In case anyone was wondering, the reason cops can search trash is due to the U.S. Supreme Court case of California v. Greenwood, 485 U.S. 35 (1988), this case was also clarified further in North Carolina v. Hauser, 342 N.C. 382 (1995). The cases were very interesting to learn about

If you consent to a search by an officer, you can revoke your consent at any given time. And if you consent to a search of your property, you can authorize them to search only certain parts of your property. Edit: Voluntary consent can only not be retracted if the officer finds something that gives them probable cause. Edit 2: I'm seeing some replies about officers saying they'll search the property anyways because of 'reasonable suspicion'. Probable cause is required to search the property, and I quote "Search Authorization based on probable cause is required to conduct a lawful search." Police can only frisk you with reasonable suspicion. The second they search a pocket, purse, car, or other property based off of reasonable suspicion, becomes a violation of your 4th amendment rights. If the officer claims that they now have probably cause to search your property, they need to be ready to prove that you did something illegal, or they found something illegal. Warrantless searches based off probable cause could be because of exigent circumstances, plain view, and hot pursuit. There are more, but these are fairly common. Exigent circumstances - The suspect is trying to get rid of any possible evidence, and the officers need to get in. Plain view - illegal contraband was in plain sight of where the officer would reasonably be able to see it. (Ex. From a public sidewalk, on a table at a restaurant, in an open field *without no trespassing signs*) Hot pursuit - a suspect the police were pursuing entered a building. If you ever get into a court case over an illegal search and you believe anything illegal is planted, you can order that the police turn over any video footage from the search. But you'd need to do it ASAP. If any video footage is destroyed, or the cameras were off, you can just let your lawyer handle the rest.

Partially true. Even if they find evidence you can still withdraw consent. They can then only continue searching based on one of the other exceptions such as exigent circumstance for a car or needing to get a warrant for a house. Of course they will now have PC to get a warrant but consent can still be withdrawn. It does not matter if they already found something.

Even if you didnt have anything to hide and THEY forcefully take yo shi and look thru it without asking PERMISSION or sneakly tries to feel / see whats inside without doing it all the way to then say "i have reasonable suspicion there's something illegal in here and i will search it.." and not to mention cops have been known to plant shi and get people in trouble , ruin whole life , etc . All because you didnt say to them "I do NOT give you consent to search my bag" So yeah always say No . theyre not your friends who you gave permission or family neither.

I’m in the UK, had police knock on my door asking if they could search my land for a missing person, only 2 acres, a mix of woodland and grass, and then tons of coast guard people also came on to search, person was found safe at their mothers house at the end.

I think it varies about state about the trash. For example, I believe it’s illegal in Oregon for cops to search trash without a warrant. There was a court case about it and now trash is considered person/private property or something along those lines.

In california vs greenwood, the supreme court ruled that police can search trash cans that are on public property but they can't if it's still on your property. This includes citizens searching your trash too.

Wrong. It is still personal property and cops cannot dig in it if it's on your property. But when you move it to the curb then they can legally go through it without a warrant cause then and only then is it considered trash or abandoned.

My sister was dating a drug dealer back in the day and she told her boyfriend that she saw someone walk up to their trash cans and wheel them away. There is a way to walk away without having problems. Ask if you're under arrest. When they say, "No," ask if you're being detained. If they say, "No," wave "bye" and be on your happy way. If they say you're being detained, ask why and if their answer doesn't express probable cause, tell them that if they want more information, they'll have to either get a warrant or arrest you. If they still won't back down, stay calm, go along with the detention, then get a lawyer after. But that's all very unlikely to need to happen.

I remember a court case in Seattle about this and they ruled very differently. It was about the garbage company searching customers trash to see if they were properly composting and the court ruled that they had a reasonable expectation of privacy.

Under the Fourth Amendment, our person, home, vehicle, and other private property are protected from unreasonable search and seizure by law enforcement. There is a Supremacy Clause in the constitution, anything not not amended into it isn't legal regardless what the government says.

@@maeamong_thest8rs I was talking about them searching your land with some "open field" bs. If my property is registered as private, they cannot come onto it with the intent of searching it without a warrant regardless of what other laws say. As for the trash bin thing, they mind as well be able to unlawfully search your car if you're parked in a parking lot or on the street. Doesn't jive with you, right? Why not just let them search you're backpack as well because you were walking in a public space? 4th amendment is clear and they're trying to find ways to make you think it's lawful to illegally search your property. If the trash bin has to be opened and the bin belongs to you they need a warrant. Letting them search your stuff unlawfully is opening a can of worms were they can look for a reason to arrest you. Probable cause is key and if they have it, they can get a warrant.

The actual language is “persons, houses, papers, and effects” which is why this issue has come up. If it said property it would probably be hard to interpret otherwise

@@bendavidson1210 if they're desperate and searching through the trash to find a reason to make an arrest, it's still entrapment which is illegal. If they can't secure a warrant, you're innocent until proven otherwise.

@@sickranchez6183 That’s a common misunderstanding of entrapment. To successfully raise an entrapment defense a defendant, among other things, has to show that law enforcement induced them to commit the crime that they are being charged with. Finding evidence in the trash after-the-fact is not inducement. Regardless, I was talking about open fields. The issue is that open fields, even on private property, are not easily understood as being part of ones person, house, papers, or effects in a literal sense.

I just realized the sneakiest easter egg in a Mike vid! If you look VEEERY closely at what the cop is holding at the start of the short, its a round circle thing with "Los Pollos Hermanos" written on it. Los Pollos Hermanos was a very popular fast food chain in the 1930s, that exploded in popularity because of its crispy chicken. But the owner of the chain was also an imporant drug dealer, and when the police found this out, the chain was officially shut down. Also, the owner of Los Pollos Hermanos died in a... "blue funny crystal" related incident. So, yeah, cool easter egg mike! Pin?

Mike! A month ago I got pulled over for no reason, and I was given a ticket for something I thinks not a crime! See, when I was pulled over, when the car was in park, my daughter unbuckled, before the cop came to the windows were he could see her, and he gave me a ticket for that! I went to court and they decided not to charge me, but is that really a thing?
