Under British law you can’t will away a title or entailed land. Only the reigning monarch can award or remove a title. Only money or unentailed land can be willed away from the heir,

So true, the story was lovely in all other aspects, but this part wasn't working for me at all.

Not enough research can really sink an otherwise good story and I was thrown right off by that massive gaff about the supposed ability to disown the heir from inherent heir rightful Dukedom. Only Death or the Royal House could take that away from Victor and to have the At the time King remove the title he would have to have done something ultra serious ( like treason) and not carrying his father's chosen bride would not cut the mustard to remove him from the title. Even if his father 'disinherited ' him Victor would still have become Duke after his father's death and any entailed estate would still be his no matter the estates condition.

In every other historical romance where the father disinherits the son there is no way to take away the title from the son.

Not just in historical romances but in real life history. The whole concept of primogeniture is that nobility is bestowed by birth. Fathers in a pique cannot change the fact that their eldest son would become the rightful heir to the title and all entailed property upon their death. Full stop. I get that this is a work of fiction and we are supposed to suspend belief but a plot twist of a nobleman putting a codicil in his will to disinherit his rightful heir is kind of like inserting a space ship to beam the hero and heroine up and fly them away to Pluto.

The title definitely goes to the first born and possibly the estate if it is entailed with the title. However, if the estate is not entailed then he can leave that and it can be inherited by a different child and money can go to whoever you leave it to. Though it used to be very difficult to leave money to a women, mostly it had to be left in a trust. I think that I heard once that it was 50-70% of land in England that was entailed at some point.
