers weren't open because she had already got 200k from the doctor....

@@AttorneyArkadyin your opinion which is harder to prove, medical malpractice or negligence, aren’t they both covered by the same rules? In my state malpractice has a one year statute where as negligence has a three year and seems easier to prove

The hospital i go to in Seattle WA Harborview has taken in many people who came over border & while i was there August a couple got into a verbal swearing match in Spanish the man stood over her ranting & raving. I told my doctor & she was upset with me. But i noticed at hospital all the people were coughing every where which i thought was unusual but my provider did not say anything about it iam sure its wooping cough very irresponsible to expose patients to wooping cough.
