The legal ramifications should be that your seed contaminated my crops. We need some folks to do class action lawsuits and get some case law to support that they should be liable for contaminating our fields.

I couldn't agree more!!!! I can't believe the original law suit didn't go this way but we should sue them for it now and try to turn this around! We need to fight all of this. It shouldn't be legal at all. There comes a time when we have to choose long term health and stability over short term gain and bending over backwards for big corporations

This is certainly an idea worth considering.. although the legal precedent has already been established against the farmer.. this might be the type of action needed to get this conversation going in that direction..

Monsanto sued a canola farmer for copyright infringement of his canola crop. They won. Later crops were tested where the farmer sued Monsanto several times. He won every time as he was an organic farmer

Caroline, when Bevin said that we already have foods that contain anthocyanins it made me think about Eve in the garden…they had everything they needed and God said it was good. Like you say, Pandora’s box.

Thank you for the information, I was blown away. I don’t understand how these companies have a lawsuit against farmers though. They don’t own nature or or the wind that carries the pollen. Therefore couldn’t the farmer sue the company for polluting their crops?

Exactly. If you let your horse on my land and don't make an attempt to retrieve it, in many states I can claim it as my horse. If you make no attempt to control your pollen, how are they your genes that you own anymore?

Look at the FDA & what they approve. Look at the cases Monsanto has already won. They destroyed organic farmers crops, & then the farmer loses in court & the court rules time & time again that the farmers have stolen their intellectual property. It's horrible. We need to get back to 100% natural crops, that's the only reconciliation to this GMO tyranny. All farming the way it was 200 years ago. Ugly food sold go to animals as feed. That's how it's always been, until the past 60 years.

I'm not one to readily accept conspiracy theory but: These companies want to have control of all the industry they represent. They watch the expansion of grow your own food interest and what we are saying. The GMO tomato is a safe way for them to muddy the waters of "you can't buy GMO seeds" we are talking about. Once they have their foot in the door, they can add other GMO crops, thus preventing seeds saving and sharing.

Also, my understanding is that GMO seeds have protection for the designer. They are uniquely patented. You are not able to seed save them and very illegal to sell any of the seeds. Farmers have gotten in trouble for some of these issues. I think this is their first step in "owning" the seeds.

​@@kathymcmc in this case of the tomato company has it right on the page advertising it for sell to save your seeds. the problem comes if you sell seeds, the gmo one can cross breed with your normal tomatos on accident and if that genetic marker is in those seeds you could get in trouble because the genetic makeup of the seed is patented.

I heard about the first GMO tomato. They took genes from a fish because the fish had natural antifreeze in it and put it into the tomatoes so they would be frost resistance. Problem is the genes from the fish caused people to retain fluid. As someone who has lymphedema without a known cause I wonder if I was exposed to these tomatoes when I was much younger.

The GMO purple tomato is an unnatural insertion of a snapdragon gene into a tomato to create the purple color and long lasting tomato. This cannot happen in nature and we do NOT know the long term consequences of doing this sort of insertion of two different species.

@@noahmeme2 I am not sure what you refer to that are both edible. The point was and has always been that many people, including myself , do not approve of GMO foods that insert genes from other species(in this case, non-tomatoes) into tomatoes and not nearly enough long term studies have been done to confirm that there are no ill effects on humans. In this particular case, a Company has claimed with little proof that the purple tomato coming from Europe MAY be their GMO product. I cannot speak to that except to always be skeptical of a company's point of view that stands to make a profit. Until and unless there are confirming studies to say this gene edited purple tomato has no negative impact on future human health, I am really not interested an any unique features that it may have. Baker Creek is right to be extremely careful with this issue.

The produce guy in Whole Foods in West Bloomfield Michigan told me just because it’s ORGANIC doesn’t mean it’s not GMO. It just means no chemicals were used to produce what you’re buying

I think he was wrong. Organic is supposed to mean non-gmo, as well as limiting what can be sprayed on the plants. As discussed in the video, an organic item could accidentally be genetically modified.

