Can your attorney claim they are not sure how much my settlements will be but went ahead without me knowing and sign a medical lein?

Thanks for the question Kathleen. We believe that clients should always make the final call when it comes to whether to settle a case. However, there are some situations where an attorney may not be able to give you an exact figure for your net recovery (gross settlement minus legal expenses and medical bills) if he or she is trying to negotiate with lien holders for lower payoffs. If it is early on in the case, the attorney may not be able to give you a reasonable estimate of settlement until he or she knows your final medical diagnosis and/or prognosis. Either way, if you have concerns about your settlement or your attorney taking actions that you disapprove of, it is usually a good idea to schedule a face to face meeting with your attorney and express your concerns.

Should I be worried if the lawyer is trying to push me to seeing one of HIS chiropractors business buddies? I feel like he's trying to run up some extra money

Great question! Sometimes lawyers know the most reputable chiros around and they can help you find the best one for your needs. Unfortunately, some lawyers refer clients to a certain chiro or doctor b/c they know the chiro/doctor will send reciprocal business. If you aren't sure what is happening in your situation, it may be a good idea to ask your lawyer how many clients he or she has sent to this chiropractor in the past. Just have an open and honest conversation with your lawyer and express your concerns. Maybe even meet with the chiropractor and ask for a breakdown of what he/she charges and decide for yourself whether you believe that chiropractor is a good fit for you. After that, trust your intuition. One caution flag to look for is whether the chiropractor is located close to you. If the lawyer is asking you to travel a long distance to see a particular chiropractor, you have every right to be suspicious. Honesty and trust are the most important parts of any lawyer/client and chiro/patient relationship. Good luck!

Thanks for the question! It most likely depends on how much insurance the at fault person has and whether they have sufficient assets to pay more then their insurance limits. Limited insurance and assets from the at-fault party may create a situation where a smaller settlement is the only viable option. However, if there is plenty of insurance coverage and fault/pre-existing injuries/causation is not an issue, you would likely be leaving money on the table if you settle for the amount of your medical bills. Items like pain and suffering, lost wages, etc are recoverable in most states. Make sure you take the laws of your state into account because some states have restrictions on the type of damages you can recover. If you aren’t sure, it probably best to consult with a good personal injury lawyer in your state. Good luck!
