In a world where we hear "only if the father been around" or "lazy dead beat dad's" and here's a man that wants nothing more than to see his son. This situation is messed up but our system is even more messed up. Now we have a child who will never have the chance to grow and know his father and have to live in the same house with the man the killed his father. We need to pray for this child. This a a sad story all the way around.

As much as I agree that courts irrationally favor the mother in divorces, I constantly see men who are divorced making extremely poor decisions, and they repeat that poor decision in their follow up relationships. I think as an outsider it is easier to see, which is why the grandparents really need to be involved to give their kids relationship advice (having gone through all that before). Unfortunately broken homes are self propagating things, the blind lead the blind when everyone thinks they can make their own decisions correctly, even when things keep turning out wrong. On a side note, any man who mutually agreed with his wife to divorce and they have kids I have zero empathy for him. As a parent your priority should be kids over your own happiness. I only feel sorry for the men who want to keep the family together but the wife is disloyal and selfish and want to leave. EDIT: Many comments below for example. Claiming their happiness is the child happiness when in reality children want both parents, not one or the other.

As a father that continues to struggle with custody for the past 5 years, this breaks my heart. So many emotions go into these situations. Unfortunately in many states Fathers have no rights and the rights automatically go to mom. Court battles can go on many years and cost thousands of dollars that add even more stress to a stressful situation. The main victim is unfortunately the son who has no father.

You'd be surprised at the amount of KZbin comments that argue in favor of this being self defense. I am bewildered. No one seems to realize.... look at Chad. Look at how big he is. Look at how easily he throws Kyle away from the porch after putting his hands on the carbine. Kyle's got no sling, in a grapple fight over a gun, with a somewhat significantly larger man. If Chad had any true intentions of taking it and using it on Kyle, he would have. Why would he ever let go of that thing? Why did he use it as leverage to spin Kyle off of the porch instead? I don't think Chad believed Kyle would actually shoot him. After the needless presentation of the gun at all, and the warning shot at his feet, Chad was convinced of this man's impotency. He made a grave mistake in underestimating how far Kyle would go over this bullshit.

As a former Texas police officer, I have become fairly interested in the Chad Read case in Lubbock, TX, as I have responded to and investigated numerous child custody and family violence scenes during my time on patrol. It reminds me of several experiences that my former coworkers and I have had. It seems that nearly everyone whom I have listened to speak about this case who has not practiced Texas law or has not been a Texas peace officer are likely unaware of a certain key statute regarding child custody that literally moves this case to another plane. The following is an investigative take of the situation based off of these two videos in light of this child custody statute (also, I reserve the right to be wrong lol) : In short, the Texas Penal Code has statute 25.03, which avers that it is a felony to violate a court order regarding child custody. (link below) My understanding of the case based off of the video footage is that Chad Read seemingly had custodial rights of the child at the time he was arguing with his ex-wife. In the video, it sounded like he was verbally elucidating that he was to be the rightful custodian of the child at that exact moment (as of 3:15pm), and the ex-wife was therefore actively violating this court order by not providing him with the child as required per the court order (this is assuming there was actually a court order substantiating Mr. Read’s claims). If the above paragraph is valid, then it seems that the ex-wife was actively committing a low-level felony (25.03) when Chad Read was killed. Further, if the court order stated that Mr. Read was supposed to be the rightful custodian at that moment, he was therefore not a trespasser on the ex-wife’s property because he was lawfully present in an attempt to get his son. And, if he was there legally, then Kyle Carruth had no legal standing or basis to tell Mr. Read to leave the property as if he were a trespasser. So, if everything is valid to this point, then when Mr. Carruth kills Mr. Read, it would be a type of “murder” due to Mr. Carruth shooting Mr. Read under the incorrect pretense of Mr. Read being a trespasser/burglar. (Note: I have heard an account where Mr. Read technically committed a burglary by stepping on Mr. Carruth’s porch during the ordeal. The allegation that Mr. Read “burglarized” the dwelling by stepping on the porch seems to be a damaging stretch of the law in this context and is likely spurious. On the contrary, it could possibly be argued that Mr. Read had a right to confront Mr. Carruth once he came out with the rifle because Mr. Read’s presence was legally justified under the court order, which meant the introduction of a weapon by Mr. Carruth was an illegal threat against him. Consequently, it may actually have been Mr. Read who had a self-defense claim in that moment rather than Mr. Carruth due to Mr. Carruth’s unwarranted threat against him in light of the court order context.) Also, you cannot shoot someone for merely trespassing in Texas. And, most importantly, if the ex-wife were presently committing a felony (25.03) by violating the court order regarding the child custody agreement, then she is therefore liable for “felony murder.” That is, she is liable for the murderous act of Mr. Carruth, as her 25.03 felony precipitated the shooting. This child custody statue is pretty straight forward with few exceptions, and it makes this an interesting case. A deeper discussion of this point can be found on KZbin channel “Dirty Hands of the Republic” in which a senior Houston Police Officer and a former Houston Police Officer (now lawyer) lay out this 25.03 statute in the context of this Lubbock shooting. My Opinion from the video Mr. Read was trespassing and wrong the ex wife told him multiple times that their son was not there on the property so therfore making Mr. Read a trespasser and the moment Mr. Read threatened and went for the firearm the perspective of the individual with the firearm is what matters if he truly felt Mr. Read was indeed going for the firearm to do him harm he is justified in defending himself. Mr. Read should of left and let the police handle this matter when the firearm was deployed.

