I have a case for Bullying and harrasment. I've documented every thing since 2018 and recently launched an HR investigation with 7 witnesses. The hr investigation concluded that 13 of the 16 claims were substantiated. Yet the persons involved were not punished and went as far as keeping them in their lead positions. My question is, was it the right choice for my lawyer to pursue this as Workmans comp case? And what would be a reasonable amount to settle for? I was diagnosed with a heart condition due to stress as well as developing sleep apnea.

This sounds like a Workers compensation claim and possibly a civil claim. I would recommend speaking to a civil attorney as well. Good luck.

I work as a medical historian for various physicians, they all conduct this type of evaluations. would you also mention this on a video? the history will always be reviewed with the patient and I do ask all those questions that you mention. this video and another one I just viewed only confirm that what I am doing is correct. :D A big problem though, is getting patients to cooperate with the historian. their attorney has told them not to speak about their case to anyone. we generally call patients to get this done over the phone. is this something legal offices can advise their clients on?

Hello Nathan, My surgery will soon be scheduled, however my QME, isn't until 5 months. Should I wait for the QME before the surgery? I'm in CA. LA area.

If surgery is pending, authorized and on calendar, it could be appropriate to postpone the QME appointment until some time after your recovery. Feel free to give us a call at 213-377-5513.

Thank you, Nathan! ✨❤️️✨You are SO wonderful, so thorough, so thoughtful and so very helpful! I wish you were in San Francisco. I was recently injured (head and lower back) on the job, and, to add insult to injury (literally) my employer is behaving like a cruel, narcissistic terrorist. Today I leaned that my hours have been cut from 32 hours a week to 3 hours a week (for next week). That's evil! My round-trip commute is three hours. I've never heard of anyone ever doing that. What kind of sense does it make? None...unless you're an employer who's retaliating. And she's retaliating like a gangster that really needs to win by any means necessary - no level is too low for her to stoop. How profoundly immoral and soulless to behave in such a way towards people who are in physical pain, but still needing go to work in order to pay their bills. I know she's afraid to fire me because, otherwise, she would have done so already. She clearly is trying her best to make me quit so she doesn't have to fire me. I don not want to play her game. It's very stressful and wicked to the core. She needs her business license snatched away from her for disrespecting a human's life, well-being and legal rights. Thanks for caring about people, Nathan! You're a beautiful humanitarian!

Do you see a QME doctor before your treatment has ended? Or before your treating doctor has called you permanent and stationary? My attorney has set my QME appointment but my doctor has not called me permanent and stationary. Also, I have high blood pressure and I have never been treated for high blood pressure before bit when I mentioned it to my attorney they said it not a body part.

If you are in California, high blood pressure is considered a body system under Worker’s Compensation law. If you were diagnosed with hypertension for the first time after your work injury, there should be a baseline of recordings prior to your injury to allow a doctor to see that your blood pressure became elevated following your injury, which is known to happen as a result of Pain and stress.
