This video will explain the nine requirements for operating under 49 USC 44809 for recreational UAS pilots. Remember! If you fail to meet one of these requirements, you are now operating under Part 107!
If you are part 107 certified, you must choose which set of rules to operate under prior to your flight. You are not permitted to change rules halfway through your flight.

The nine requirements to fly recreationally under USC 44809
1. Fly only for recreational purposes (enjoyment).
2. Follow the safety guidelines of an FAA-recognized Community Based Organization (CBO).
3. Keep your drone within the visual line of sight or use a visual observer who is co-located (physically next to) and in direct communication with you.
4. Give way to and do not interfere with manned aircraft.
5. Fly at or below 400' in controlled airspace (Class B, C, D, and E) only with prior authorization by using LAANC or DroneZone.
6. Fly at or below 400 feet in Class G (uncontrolled) airspace.
7. Take The Recreational UAS Safety Test (TRUST) and carry proof of test passage.
8. Have a current registration, mark (PDF) your drones on the outside with the registration number, and carry proof of registration with you.
9. Do not operate your drone in a dangerous manner. For example:
a. Do not interfere with emergency response or law enforcement activities.
b. Do not fly under the influence of drugs or alcohol.

I bought a Holy Stone drone and now think it might have been a mistake. I registered it, did the TRUST test, have flown it from my home which is a challenge with trees, fences, bushes, etc. The problem are restrictions everywhere. We have a natural park within a half mile but you can't fly there, schools with large open areas and generally no one around, can't fly there. In order to join a group of RC plane operators it will cost me $150 per year and I must schedule my flights well in advance , like 2 weeks is recommended. So far in doing the research I have found no place reasonably close to fly. This is not what I had in mind. This is not "fun" or recreational.

I am 81 years old and started flying model airplanes in the late 40s. I have flown R/C pattern competition, control line, and free flight. When the government started regulating the model hobby I hung up all my planes rather than have the FAA come to my house to confiscate all my planes because someone else screwed up. Also, if they cannot tell the difference between free flight, and control line as not being drones, they do not know the difference between cars and airplanes. But they love to control people and could care less they have destroyed a great hobby. I am retired and on a fixed income and have no provisions for 10,000 dollar fines. It makes no sense to me. I have no desire to go to court to let two lawyers decide my fate. Power corrupts, and absolute power corrupts absolutely. No matter what you do with your planes they will find a way to destroy your life. Not worth it. A control line airplane is no different than a kite never getting over 70' from the flyer.

I'm not far behind in age. Within a few months after I bought my first quadcopter, the FAA announced that drones were to be regulated. Recent events bring to mind the question I had after that announcement. Rephrased for the context of current events, "Why are there so many rules for toys when a kid who just turned 18 can buy two assault rifles in Texas, and shoot up a school?" Where are the training, testing, licensing, requesting to use, certifying compliance with organizations, etc. for using firearms?

Drones do not kill people. People kill people. Guns do not kill people. People kill people. I have been flying model airplanes since I was 6 years old. Never once has one of them killed anyone. I have owned a few guns. Never once have any of my guns killed anyone. The gun did not go in that school by itself. He could have done the same damage with a pipe bomb. Government agencies love to make it look like they have solved the problem. But they never do. Chicago has the highest gun laws in the country, and 43 people were shot and killed over the weekend in Chicago. Where I live everyone has guns. There were no people killed over the weekend by guns. If you take the guns from law abiding people only killers will have guns. Cars do not kill people. People in cars kill people. Gods laws never stopped people from breaking them. We live in a fallen world. It will only get worse.

Just bought a DJI MIni 2 which technically is below the 250g rec usage limit, but my county requires registration regardless, so register I did. The big challenge I am now finding is a place to fly given restrictions beyond just FAA rules. I thought I knew a place, drove down there to find a US Corp of Engineers no drones sign. Most of my questions were not from any practice exam I have ever taken. This by far was the hardest exam I have ever taken in my life. That air control app is also a great way to get in touch with the correct contacts if you wish to fly in those air spaces. The location I went to, in addition to the reference booklet, sheet of paper, and a pair of pencils they also gave me a clear sheet of laminate with a dry erase marker and eraser. That helped greatly with the few questions dealing with looking xSM away from a location to get an exact fix on what they were asking for. Between watching 2-3 in-depth videos (1-3 hours long each) and a couple flashcard style apps on my phone is what I used to study.

