Bailable & non cognizable Offence
Difference between bailable and non Bailable offences in telugu
Bailable offence.
1.) section 2(a) cr.p.c, an offence which is shown as bailable as per the First Schedule of the code of criminal procedure, 1973 or any other law for time being in force.
2.) where accused person can claim Bail as a matter of Right .
3.)These are called as complaint cases or private cases. ( Few will be warrant cases).
4.)F.I.R, investigation, search can be done by the police only upon the direction or orders from the Magistrate.
5.) Summons trial or summary trial
6.) Bailable warrant will be issued in warrant cases and summons in summons case.
7.)No Framing of written charges as charges will be explained orally to the accused.
8.) Compoundable offences.
Non-bailable and Cognizable Offence in telugu
Non-Bailable Offence
1.) section 2(a) cr.p.c: Non-Bailable offence is other than Bailable offence.
2.) where accused person cannot claim Bail as a matter of Right, it is the Discretionary power of the court whether to grant bail or not.
3.)These are called as warrant cases or police cases.
4.)F.I.R, investigation, search can be done by the police on their own.
5.) Sessions trial or warrant trial upon police report or warrant trial on private compliant.
6.) Non-Bailable warrant(N.B.W) will be issued in warrant cases.
7.)Written & elaborate charges will be framed.
8.) Non-compoundable offences.
