Darcy! How can a Common Law spouse get CPP Survivor Benefits after 1 year when The Canada Pension Act does not recognize a Survivor Spouse if that Common Law Relationship is not at least 3 years

I have been receiving a survivor benefit for 10 years and in 2024 I will be 65 and will start receiving OAS. I began my own CPP when I was 61. Once I start receiving OAS does the survivor benefit change? I have heard it becomes lower. This to me seems unfair.

OAS is not the trigger to impact the CPP benefit amount, it is you reaching age of 65. When you reach 65, the survivor portion of your current combined benefit will be recalculated. I have been attempting to get accurate information for about a year, have received 4 estimates from Service Canada - all with different amounts & with significant variance in the amount calculated.

What about when your spouse is not a canadian citizen..how can she claim the benefits?

She won't get any CPP if she didn't pay into the program while working in Canada. CPP is paid by the employer and employee not the government.

Is anything clews back at age 65. I have a spousal pension and am approaching 60. I am thinking of taking it at 60 but am told I may be clawed back at 65. Is this true?

It will be clawed back once you start collecting your own CPP. That doesn't mean 65 if you choose to collect your CPP at 70.

Unlikely because you have to work in Canada and pay into CPP in order to collect the Pension.

If a combined survivor’s pension + one's own CPP benefit amount at 60 would equal more than the maximum CPP benefit amount at 65, isn't it logical to not wait until 65 to start claiming CPP? I did hear elsewhere that starting CPP at 60 when receiving a survivor’s pension, we would actually receive a lower combined amount 5 years later at 65 than the combined amount from 60-65. Is this correct?

Not necessarily because when you apply for your own CPP, it will be reduced if your already collecting a Survivor Benefit. You can not collect both full pensions.