Great rule summary video, thanks. Please also emphasize the importance of courtesy. But just because you can do something legally, doesn’t mean the behavior is in the best interest of the sport. Just like dirt bikes, pretty much everyone who doesn’t fly drones, hates drones. If you take your drone to the lake and fly around someone out in a kayak, or fishing or over houses in a quiet neighborhood, then you’ve just made a drone enemy. We’re fighting an uphill perception battle, it takes effort and awareness on our part, if we don’t want even more rules and restrictions.

That's a great point. I recently retired from the Army as a UH-60M pilot and I'm interested in getting a drone. Right now it is just for fun and to learn about it, but I may start investigating into ways to make money using it. Do you have any recommendations for a good drone, especially a quiet one. I have some neighbors in my neighborhood that fly around with drones, and I am surprised with how loud those little rotors are. Even at about 300 feet, the buzzing noise is noticeable. I don't want to bother my neighbors, especially because my neighborhood is directly under a flight route from the nearby base and I'm sure everyone here is annoyed enough at all the UH-60's, CH-47's, and AH-64's that pass by overhead.

I have a brand new DJI Mavic Air 2 still in the sealed box that I'm too afraid to fly because of all these rules and regulations and tests requirements. So I bought a new DJI FPV drone thinking that I didn't have to worry about rules only to find out that now FPV is regulated with rules and requirements. Technically yes, but really, how many FAA inspectors are out there? Not many. And are they walking around with a calibrated scale to weigh drones? They're only going to actually be interested in you if you're being dumb enough to fly around an airport or heliport.

Hi Greg! I'm one of your graduate students from your 107 Certification class. I passed on my first try at 87%. Thank you for the awesome guidance! I have just ordered a Mavic 3 Classic and I'm upgrading from my Mini 2 to the Mini 3 Pro. I'm happy using DJI products but I live in Florida, and listening to your latest newscast I found out about FL banning Chinese-made drones for their local gov't agencies. I see the DOD has done the same so long term I've began to wonder if DJI is a good investment. I looked at the brand options in the FL whitelist and only the Skydio 2+ line is apt for consumers. And they are certainly NOT DJI in many aspects. Now, at first I thought, maybe I should trade my Mavic 3 Classic for the Skydio, but I'm not ready to part with my new DJI drones. So, I've been thinking that perhaps the ban won't reach private citizens doing on-demand work for local businesses just yet. Maybe in the future I'll add the Skydio 2+ to my collection; perhaps when they have a more portable drone (where the legs fold) with a better-quality remote (the current remote feels like a cheap toy). As a Florida resident I've come to this conclusion after hearing your news update and doing some research. I am going to hold on to my DJI drones until they are banned, and hopefully by then Skydio has come up with drones that are closer to the DJI quality. What would you do if you were in my shoes? I'm not ready to give up on flying drones for commercial purposes just yet.

China has already created their own style of NSA for world surveillance and Congress really wants to ban specific imports but cannot do this without interfering with the American free market. Computers have been turned into data mining tools for government and business and who knows if all that flight data from the DJI is kept in a database on Chinese government servers. We already know now what Snowden leaked back in 2012.

I would add a Rule #10 for awareness, which is just because the FAA say it's OK to fly, individual States and Cities are able to restrict where you can OPERATE (Take Off and/or Land).

Even though I'm licensed, I'm hitting more and more geofences and lock-out by DJI and the FAA. It's getting to the point where its not worth jumping through all the hoops. Especially if you get locked out on a paid gig.

Try another drone maker. DJI does that probably for PR reasons with the government, since they don't like Chinese drones. Although lots of drones are made in China, they don't all have geofencing.

Very informative video. Well done. I was checking when I need to renew my recreational certificate. I saw they now require my inventory. I fly fpv and built and rebuilt my fleet. It asks for the manufacturer and model. There's a ton of components in a build most from different manufacturers. Do I use the frame model and manufacturer? If I destroyed one can it be removed? Thanks. 🤓

Flying for pure pleasure and enjoyment, drone is under 249 grams, no money involved at all, as long as you're following basic guidlines '5 miles from any airport, under regulated altitude, away from people, buildings ect. don't need a license, permit or registration required by law, joining the AMA is a good idea but the rest is optional.