I watched a video last night by him and he said just the opposite; if it's certified organic it can't be GMO. I think what he was referring to that you're thinking about is that some companies claim their products are organic but they are actually not because they're GMO. He said also that you can use organic gardening practices with GMO seeds/plants, but they can't legally be called organic produce.

There is also a garden huckleberry, which is a natural purple small "tomato" it happens naturally so they didn't have to create this.

Thank you- I specifically picked a couple purple tomatoes at the U-Pick organic farm last week, thinking I could save the seeds. Now I think I'll just stick with my Roma seeds from last year.. 🙏🏻

Roma tomatoes are awesome. My husband's favorite tomato. I usually throw in one slicer and one cherry tomato. But he loves Romas and he does the cooking. So I try to plant to keep him happy.

We quit buying from Lehman's, after they sold the business to Big Corp, a couple of years ago, and immediately banned open (and concealed) carry, in their store.

@@kathymcmc it happened to a couple, on one of the channels that I had subscribed to. That's how I found out about it. The original owner of Lehman's, passed away. Those whom he left the business to, sold out to big corp. So sad.

I remember thinking, when Baker Creek had to pull the Purple Galaxy tomato, "Oh no, I can almost guarantee they were growing some plants on the Baker Creek site". We almost grew seed for Baker Creek quite a few years ago but realized the monetary "return" was not going to be worth it. They would have had to grow out our seed to check the germination rate, and also to maturity to check that our tomatoes were true to type. After they determined our seed was okay, then we would get paid. Unless something has changed in the way they do things, that would mean a few Purple Galaxy tomato plants were probably growing at their test site in the U.S. at some point. Take a moment to ponder the ramifications of that.

I see this as a way for GMO seed companies to shut down other organic and non-GMO seeds companies. I will not purchase from seed companies who sell GMO seeds even if they sell organic or non-gmo seeds. I was planning on seed saving but now even more!!

Not only plants. Think about the poke in the arm. Will they claim ownership on gmo people, too? We have to try our best and be awake. Thank you for such information and for to get these issues to more people to be aware of such possible problems.

It never should have been allowed for patent. SOLUTION: I think it will take heirloom seed companies suing Monsanto for infecting their heirloom plants with an airborne GMO pollen

The food argument is because people don't consume enough vegetables and they don't get enough antioxidants. Anything to get more of it into people is a good thing.

I need to know about pressing my own oil! I can't be at the conference but I want a video on it!!! As I said in my video on GMOs: DNA is catalyst molecules to produce the proteins the body needs. if we insert a foreign gene into a plant, it will produce the same protein as it did in the original species. But: Does it interact with other proteins in a negative way? Does the new combination of genes produce proteins we don't know about or what their effects will be?

This is prior to watching, and I can't speak for any specific GMO, but from an unbiased perspective most GMO stuff is harmless and will all break down the same way in a stomach. However, some GMO stuff could produce compounds which could have effects on a person - this is more likely with things that are modified to act differently rather than aesthetic changes like "being purple". That said, always look into it if you're concerned.

Reminds me of a cartoon I watched, (American) " little Johny Appleseed". I really think municipalities and people, could plant fruit trees on the side of the road. We had olive trees and every year, Italians used to come and get them, back then we wondered why lol

I saw somewhere someone commented about Backercreek calling out 'big ag' saying they are a big company so they are 'big ag' I don't think people understand the scope of the biggest agriculture companies, Bakercreek isn't even in the upper echelon of agriculture , but because humans are bad at wrapping their heads around big things most people can't wrap their heads around medium country sized corporations.. We need better antitrust laws, and we need them enforced.

The idea that a GMO company can sue people for accidentally ending up with their product in their crop is like a oil refinery that dumps its by product in a stream and the when farmers down river water their cows with it, the oil refinery claims the cows now belong to the oil refinery because they contain their product that escaped their control. How about we sue them for tainting the water, air or the genetics?

There are already plenty of heirloom purple tomatoes, like Urainian Purple and Cherokee Purple . Why do we need gmo?

We will soon have to grow our plants that we want to gather seeds from inside a greenhouse and keep our bees inside that greenhouse!!!

You don’t need to physically contain plants to keep seed from cross contamination, breeders couldn’t possibly work like that. Instead you put individual flowers inside net bags, pollinate them as you wish, the bag keeps other pollen away.

