Can’t government change the rules when they want making a trust invalid sometime in the future?

To the best of my knowledge there has never been a change to rules that affect exicsting trusts. Any rule changes normally affect new trusts.

@@Inheritancetaxadvice I think you will find that there was a trust arrangement setup through Halliwells Solicitors in conjunction with St James Place Capital which put family home into a trust and that trust loaned it to another trust. The sale was made with an exchange of contracts triggering Stamp Duty at the market price but an open date for completion. It was the first time when the rules were changed by HMRC and applied retrospectively. V costly for those affected as the Stamp Duty had to be paid again as each trust was unwound and returned to original vendor.

@@angusg220 Hi Angus -yes but this was not retropestive changes to existing trusts - this was a company working to the letter of the rules but outside the spirit of the rules and HMRC adjusts the wording to stop abuse.
