I am working outside South Africa, the paper work I had to fill in I nearly said I don’t want anymore. Getting my fingerprints checked, blood tests investigated even poop. It took almost 6 months for me to get that VISA. Our country has a weak law.

Yho tell me about it. I was so shocked after all those tests and checks when I got to immigration I had to undergo an X-ray scan for TB coz the one I had was two weeks old already and they needed a recent one.

ZEP holders have been in South Africa for over 13 years and the goal post keeps being moved. Getting a work permit in South Africa as a Zimbabwean is probably worse than what you got through and whats worse is home affairs makes it seamless to enter SA as a European versus an African.

@@Tlc_lele And the money 💰 that has to be spent getting that documentation in order yho!🙆. And you still have to pay for the Visa and have at least R10K + left over, so that you can settle comfortably in that country because you literally have no one to rely on.

I saw the news that the BOSA president was there wanting to talk on behalf on abo myfriend. The community kicked BOSA out, which is good. I'm so proud of you guys. I wish all South Africans could do that, too. And stop making excuses for things that just need the unity of community. These foreigners disrespect South Africans too much.

Injustice is injustice. Doesn’t matter if I’m complaining from a two bedroom apartment with 3 cars parked outside “(Privilege)”. And we are not saying restaurants must hire only South Africans. The waiters, chef etc aren’t even half of the problem. It’s restaurant owners who misuse powers to abuse even other foreigners just because they “ won’t have anywhere to run to”. That’s inhumane. Regardless of being a citizen or not. Every employer is entitled to labour laws and regulations. If anything happens; incase of any emergency. The law needs to be held accountable and protect the life of that person. I hope the government finds the culprit and owners; and they need to pay. Including the South Africans taking bribes or fraudulently withholding foreign nationals privileges for bribes. If any foreigner feels any injustice. SPEAK UP‼️ Mihlali was fighting for everybody. Regardless of where you come from etc.. if it means everything closing down so that things could be done correctly. I support THAT. We did so after Apartheid; we can still fix our country even after 30 years of occupation. As South Africans; this is our country. We have no where to go. If it means closing and starting everything up from scratch. Sooo be IT. Those who do wrong must be EXPOSED.

I have an aunt u who stays in the UK and pha they don’t play. They always check your documents to make sure that u are there legally. Personally I would never support any foreign person here illegally coz thina when we do follow laws of other countries. Also in recent years, there are many South Africans that when to other countries to look for better jobs and stuff and u would never hear about them that they went there without proper documentation. Owammie people needs those Jobs but they stop when this exploitment started and these establishment opt for illegal immigrants to slave them. I was the one who works in restaurant in 1998 /99 we had basic salary we have our tips everyday . I remember i had a little basket full of coins that i used for transport and buying bread and milk literally everything cause even my rent was R150 /200 sharing. My salary was to send to my mom.

Living in the burbs,or beautiful house/apartment, well furnished with extras doesn't mean one is not struggling, Owami. Please, Sisi, let our people work in those jobs and other African government fend for their people. Those companies must go to those countries and open businesses there.South Africans are going through a lot in their country.

Being legal & being documented are 2 different things. Thabo Bester is legal in South Africa but he's undocumented (he has no I.D while he's South African). Having a foreign passport means u r documented, bcz it's a document, but it doesn't mean u r legal bcz ur visa can be expired. Having a document doesn't mean being legal.

I’m currently working abroad and the amount of paperwork I had to do ? Chile it took me months and if you’re not patient you might even just quit cause it’s a lot and they won’t accept anything that’s incomplete.

I am so happy that the department of labour takes this matter seriously, this restaurant they hire foreigners because they don't want to pay staff. So, as South Africans sihambise ama-cv restaurant and dololo umsebenzi ngoaba bengafuni ukukhokha. South Africans, if you apply for a job to another country, you need proper paperwork.

University students need those jobs, they really help as pocket money. Restaurants are not going to be affected they made lots of profit already. Imagine Babel was a new business but it already made R1.3 million unfairly what about Ocean Basket who have been doing it for years. Working in a restaurant is not a critical skill so in a properly functional country they shouldn't even be here and to get a work permit you apply for it from your country which lawfully you are only supposed to get if you've been offered a position that is on the critical skills list. What is annoying is we have all these laws but none implements them and other countries apply them to the last dot.

When you go to another country, on entry before your passport is stamped you will be asked why you’re visiting and you get given a number of days to stay in that country. If you’re coming to work, then you should have a permit allowing you to work in that country. I can understand you not knowing but it doesn’t mean those people are justified to work without obeying our laws. The only reason people would not take “those” jobs is when they’re privileged and have plan B. The rest of SAns who aren’t privileged will definitely take any job. So, yes. We have enough SAns that can fill those positions. The unemployment rate already tells us that. Also, the non-south Africans are only getting hired so that companies can get away with not paying minimum wages.