This video makes me think of the many gardeners that got unrequested packs of seeds that weren't labeled well. Makes me wonder if maybe "they" want to contaminate heirloom gardens for their own profit.

If the seed companies can try to sue you for having their genetics in your seeds, can people turn it around and sue the seed companies for damaging or contaminating people’s heirloom seed genetics? Could they be vulnerable to class actions? Just a thought.

OK, look at it this way. The same people who are genetically engineering how biological entities function at a microscopic level so that they can lay claim (via law) to anything that functions with that "proprietary" technology also operate the judiciary system. They are using law to seat themselves as the arbitrators of all life. So, can we use law to protect ourselves from them? Think about it for a minute.

yes there is a precedent for it already based off another comment under this video "an organic canola farmer lost a lawsuit to Monsanto. He started testing his organic crop for contamination. Every time he sued for the loss of his organic crop, he won. Precedence has been set in Canada."

I bought the pink pineapple yesterday. I haven't cut it yet, but the sample I tasted was super yummy. The label says this product is possible due to bioengineering.

There is a large potential for good with this technology but it’s also got a large potential to cause harm. It’s completely dependent on who’s doing it. As a former chemist, the technology could create some amazing healthy things. However, if that was truly their goal they would have opened the patent.

I've been saving my own seeds for the past 3 years. I have not always been successful in growing from my saved seeds. Hoping this year will be better! So sad to hear about the grocery store GMO Zucchini😢. It's my main way to have zucchini, especially since last year was a terrible year for my garden produce😢 Much of our winter store produce comes from Mexico. Are there any great insights into Mexico farming practices?

I thought I read somewhere that Mexico was rejecting US corn since it was so heavily GMO. Based on that, I feel that's maybe a good sign about Mexico produce? Not sure though

Thank you so much for sharing about this. We just don’t currently have enough information to make sound decisions about this and asking us to eat the foods produced as human testers is not right. I had no idea about the zucchini and that it has been put here for years. I wonder if was produced the same way as this tomato. What is in these zucchini’s that we are eating? I’m also wondering how this is effecting the eggs that we eat and other food substances that the chickens are eating and then producing eggs that we then eat? Do we move to greenhouse only growing to avoid cross pollination? We moved into a townhome and downsized from almost three acres. We had not even thought about the fact that our community would be treating the grass on a regular basis which means even a container garden on our deck is exposed to the chemicals because of the wind

They have been splicing since the 1970s.. They kept it out of commercial for a couple decades.

I have a rather uncomfortable question… 45:06 if so much of the seed is going to be tainted and testing is so expensive, is going to small local, well mea in seed sellers a good idea if your priority is to avoid getting GMO tainted seed? Seems they would be more likely to fall prey to tainted seed than for instance Baker Creek who can afford testing.

This is a great question! First, I'd say that "so much of the seed" being tainted as you put it, might be a little extreme.. While it is likely that this trait will spread, that spread will certainly be slow as cross pollination among tomato varieties only happens about 5% of the time. Secondly, I think that small-scale seed producers are more isolated than larger producers.. for example, we only grow 10-12 tomato varieties in a season.. and on this small scale, we can bag blossoms and manage crossing much easier than large producers that grow far more varieties per season..

@@SmallHouseFarm I am going to gently disagree with you, at least partly. 5% is small, yes, on an individual level, but the spread of the GMO tomatoes genes will not be linear, it will be exponential, because each plant that is pollinated will be contributing to the spread via the resulting saved seeds from each plant etc.(which the company is encouraging). It's like the classic example of exponential growth of lily pads covering a pond. Starting with day one and one lily pad, it will take 48 days for the pond to be covered 100% by lily pads if they double everyday. However, and *this is the alarming part, on day 42, the pond will only be 1.5% covered by lily pads.* Now take this same concept of exponential growth to a 5% cross pollination rate and distribute that to at least thousands of home gardeners and growers. Each of those home gardeners and growers is the one lily pad on the pond. How long will it take for that 5% cross pollination rate to cover the entire pond? I take your point that home growers could likely bag their tomato flowers, but can small growers? Will they? And keep in mind also, that geographical isolation would have to be rather substantial to prevent cross pollination given that bumblebees are frequent pollinators of tomatoes and have a flight range of just under 2 miles. Looking at the numbers, it seems to me that only by mass boycott of these seeds will we be able to avoid widespread cross contamination of tomato genetics. On the individual level, people can grow with bagged flowers or in insect proof greenhouses and hand pollinate their tomatoes, but unless there is mass rejection of these seeds, it will spread to everywhere within short time, particularly as I expect many new gardeners will jumping on the chance to grow beautiful "healthy" tomatoes in their new gardens, and the company is actively encouraging seed saving.