Very interesting, Does he (the father) have a right to go onto a 3rd person's property to attempt to retrieve his son when he isn't aware that he's there? It sounded like he was convinced that the child was at a different location. Additionally I don't see in the penal code that the father has a right to "trespass" to attempt retrieval in the case of a violation of 25.03, I'd be interested in seeing if that is in the PC anywhere. Will be interesting to see how the case plays out.

Untrue. He has the legal right to see his kids, but court orders don't specify that he can just waltz onto any property to do so. You agree to that with the other party. Even if that party stop upholding their court orders, you can't just show up at their doorstep without permission. It's still trespassing.

It would’ve never even got to that point if the little guy would’ve just went inside his house and waited for the police to get there. But this was an ego battle and that’s why it ended the way it did.

Going to be very hard to convince a jury to see it as trespassing even if it was. Law is black and white sure, but that doesn't mean the law won't be decided on emotion. I'd find the shooter 100% guilty of murder, and I personally believe you have the right to gun down threats, and that you should. I'm just not seeing a threat man. I'm seeing a guy who is being denied his right to see his son and another guy who wants to be seen as a badass. My parents divorced when I was 3 and they hated each other. Neither of my parents ever told the other fuck your pickup time you'll get him when you get him, and I was never allowed to be anywhere but that pickup location unless clearing it with however was picking me up.

If I was that new boyfriend and I told this man to get off my property, he has no right to be there, he's a trespasser, and he better leave if he wants to be alive long enough to see his kids. Wife said she didn't think it was a real gun. Maybe an airsoft gun or something of that nature. It sounds unbelievable but I don't know, I can understand maybe the reality of the situation not hitting her in the moment because it was such a crazy thing that happened. One second they're verbally arguing without physical conflict, the next there's a rifle and your husband is on the ground. What happened, happened very fast.

She knows from the court order she is suppose to give the father the kid NOW, but she's sent the kid off somewhere so he can't pick up the kid like he's suppose to. Which is why the father is talking about what will happen in court. Not saying he's going to kick ass, saying he's going to do court stuff. So then this asshole fetches a gun and shoots the father.

The mom and boyfriend wanted this outcome in my opinion. The wife had been playing games with the ex for awhile it appears. I’ve been down that road with my ex. We had an agreement between us and the state. I showed up to get my kids and she said no. So I called the cops. Showed them my paperwork. He walks in the house is inside less than 2 minutes and comes back out and says sorry I can’t help you. I can’t force her to give you the kids and drives away. Then what is the point of us having an agreement between us and the state? This mother was escalating the situation and had been for a while. Unfortunately they will probably both get away with it.

Toxic mothers who do this to their exes know how the system works and it's exactly why they play these games, they want to punish the fathers at the expense of their children.

Wow, this is incredibly sad. A man is now a killer, a father lost his life, and a son grows up without his dad. All because of competing egos and flaring tempers. The guy with the gun should have just waited for the police to arrive. Once a firearm was brandished, the father should have just left. So many chances to avoid this disaster. From the looks of it, the guy was lights out, but SOMEONE should have been attempting to administer aid or call for EMS. What a sucky situation.

As a dad who has three kids and an ex-wife, I understand frustration with the dad. The dad in this case, was there legally to comply with court ordered custody exchange. I believe I could hear that the mom had not complied with the court order previously. Mom obviously manipulated these events.

He was there legally... Until he let himself get his buttons pushed, as was obviously the trifling heifer's intent, and was instructed to leave. At that point, he should have gotten in his vehicle, parked in the street, and called the cops to come enforce the order.

If the father had done the right thing he would have left the property and called the police to enforce the custody ruling. The stepfather is within his rights under Texas law to be armed on his own property. He got a long gun to defend himself self against the obviously over aggressive father and never aimed it at him until he threatened to take it and tried to. Are custody battles frustrating? Yes but that gives no one the right to trespass and make threats. To me someone who grew up around domestic violence the father definitely gave the impression of a domestic abuser and a bully.

