Hello students!.
I am Brian Perez and today we will see "The RIGHTS". What are rights? and Types of RIGHTS. Civil Rights, Political Rights, Social Rights, Collective Rights.
They are powers or prerogatives recognized by law to individuals and social groups.
They consist of the possibility of doing or not doing something determined. That is, they give us the freedom to carry out endless actions as long as they are not prohibited.
In addition, they protect us against actions that we do not want to perform. For example: In ancient times parents arranged the marriages of their children. For a long time, women could not choose their husbands.
Today this practice is unthinkable given that the States that recognize civil rights to their citizens guarantee that they have the freedom to choose who they are going to marry.
There are several classifications, one of the most common is the one that differentiates between:
Civil Rights, Political Rights, Social Rights, Collective Rights.
1) Civil rights correspond to all people, both those born in the country and those born abroad. They are based on equality before the law and refer to freedom in any of its forms (physical, of expression, of religion: freedom of worship, freedom of association, etc.). They are exercised in the field of coexistence in society, it requires another person to put them into exercise.
They make real sense when there is an interaction between two or more people. Eg The right to private property would not make sense if you were the only person on earth. Because then, no one would invade your property or steal your property.
They are individual rights because they offer protection to individuals in a particular way. That is, case by case.
Some examples are:
The right of expression: People have the right to receive information and express their opinion by any means without any prior censorship. That if ... we have to take responsibility for what we say.
Right of movement:We can freely transit the territory of our State. Unless this right is restricted for reasons of public health, safety, or the property of another person.
Right to property: Our belongings, car, house, an invention, shares of a company, etc. They are inviolable, this means that no one can deprive someone of what is his or affect his property.
Right to teach and learn: We all have the freedom to transmit and receive knowledge.
Rights of freedom of worship: No religion can impose its spiritual vision on society. This means that all beliefs are respected, even those of those who do not practice any religion and those of atheists.
Right to associate freely: This right implies that you can choose who you are going to meet in your life.
By protecting equality before the law, civil rights reject any type of practice that benefits or harms people due to their characteristics, beyond their merits and abilities. The restriction of some of the aforementioned rights, alleging as a reason, the color of the skin, physical characteristics or religion, is considered a discriminatory practice.
However, 2) political rights for their part: They allow the participation of citizens in the government of the community of which they are part. An important clarification, at this point, is that not everyone has political rights. Given that to exercise them you need to be a citizen or nationalized.
then ... these imply, mainly, the right to elect representatives and be elected to government positions, by vote (or suffrage). The main political right is suffrage, however, whenever a person is interested and actively participates in improving their community, through different participation channels, political rights are being exercised.
Examples of these channels are the Tools or Mechanisms of Citizen participation).
Referendum, consultation or popular initiative.
3) Social rights: They correspond to the most vulnerable groups. For example, workers, the poor, children and the elderly and must be insured by the State through laws and government programs that aim to promote equal opportunities for development. They are social rights because it protects a group or sector of society.
Unlike civil rights, they can be exercised as a group.
Some examples are the right to: A home, to health, to work, to education, etc.
4) Collective Rights Also called "Third Generation Rights".
They are those that correspond to society as a whole, since they protect diffuse interests. They encompass the community in general.
They refer to the defense of the environment or ecology, and to the protection of consumers and users. The actions or practices of people or corporations that can pollute the planet harm us all. As well as it is also necessary to protect ourselves, as consumers, from certain malicious or abusive practices that service or goods providers may practice.