Horizontal (Species to different Species) gene transfer does happen in lower organisms, plants and animals. (It is fairly common with bacteria, such as how they get antibiotic resistance from completely different bacteria). It can also happen in plants and animals to a lesser degree via viruses. It's actually fairly common, and it blew my mind when I discovered that it does happen. The odd thing is that when Humans do it, it can have deep effects then we are not aware of. (Such as the excess insecticide that people can dump on it and it still lives). The real danger is that the modified genes from these seeds can "spread" to other seeds. And, they have a "rule" that says you cannot "sell" these seeds... but if they spread to your "farm" -- they will probably take legal action... and that should be "their" problem., but that apparently is "our" problem. (Oh, wow -- yea, that {purple galaxy)... as I am listening... yes. What really needs to happen is that farmers / gardeners should not be liable for genetic transfer of modified genes from GMO plants that occurs naturally...

I only plant Heirloom - Non GMO in my garden, please tell me I am safe following this rule. Do I need to be concerned that seed distributors are labeling GMO as Non GMO? I have no intentions to sell my seeds, I'll only use them for myself.

I am a little surprised no one has mentioned that the BLUE tomatoes , that have a blue black color to some or all of the tomato skin, are NOT GMO. They are a special selection process of a natural hybridization, which is then standardized so it is open pollinated. They are NOT the same as the GMO purple tomato.

I had such a hard time with chickens! They hated the rain and the standing puddles. Ducks worked better for me in the naturally wet area I am in (Western Washington).

This reminds me of a time I had a broody hen raise a batch of ducklings. She was such a a good momma, but her last straw was when it was so rainy and yucky out and the ducklings would not go in. She looked like a drowned rat she was so soaked trying to to stay out with them. She finally was done being their "mom"😅.

It is the same thing as I’m trying to grow with no chemicals for my own family and the farmer sprays his field behind my garden. I can’t keep him from spraying and can’t keep the chemicals from my garden it’s impossible to stop.

Watched Lazy Dog Farm and they are planting them, so they are available at some level. Being a retired medical professional I have several questions #1. Will the body even recognize these genetically spliced genes 🧬 in order to synthesize it into something it can use. #2. If it’s so healthy why not use that technology in a medical supplemental form, such as a vitamin. At least it goes through a series of checks and balances. But at least we have personal choice. I agree with all of your concerns as well.

Just got the baker creek 2024 catalog and purple galaxy is the covergirl.... what's up with that? Even if they somehow have a non gmo strain I feel like it just adds confusion to the issue

My concern as a bee keeper is what is the impact on the soil biome and the roots and mycelium, the pollen and the impact on the bee brood in bee bread. None of that regression testing has been done. Man thinks that he is god.

I have questions regarding Damon corn seed that is an sh variety that territorial says is an heirloom variety that they say they will qualify as an open pollinated seed. Then is it deliberately misleading and entrapment? I am one who saves my seed.

Damaun is a variety that has been stabilized from a hybrid line. It is not an heirloom by any means, but comes true to type from seed.

One last comment. IF the purple tomato Company tested the purple tomato Baker Creek had and their tests were inconclusive, I would say that the original European breeder DID NOT have a GMO seed. If there was even a tiny bit of evidence that they could prove, they would have sued the breeder and everyone in between. More to the point , the patenting company would rather scare them into not offering a pure purple tomato. Easier .

I recall my farming uncles talking about the decision t I plant HYBRIDUZED field corn many many years prior to the entry of genetic manipulation. The companies would notvlet you save seed corn for next years crop. THAT was a forearning! And the air pollinating was part of the problem!