@@michaelmoody3737 I am going to address this from a legal professional standpoint. Though that is from NC and a comparison on legal standards. Both TX and NC have same standards for armed status on own property. HOWEVER, both also explicitly require a clear immediate threat of serious bodily harm or death to bring that weapon into play. Frankly, from years in the profession, there was zero credible articulate argument from the "Stepparent" to justify the brandishing of a firearm. The moment he brought that long gun out at low ready, that is brandishing. As for NC, I can tell you that would be a Class 3 Misdemeanor. Now as to the father on property, he was there initially legally to pickup a child for court ordered custody. His statements regarding subpoenas for court is not justification for a lethal weapon. Second, his body language, distance etc doesn't indicate an articulable threat. Third, the discharge of a "warning shot" is virtually illegal in every single jurisdiction that I am familiar with. Both from a personal or professional standpoint. The moment the "Stepparent" fired the shots into the ground by the man's feet with zero immediate threat of serious bodily harm or death. That man had every right to engage. Trespassing is not a lethal force justification in TX or in any other state (NC). Lastly, failure to render aid is further demonstration if lethal intent or premeditated intent. If this was my case, the Stepparent would be charged with 1st Degree Murder. Elements as follows: (1) No justified self defense as no immediate threat of bodily harm or death at time weapon was introduced. Yelling "subpoenas for XYZ" doesn't suffice. (2) Brandished firearm with intent to escalate (3) Illegal discharge of a firearm, reference #1 (4) Fired with terminal effect with again reference to #1 (5) Failure to render aid indicative of premeditated intent to cause death of subject. As there was no continuing or immediate threat of serious bodily harm or death. Therefore, duty to render aid applies.

He went inside to retrieve his firearm, which is 100% legal in Texas. He had already verbally trespassed Chad, and Chad refused to leave, authorizing Kyle to use non deadly force to remove him. Texas defines simply holding a weapon while you order a criminal trespasser off your land, use of non-deadly force. Then Chad attacked him and justified use of deadly force

It's not the bf's problem. And the bf should be able to walk out on his very own front porch with a gun anytime(threat or not). How the Dad reacted was his choice. Even if he was justifiably angry over not getting his child/children. Once the Dad moved forward and got in the bf's face, threatened to take it away, bodily harm and then put hands on bf and spin him off the porch? I'm not sure why you think the bf deserves life in jail?

@@1984Pturner the boyfriend (Kyle Carruth) was not threatened before grabbing a firearm. And no you can’t just go grab a gun on your property whenever you feel. If you do while in a confrontation the castle doctrine has to have proof without a reasonable doubt there was life threatening harm to Kyle. If the husband was there on a lawful visitation order he would then be in the right. Case and point you’re not a cop, don’t be a tough guy, and last but not least, pulling a gun to win an argument cause you have a fragile ego is not a good idea.

I am a dad who has to share his kids with a woman who has a new husband. This is so incredibly hard to watch. I understand the dad’s position. He had a scheduled time and the mom violated it. However, it’s the nature of the beast, it’s still the other mans house. Do not lay hands on him. I really feel for the dad as he is trying to get his kid and is passionate. I would have never escalated to that point of laying hands on the other man. I would have said my piece from the street and called the police.

I have not been in your situation. But for me, I would document the violation and then seek a contempt of court order. Now the mother's idiot boyfriend/whatever will at least face a civil lawsuit and perhaps criminal charges which will bankrupt him and mother will likely lose joint custody. All because the dude thought with his penis. And father? He's dead and all his family gets is a lawsuit suing a loser who likely has no money to recover from. Pathetic outcome by people who do not think about the responsibilities that come from owning firearms. This video is excellent.

Shock is an absence of normal function due to trauma, not hysteria. It could take a couple minutes for the adrenaline shakes to set in. Until then he's still hyped in fight-or-flight, and first aid isn't either of those. As for the women and bystanders, odds are 99% likely they have zero tactical training so the concept of life and death and the fragility and ease of losing/taking life is completely alien to them, so shots fired = ..... 404 system error: file not found , especially since it was so calm and almost theatrical in how he immediately fell down and there's no blood. As soon as you can visibly see him losing his life or that he's severely hurt, whether that's massive blood loss or groans of pain or death gasping or death twitching, then reality will hit the bystanders like a freight train, and seeing the bystanders reactions often set off the shooter's realization.

