I am an attorney who has handled securities fraud and a multitude of other types of financial criminal matters. It is rare to see a journalist handle a difficult interview in such a complex case with such balance, fairness, and integrity. Precisely the right questions asked; precisely the right degree of follow-up; and precisely the right measure of skepticism of both sides to promote the public's interest in getting to the truth. I was very impressed by the skill in questioning and the way facts were drawn out during the questioning. I learned a great deal about the overall situation as a result. My take is his handlers had agreed to the interviewee controlling the narrative in exchange for the first interview. The narrative being to clean my record, for I was had by a corrupt legal system and I have a book that goes into more detail. It accomplished this but little more. I did not notice much push back but I assume if he stays on the circuit he'll get exactly that. It was worth my time but I'm left wondering what the other side had to say. I am well aware of prosecutors deep competitive unfairness and this could easily be a case of that.

Why Steve Cohen personally got away from prison . Some of his employees went to jail and he settled with court by paying huge fines in millions. It was unfortunate by his aggressive behavior with the help of FBI Barrera was able to get conviction for several minor employees only. He never nor his successors prosecuted using a disputed law after these90 cases. Even now the law is not resolved. Only congress can straighten this disparity between the courts and SECs definition of insider trading definition. Unless this is resolved there is a possibility of another aggressive district attorney may use this same tactic if a judge was willing to go along with him even though the law is weak.

Just finished his book and would recommend it. His version is that he got picked on by district attorney who himself didn’t understand what constitutes inside information. Based on his book it appears he was either doing the the opposite to what the tipper alleges or his team had already found that information legally and had traded prior to it. However the prosecutors, judge and jury didn’t understand markets and hence couldn’t understand what is legal and what is illegal. I plan on reading different versions of the same story from Preet and Gupta next. I remember reading books on the insider trading scandal of the 80s where people were just fined. Similarly after the banking crisis the banks were bailed out and no one responsible went to jail. But for political gain one south Asian prosecutor picked on other South Indians.

I remember listening to the audio tapes of the phone call some 10-12 years ago where Rajat Gupta clearly said something to Raj along the lines of "hey, this just off the boardroom..." and proceeds with the tipping. So when Raj says no one told him, "hey I just got this from somebody", that's really hard to believe. And if 100% of his trades were based on the written statements of his 35 analysts, why is Rajat Gupta's tip on the call "news" to Raj? Just as Raj is guilty, Preet Bharara is equally guilty of muddying up the waters to make the case. But if Raj is guilty, so are most of the "fund managers", just not convicted yet. Justice is a joke nowadays, not a "bedrock" of anything. But we wanna go on believing that, don't we? EDIT: “Yeah," says Rajat Gupta. “... this was a big discussion at the board meeting" to buy a commercial bank. Lookup the audio tapes.

Here is the review from Amazon -“Raj Rajaratnam, the respected founder of the iconic hedge fund Galleon Group, which managed $7 billion and employed 180 people in its heyday, chose to go to trial rather than concede to a false narrative concocted by ambitious prosecutors looking for a scapegoat for the 2008 financial crisis. Naively perhaps, Rajaratnam had expected to get a fair hearing in court. As an immigrant who had achieved tremendous success in his adopted country, he trusted the system. He had not anticipated prosecutorial overreach-inspired by political ambition-FBI fabrications, judicial compliance, and lies told under oath by cooperating witnesses. In the end, Rajaratnam was convicted and sentenced to eleven years in prison. He served seven and a half“

These mfers make billions on inside information & leave the individual investor holding the bag. I've seen it hundreds of times: a stock will suddenly drop for 2-3 days on no news & then the company will make an announcement -- earnings miss or some other calamity -- & the stock then craters. Just looking at a chart you can see the huge exit that took place prior to this announcement. This is not "research" or "analysis" -- it's purely illegal insider trading. It's a travesty that the SEC is asleep at the wheel. Sorry, not buying his choirboy stories.