If you only grow open pollinated seeds and you plant in a community garden when someone else may grow this plant… will it cross pollinate and does that affect this year’s crop for my consumption? I don’t save my own seeds so I am not worried about future crops, as I prefer to purchase seeds each year.

Tomatoes don’t readily cross pollinate as it is. They are self pollinators. So if it’s in another garden I’m sure you will be ok.

No. When plants cross pollinate, it makes only the seeds crossed, so the next generation will be gmo. But thinking about it, I guess you'd be eating those seeds in the first year tomatoes right?

Although tomatoes are self pollinating, cross pollination can certainly occur between varieties. Although cross pollination in tomatoes isn't as common, thanks to the structure of the flower, it doe happen - about 5% of the time. Tomato varieties that date back to before 1930 are even more likely to cross, especially in areas with plenty of insects.

this is sometimes caused by too much nitrogen in the soil.. I recommend getting a soil test!

Why can't the person sue the gmo company for contaminating their crops when they didn't want a gmo crop. This is the first time I've heard that crops other than corn could be gmo and so if they are in the stores and markets they are not listed as gmo.

As far as I'm aware, no. Although packaged foods have labels now about genetic engineering, I haven't seen any labeling in the fresh foods.

This needs to be handled legislatively. Either ban GMO pollenateable products or make it so that releasing them voids the patent. Can I patent a chemical, release it into the water supply, and then claim I own all of the water? It's the same thing.

This is all about *control* and it seems like a great way to shut down small farms, thus making the people dependent big companies/govt. food... How easy would it be to aquire land somewhere in the middle of farming communities, plant the GMO crops & let nature take it course? It could decimate a whole community in a matter of a few seasons.

@@lyndaash6766 Also they have forced their employees to take the c19 vaxx. Even firing those who refused and the whistleblower who leaked the info. So yes, I am concerned. First the vaxx from a company who say they dont like gmos. Now a gmo tomato. theyre losing credibility.

@@victoriaschell2225 That's not quite accurate: #1 they did not sell any of these tomato seeds. #2 the tomato seeds went through numerous tests looking for particular genetic markers of modification. Although two tests came back negative and third inconclusive, once the possibility of genetic modification was detected, all of the seeds were destroyed. .. so, they did not put out any seeds and the seeds they had were rigorously tested.

They need to pass laws that don’t protect the patents of GMO seeds. If you harvest your own seed, grow heirlooms or you’re land is contaminated with GMO seed you should not be liable to the patent holder.

You can buy these seeds. I have them growing in my greenhouse. They are expensive, $2 each. The seeds don’t cross pollinate . You can save the seeds from year to year. These will not affect your DNA no more than when you eat chicken gives you the ability to lay eggs.

I'm not sure what you mean about the chickens.. but tomatoes can certainly cross pollinate.. it happens about 5% of the time, or significantly more if you're dealing with varieties developed before 1930. Although the structure of the tomato flower helps to prevent crossing, in older varieties, the pistil is still exposed and crossing is more likely. Also, areas with high insect populations see higher rates of crossing between varieties.

If you grow a tomato and it gets GMO genes into it from pollination, you CAN be sued by the patent holder even by USING the seeds you have saved. This happened regularly by Monsanto with their GMO corn and local farmers who only wanted to use their saved seed corn. It put many farmers out of business.

To be fair, a great many 'foods' we eat have only been in the food supply for 50 years or less. Flip a box, it's a bit disjointing to realize how much on there is pretty new. As for this tomato, I want to see their guarantee that these tomatoes are self terminating, that was back in the day part of the sales pitch, the GMO's where never supposed to be able to outbreed at all.

​@@SmallHouseFarm yup I'm out, at least they are not lying about it like Monsanto did, so cudos for that I guess, but while I am not willing to blanket state 'all GMOs are bad' I do think it's irresponsible to let them freely spread this , relatively, early in the game. That does feel a bit like a set up, or at least I've read enough to side eye it intencly lol

Only a few crops have been genetically modified to resist chemical application. Others have been developed for disease resistance, higher nutrient content, or increased shelf life.