If you read one of the accounts of the woman filming, she said she thought it was a paintball gun or something because of the sound of it. It was a super suppressed sounding 22lr pistol with a stock…I think they didn’t realize he had just been killed

I go through this every time I pick up my son. The only advantage is I have firearms and I’m trained .. new boyfriend is a convicted felon who can’t own guns. I have footage of him trying to square off on me. It got to the point where i got an assault charge for hitting him. It’s hard to go through what this man went through, you just have to see more than you. You have to see your kids. If I’m in prison I can’t care for my boys. Good news is judge was on my side. After this happened Texas is realizing how the system is failing fathers. I now pick up my son at school .. don’t deal with them anymore.

I haven’t spent time with my son for 4 months and will probably miss Christmas with him because the lawyers are dragging their feet. Last time she did this the judge didn’t hold her in contempt. So she learned she could get away with it. I can only imagine how impossible it is for fathers who can’t afford a lawyer.

Mom had a friend who was on his girlfriend's property trying to see her and her dad stepped out onto the lawn and shot him in the head with a shotgun cops never arrested the man because he was on his own property defending his home at 2 in the morning. Cops wont do shit but tell you it is a custody issue and you need to go back to court$$$$$ and plead your case to the judge. So the mom will get a butt chewing slap on hand and told by the judge to let the dad see his child , and the dad will spend his hard earned money maybe even havevto pay more on child support if he is hit up again by the mom while in court. I was met by my exs new husband while i was dropping off new school cloths for my son, he had left in my car. So this fucking deushbag comes outside with his AR15 , starts talking shit while im driving away after my son goes back in the house with his cloths. Called the cops they didnt even come, told me it was a custody issue i needed to take her to court. When seconds matter, cops are minutes away.

Update: The Grand Jury declined to indict Kyle Carruth. If you ask me, he got off very lucky. All of these people sound like real winners. I haven't seen my daughter in months and I have spent thousands in attorneys fees fighting for mine and my daughter's rights. I saw myself in the man who was shot because I've been that upset, but I know I have to navigate the corrupt family court system in Texas and do it the right way. But there are so many dads who don't have the resources I do nor the temperament to ride out a vindictive ex. I think the new boyfriend, the state of Texas family courts and Texas Attorney General should be found guilty of murder and for profiting from the division of families. The Texas AG makes 70 cents on the dollar from the federal government from child support funds paid by mostly fathers. Then the attornies profit massively pitting fathers and mothers against each other while contributing generously to Texas elected officials. This poor man paid the ultimate price for this corruption. I can only hope his death will bring about change in the state of Texas.

Here in NC it is starting to turn around quite a bit. Courts are recognizing phych studies that point to the necessity of the father and mother in a child's life and side more with 50/50. Don't get me wrong there are still some crap judges that always push for mother's getting primary custody. Also we have to play ring around a rosey with mediation and all that mess before even entering a court room. That is where it is mostly ran by man hating feminists which mostly side with the women and limit the men severely. We have to hold our ground and not budge. Now after court and stuff the police never really want to haul off a parent for not following the court orders and typically treat these cases with kid gloves never backing the parent who needs the law to do what it's supposed to do. That 0 accountability causes these type tempers and situations. It totally sucks.

As someone who lives the life with a vindictive Ex wife, I think its important to remember the role that the "mom" played in this situation. "warning" shot for no reason. That warning shot could be considered provocation or dangerous, so the prosecutor could argue the father was defending himself when he went for the grab. Also, he got shot when he was just standing still in one spot, he wasn't chasing after him.

That appeared to be an accidental discharge. Not a warning shot. He was exercising proper trigger safety until he was battered. He never pointed the firearm and was on his own property. Simply possessing the firearm is not deadly force or threatening deadly force.

As a father who was actively prevented from seeing my son, I can absolutely understand the anger at the custody games she was playing. As a man, the shooter was absolutely an asshole for perpetuating the mothers games, and was way out of line to even get the gun, let alone fire. Now, all that said- we the public only know what the video shows. As Colion and John both allude to, seeing only this little snippet shows nothing of prior engagements and what the context was, with regards to all involved. This could very well have been totally justified behavior if the decedent had initiated or threatened violent conflict previously. Still, as a man, he should at least have had sympathy with the father over the angst he was dealing with over the child being withheld, when those hours of visitation are precious and brief.

Being armed when confronting an unknown trespasser on your property is NOT the same as having an argument with somebody you know, telling them to leave, and then fetching a gun in order to intimidate them into leaving.

For someone who “didn’t want to do it” he got a gun fairly quickly which is NOT a great way to DE-escalate a situation, and also shot fairly quickly. There are times when you need to defend your woman and times when she is just WRONG. This time she was wrong and the boyfriend may have over-reacted and a man who was justified in being angry, and who wasn’t really threatening violence was killed. I feel like a little brotherly empathy could have done a lot to have actually de-escalated this situation.

