Hi, you said you got sued for hiring an employee who signed bad non-compete with someone. How do you check if a person doesn't have that problem before hiring?

You have to put in your contract that the contractor or employee certifies that they are not under any non competes and if they are you reserve the right to terminate the contract. That is the only way because people can lie. You don’t get sued right away first they try to get you to comply peacefully.

If a business wants you to make calls to grow their business yes they should pay for your business line. I would not do this with your cell, and if you are you can write it off as an expense.

Does a freight agent need to have an LLC or other entity to be paid as a 1099? I have a brokerage, so I'm looking forward to that next video for what brokers need to put into the agent contract.

Yes they should unless they are operating as a sole proprietor. For your purposes you should require agents to have their own entity. Just makes the books cleaner.

The company im working with to negotiate as an agent . They want me to bring 3 signed contracts with shippers before they will give me an offer what do you think about this ?

That’s like them asking you for a left handed coffee mug. A shipper is not going to give a signed contract to an independent agent with no brokerage behind them. Owner sounds clueless. Either train your agents that you bring in “green” or don’t offer a program with impossible metrics. Wish I could tag them here.

I had a broker once tell me that they pay the agents every other week, as though it's a "payday"; I was a bit skeptical because I got the impression that he considers his 1099 contractors as employees- He was also a "control freak" who DID call and ask things such as "Why are you still in bed at 10 AM on a Wednesday", etc...

I pay every 2 weeks nothing wrong with that that’s just dependent on the pay cycle of the company. but a contractor is a contractor so can’t be calling to wake them up. You could have sued that broker for waking you up essentially. I would have