Owamie, if it's not a scarce skill, you cannot do the work unless you have a general work permit or special permit like ZEP. Those jobs used to be done by those without skills and students who needed the money and gained work experience. This whole thing has made me call bs on South Africans being lazy. We just don't want to be exploited and ill-treated. In high school I worked in a small shop on weekends and holidays and I used to earn double, per hour, than full-time workers at a major supermarket. That seemed so unfair, to me and made me realise why retail workers tend to be unhappy.

I agree with you 💯. But that exploitation affects our economy. Without papers, how are they paying tax?. They also get serviced here in South Africa. Their kids as well. They use government utilities. Eg, free education, hospitals, etc.

Having a passport doesn’t mean you are legal in a country. You need to have proper documentation that allows you to be in that country. Whether it’s tourism or work. If it’s tourism and you have a visa or you are visa exempt due to the passport you are holding then you are fine. I’m in China, should I get caught with my Residence permit not in tact then I’m in trouble. South Africa needs this clean up. We are tired of

I am correctly in a foreign African Country and here work permit is a big thing, you even get arrested so let the law take it's Couse as like other African countries. we just need to have proper docs and our SA people are will to work at those restaurants

A passport don’t mean you can just travel anywhere and work. There are a lot of South Africans who need those jobs , I think you are speaking from a place of privilege to think that SA don’t need to work in the restaurant industry. To travel outside you need a visit visa first not just a passport unless you are traveling to countries where SA are allowed visa free but to work you still need a work permit in those countries

The fact that our country hasn’t been attentive to public service - we have issues of unfair work/labour practices and/or “oh-my friend”, the bar is low. When South Africans are forced out of low barrier sectors because of corruption allowing cheap labour from foreign nationals, fellow South Africans are called “picky, ungrateful, lazy” - the question is how? When our government doesn’t defend small South Africans and their businesses, who is supposed too?

People should understand that passport is a travelling document it ends there, anything else needs a visa or a permit to do it. It seems like most people specially our african people doesn't get it, even that visa free it is not free for life it country days and days you get in a year and they don't allow you to work unless it started so like the one we used to get for two years in UK.

You need a work permit, even with a ZEP,under SED ,ppl are obligated to ensure that the entire job market locally has been exhausted before one can employ a foreign national unless they provide skill that SA is drained with.

No I don’t agree with u. There are many people that will take those jobs any day. Yes maybe not to stay in those jobs forever but too many people will take those jobs. Also recent graduates or young adults in gap years, would really appreciate those jobs as start ups while they’re trying to push this life thing. Even adults nje would take that job, its way better that sitting in the townships depressed that you’re doing anything in life.

@buhleshezi5222 let's be honest : hiring a South African by law, the employer must pay R27 or more per hour otherwise the South african employee can sue the employer and win millions after a nice lawsuit, while for the exact same job, an illegal foreigner will accept being paid R10 per hour. Hiring a South African means, the employer must pay for his vacation time when he goes to Mpumalanga spend christmas with his family, while an illegal foreigner has no vacation time, nowhere to go bcz he's undocumented. When a South African employee is injured at work, the boss must pay for the medical expenses, while the illegal foreigner who get injured at work will be told to go home and come back when he feels better. A restaurant is a business and all businessmen on earth want a ROI (return on investment). Now Buhle be honest : if u were a restaurant owner, would u prefer to hire a South African or a foreigner ?? Please be honest, don't lie.

This is the reason why we have labour forums "unions" in SA, if we could remember our beloved uncles who used to be truck drivers once raised an issue about foreigners settling for minimum wages which puts south africans at the disadvantaged side of getting employment from these private owned companies...unfortunately it's catching up with innocent people like mihlali if they listen then this thing could have been fixed long ago.

I worked as a waitress before and this is how things were done. We thought it was normal. We lived on tips, no contracts, we had to buy tools, and uniform. Our managers would fine us random amounts for being late, missing tools, paying off breakage and walkoffs. It's a lot.

Also guys, those who are already in the country and are trying to get their papers (renewing documents or getting new ones) are really struggling. Every week they go to home affairs and they're told to come back next week, your name is on the list. Every single week. And mind you they can't just show up any day. Each nationality has its own days e.g Ugandans are attended to on Tuesdays, Congolese on Fridays, etc.

