Here's another example:: if you are applying for a loan and list your assets as A. House in MA valued at $300,000 & B. 2019 BMW 3 series worth $29,000. 6 months later your being suited, you can't than say your assets are A. $200,000 and B. $15,000 even thought nothing materially occurred that would cause such a loss in value. IS THIS A GOOD EXAMPLE??

Yes. That is a great summary. Estoppel means you are stopped from contradicting yourself.

I read about UCC jurisdiction, if you ever sign something and invoke UCC next to your signature it should always be the same. ie John Doe UCC 1-308 creditor. John Doe UCC 1-308 grantor. Different

When the commercial space I lease was sold from one owner to another, I was asked to sign an estoppel. My understanding is that it was me atesting that I am indeed a tenant with an actual lease that I acknowledge.

So one example would be if an employee is charged w/ embezzlement and gets a plea bargain-- they plead guilty in return for a suspended sentence and probation. Later on, when they are suited civally by former employer they can not go back and claim they are innocent.

Hi Adam. Your example is so specific that it appears to be a real situation. If it is, I would recommend you consult with an attorney in your area. It seems like you get the general idea, but in real situations there are many details and exceptions to take into consideration.

@@Hall so thats when you should hope and pray the court will allow you to plead nolo contendere. It's just a made up scenario I came up w/ in a few min to explain it via a realistic example. I have experience in the courtroom & taken law classes online before but never graduated, so I am knowledgeable in the field. Maybe someday I'll move to VA or VT & be able to intern w/ someone n maybe take the bar exam without law school.

When you acquiesce, you give in or compromise to the position of another party. The emphasis with estopple is on your prior position and the fact that you are held to that prior position.
