It is difficult to answer that question because, Mental capacity in such a situation depends upon two factors (as per your question) - the task in hand - person’s terminal condition, medications, chemotherapy, infection and other comorbid conditions So it is difficult to answer

Could you please tell me whether this guidance are applicable for assessment under section 102 of mental health care act..?

Mental capacity assessment is done as per Sec 4 of Mental Healthcare Act, 2017. Mental capacity is to assess the capacity to consent for treatment and admission It is not just specific to Sec 102

Thank you for such an elaborate talk, Sir. Request if you could enlighten regarding few doubts as follows 1. If the Psychiatrist concludes pt lack capacity and need admission, however no AD or NR or NOK available, under what section the pt may be admitted? 2. If the pt as per the available CMHA guidelines has capacity to decide however lvulnerablescenario what would be the appropriate step ? thank you Regards Dr Vaibhav

1. Admit under sec 89 and If no NR is there follow sec 14(4). if no such person is available to be appointed as a nominated representative, the MHRBoard shall appoint the Director, Department of Social Welfare, or his designated representative, as the nominated representative of the person with mental illness. 2. If patient has mental capacity he/she will decide. If you have doubt about vulnerability approach MHRB for next step.