When you go to a foreign country Ninja you have to have have a permit to work, be on a working visa, be a permanent resident or a citizen of that country to be able to work. If you are on a visitor visa you can't work thats illigal. If you work while on a visitor visa you have broken the law and could be fined, arrested or deported. Other countries are very strick they send you back at the airport already book you on the next flight to your country. But ke South Ahh GNU. Imagine if having a passport meant you could work ngabe kade sabase New York 😂😂😂. And you can't have a passport of a foreign country if you are not a citizen of that country. You must obtain citizeship first 😊

I remember my friends and I went to a small pizza place in Braam a few years ago. Because we were students and a little broke, we only paid for our meals and no tip. The waitress begged us for a tip and explained that's the only money they make, they didn't have a salary. We felt so bad and had to put together the little we had to tip, and make it cash cos that's what she asked for saying if it's card payment she won't get her tip from her boss.

If the intent was to come to SA and work, get a permit. this is definitely worth looking into Owami. Having those papers is very important. I am not saying they should not be allowed to work but they must do it legally. This is similar to those who come to SA to open businesses illegally. It is wrong. Get the permit to operate. Yes our country is messed up (corrupt) but report those officials who ask you for money if the rule to get papers does not involve money. Report them, period!

I'm South African and I'm married to a foreigner. I know for a fact that you are not allowed to work or study without a work permit. You can't get a work permit unless you are doing a critical skill. The government implemented these rules to prioritize South Africans. However, many companies are not following the proper procedures and protocols, which is why we have issues with "foreigners taking our jobs." I don't like this situation. It's South Africans who are not following the rules and causing issues for the country. If we follow the rules, then foreigners won't have a choice but to follow them as well. And remember these companies hire a lot of foreigners not be they are trying to help them but because its easy to exploit them mentally, physically and financially. There are different types of permits. Zimbabweans have special permits which were given to them by the SA gvt. We also have the scarce skills permit and general work permit as well as study permit etc. Study permit only allows you to work for a specific number of hours, I think 20 hours a week if I remember correctly. My point is not every general worker is an illegal immigrant.

@@antonattachihombori9561 There is also a General Workers work permit as well sir, I have observed all work visas in South Africa. one of the challenges we often face is that, with a ZEP,one of the challenges experienced often is having to explain the need to hire a foreign expat in a position that can be attainable locally.

@@Vee347 yes i mentioned it above. I agree with you. The department of labour has to write a letter and confirm that the position was advertised and no South African was qualified to do the job. That letter is then taken to vfs together with all supporting docs for visa processing.

Passport is for travel and is used on a point of entry and exit in a country it has to be stamped if you are visiting you can't visit for a year and you should also support it by showing your accommodation bookings or your host if you are visiting a family member and that family member should be earning an income. A lot of these people are illegal. To get a work permit you should have a critical skill to provide in a SA not spaza and waitressing jobs the raids will happen and they will be arrested

A South African university student will be required by law to be paid R27 or more per hour, while for the exact same job, an illegal foreigner will accept to get paid R10 per hour. A South African university student must be paid by the restaurant, the time he return to Mpumalanga to spend christmas with his family while an illegal foreign has no vacation bcz he goes nowhere, with no document. Are you 100 % sure that they don't do crime? It's unfair of you to blame mihlali, even if they are foreigners it's unfair of them to be exploited, the government was well aware of what's happening in those restaurants.

Not only do they need permits, there are certain jobs that are reserved for citizens as the labour supply is abundant in the country. |There is a scarce skill list ( which needs to be updated but that's a story for another day) that companies must use to get guidance on what jobs the can look outside of the country for skilled personnel. So many laws have been broken for so long that so many people think it's normal. We need to keep applying pressure because all these raids will stop if we dont keep talking

Being a South African working abroad, my paperwork is insane. I don't even leave the country up until they do thorough investigation on me. I feel like our government is lazy. I mean, do you blame them for coming here illegally. It's doable moss. And they find greener pastures here in South Africa.

Restaurant owners look for ROI (return on investment). Hiring a SAn comes with higher salary (minimum wave R27 per hour or up) while a foreigner will do the exact same job for even R10 per hour. When a South African worker get injured at work, the employer must cover the medical expenses, but when an illegal foreign worker get injured at work, the boss tells him to go home and come back when he feels better. Hiring a SAn means he has paid vacation, when on chistmas he go back to Mpumalanga see his family he still get paid, while foreigners don't even go on vacation, bcz they have no legal documentation. A South African employee has the right to take his employer to court, for unpaid wage or discrimination, etc... but an illegal worker can't do it. Now put yourself in a restaurant owner's shoes : would u employ an illegal foreigner or a South African if u want a huge return on investment ???