Yes, I have seen vindictive parents who are separated. Now, because the mom didn't do anything to de-escalate the situation...her son's DAD got shot. And the son is who my heart goes out to, most.

This is way late but the mother is the one that caused all this because she was interfering with custodial rights. She should have gotten hit with a capital murder charge, IMO, because someone (the father of her child) died during the commission of a felony she was committing. But in the gynocentric court system that will never happen.

I think a lot of people misunderstand the concept behind the castle doctrine. It's not a blanket immunity that allows you to shoot anyone who sets foot on your property, or even in your house. All it means is that given no information to the contrary, you can assume that an unidentified person in your home is there to do you harm.

Exactly! a lot of people miss this point. The idea is you get the benefit of the doubt because you shouldn't have to risk your life trying to figure out if someone is or isn't a threat when you are on your own property. This does apply here because the ex husband had been clearly identified and hadn't show himself to be any threat of physical harm.

He touched the gun at one point AFTER the guy already fired a warning shot which can easily be argued as the ex-husband acting in self defense. The new boyfriend simply steps back, not being chased, and fires two shots and literally murders him in cold blood. He was in no danger at all.

Hey, John, I’m from the city where this happened. The shooter’s ex-wife is also a judge here and, I believe, signed an order for the case to be sealed, so that’s also why there may not have been a ton of coverage or info out. The lawyers for both sides finally released the videos last week. Couple have judges have already recused themselves from the case.

From what I read, Carruth's ex-wife who was the judge recused herself as you said. As did the Lubbock County DA and the judge who was to preside over the wrongful death civil case. A prosecutor has been assigned from the Texas AG's office, but I'm not sure about names. No idea about the civil case reassignment.

Also did he shoot a warning shot into the air? If so that's extremely irresponsible to do for a gun owner.

@@isucc3817 Realistically if he did shoot the dude at the same moment he took the warning shot, it probably would have been justified. When he actually took the shot though, it most likely wasn't. He still probably won't be prosecuted either way

I have been in his shoes, she assaulted me and then claimed I hit her. My hands were in my pockets the entire time, even when she picked up something and started hitting me.... because I outweighed her by 100lbs and could have easily ended her with one hand.. but I did not. The man is always guilty, the woman is always the victim, that is the way society and the state functions.

My mother was the definition for "evil" when it came to her and my father's split. I as a child (I might have autism) asked too many questions and hard a high pain tolerance, witch lead to years of finding out truths the hard way... bless my father for going through hell and back. He spent un deserved time in jail, lost friends family, emotional trauma and spent endless sums of money to be apart of my life. All the while I was neglected, abused and used as a pon. Watching this I could easily see my father in the dad's place. (He beat up alot of my mom's bf's) it's sad. It's upsetting, but at the end of the day the only lessons my father and this video have shown me are: keep your emotions in check. Think about this situation and act accordingly. But most of all just like they said in the video think "tactical". "Win the war not the battles as my father said." He pulls gun, ok b!+ch boy. I'll wait out side for the cops to get here. Just wait I'll catch you at the grocery store or gas station and u won't know what hit you, but ull definitely know you've been hit. At the end of the day your goal is to see and be apart of your sons life ❤. Getting in a $h!+ talking or pushing match won't gain you that especially if the other person has a gun. Fall back and wait...

Both parties - Blue Shirt could've de-escalated by calling cops to that residence (just like he did to his ex-MIL's house), walked off the property, and waited for cops - Black Shirt could've tried to calm everything down instead of grabbing his gun considering the custody battle has nothing to do with him - Mother of Kid could've just told the truth of where the kid is and let Blue Shirt get their kid - Black Shirt could've called the cops after telling Blue Shirt to get off his property, stayed inside with his gun, and waited for the cops - Blue Shirt could've walked off property, called the cops, and waited for cops to arrive after Blue Shirt saw Black Shirt come out with a gun

That was such a morally corrupt shooting, she held the man's kid from him, antagonized him, and ultimately her boyfriend pulled a gun on him. It wouldn't be a stretch to say this was premeditated murder in the since she purposely got him frustrated snd heated enough to have an excuse to kill him.

I’m interested to know the backstory on this one before I decide if it was “morally corrupt”. The father seems to be a bully who is not used ti anyone standing up to him. It will be interesting to see what comes out on the backside of this. There is a lot to reconcile in this incident.

I think its more shock seeing someone gunned down like that creates a very off atmosphere which leads to anger, blame and denial.