This has been the single most helpful video for how to get started. I know I want to invest in a drone, and didn't want the "variables' to discourage me. I know I want to be in compliance and I also want to pilot my drone at longer distances, so I am committed to getting my Part 109 licence and applying for the waiver to take my drone out further. I think I will be taking the "guaranteed" training program you provide so I can learn everything I need for my Part 109 test. I don't think I will be creating a drone "business" but I do want to post videos on KZbin for hobby/business so I want to have more privileges beyond flying for enjoyment. After all, why invest in a long range drone if I can't take it out of my yard?

First, Great Explanation. One thing that I didn't hear you mention is that National Parks are No Fly Zones; these are listed on AirMap, but every National Park employee knows that it is illegal to fly drones over any National Park and they WILL call the authorities. Next, the Visual Line of Sight thing is a bit challenging for FPV even with a spotter. So, while FPV is considered acceptable, in reality, the LOS stipulation is an excessive limitation. Consider just flying a small 2.5 inch quad FPV. From the pilot's perspective, it is near impossible to determine if you have exceeded VLOS. From a spotter perspective, it is near impossible to track or even tell if you can see it or not. The truth is that the Line Of Sight stipulation just kills FPV from the Recreational Exemption. So sad. On a different note, every child that wants to fly a tiny whoop quad is going to have to get a TRUST certificate. This is just absurd. Any way you want to look at it, the FAA is going to effectively kill FPV as a recreational hobby (or at the very least make a lot of people outlaws). Furthermore...DroneZone...yeah right. Where are they? How many people have one close? Again, absurd. This whole exemption is an effort to appear to be appeasing while in fact, just restricting the recreational FPV pilot.

Yeah, no matter how a person wants to look at it, the faa is screwing the industry as well as the citizens. They would be tickled if they ended the hobby. The fact is, gov decided to start regulating when civilians flew one over a police baracade. They had a zone where they took citizens they were detaining during a protest. Cops let no civilians including press in that area. A journalist mounted a gopro on his friends quadcopter & flew it over to record police wrongdoings. The 2nd event was when a couple young men flew a drone over a large corporate hog farm. They filmed the farms illegally dumping waste into a waterway. It had absolutely nothing to do with safety. No personal drone had ever damaged a manned flight. If gov were concerned about our safety & well being , they woulda went after the hog farm with everything they had. They were more concerned with busting the drone operators vs the corporate hog farm that was contaminating the waterway. Gov used that propoganda & made up a narrative that peeps were flying drones to peep on women's privacy. It was all propoganda. They can't have citizens filming their dirty deeds. They reserve that right to do unto us. I'm all for drone safety & common sense rules. What the fda is doing is about control & power. Y'all can think what you want, idc if u disagree. Everyone has the right to be wrong.

So happy I found this channel. I am travelling to US this summer, and it looks so easy to fly there. Here in Spain, for starters, if you take pictures in urban environment it is already a "professional" flight, no matter the intend, and you must notify to the equivalent to Homeland Security before 10 labour days. And sooo many restricted areas in our B4UFLY... Sure my mini will come along!

Thanks for the info. It's unfortunate that the FAA has the remote location is included in the Remote ID, it's going to scare a lot of people from the hobby or be limited by a drone that weighs less than 250 grams. I got into this hobby for aerial photography/videography, and I won't register a drone because I don't want my location broadcast to everyone. I was fine with registration until I found out that instead of my info being broadcast to the FAA or authorities in case something goes wrong but I hate the fact that they broadcast your info & location to the public. This will put a major hurt on the hobby. Do I still have to register my drone if it's under 250 grams? I may be wrong

I’m also a recreational flyer with a drone under 250 grams. (Mini 2) I’ve been researching this and NO, if your drone weighs 250 or less you do not have to register with the FAA. However, I noticed my DJI drone has “remote identification” listed in one of the set-up menus. What this does is unclear but I don’t think it has broadcast capability.

Lastly, why didn't you define explicitly what a DRONE is? Most think it's does not include fixed wing and helicopters. That needs to be made clear.

If you want to fly every day, get a micro with shrouded props and fly it indoors. You'll get all the practice you need for when you take your expen$ive DJI investment outside, and the FAA won't be breathing down your neck on every sortie.
