The evidence suggests that Rayner may face legal consequences for making false declarations on the electoral roll and potentially violating tax rules regarding primary residences.

The value of this ex council house could at the most have been liable for a couple of grand capital gains tax. @@mikescott2099 I doubt that, you might get a penalty from HMRC for unpaid tax, but it seems to be such a complicated arrangement with capital gains tax that she could probably claim to have made a mistake. It's not like the rules are really that clear and if the house did not go up in price much, the capital gains tax threshold of £6,000 per year may cover the increase anyway, so no tax would be due.

It's not just the sale of the property though is it. If she didn't live there who did, and did they pay her rent? If so the income from the rent is also taxable. If she did live there as she claimed she should be able to produce utility bills, council tax etc. addressed to her and demonstrate that she paid the bills. It's easy to resolve of there's a will to do so and there lies the problem.

Was it just sitting there empty, gathering dust? Or had it been let out? And, if so, apart from the CGT point, is the Growler guilty of not declaring that rent to HMRC? There’s also the small matter of breaking electoral law by not declaring the right property for voting purposes. And the Council Tax position on Vicarage Road. Was it paid as it should have been if the property was empty, or with the 25% rebate for single occupancy. Or was it paid by somebody else entirely, because they were a tenant there? Clarity is needed on all these points, but many people seem to want to sweep everything under the carpet instead…

If she didn’t understand her tax liability then she shouldn’t be in politics let alone the Labour cabinet. Home ownership CGT rules are not complicated so no need to find excuses for her. Of course she knew her tax liability. The home she had with her husband is presumably worth more so she should be paying CGT on the ex-council house. Having said that, she got the ex-council house for a song so there might be a bigger tax bill there. One rule for the ordinary person and another for a politician.
