What to Say to Insurance Adjuster After a Car Accident

Were you in a car accident and you’re just about to call the insurance company but you wanted to check what to say (and not to say or do) to an insurance adjuster? Check out this short video to find out.
You just got in an accident an you’re about to call an insurance company. The question you should be asking yourself is how to deal with the insurance adjuster.
Here is a list of what to say or not to say or do to an insurance adjuster during the claim process:

7:15 Two situations where the above may not apply
First, do not admit fault. No brainer right? But you could say something that incriminates you like you were driving 35 in a 25 zone. If you admit you were speeding they’re going to find you at least partially at fault for the accident.
Second, you should not agree to give a recorded statement. Why? Because they’re trying to get you on the record so that they can use anything you say to try and deny, delay or diminish your claim later.
One big exception to the recorded statement rule - you may have to give a recorded statement to your own insurance company. Why? You have an obligation to work with them written in your contract and if you don’t they might deny your claim or even cancel your coverage.
Number 3 thing you should not say to the adjuster is that you agree to settle your case for a small amount. This is an insurance adjuster trick. They’ll tell you to give them your medical bills and that they’ll take care of them for you and give you an extra $500 or $1000.
That money sounds good up front right. But its much less than you are likely entitled to.
The 4th thing you should not say (or in this case, do) to your insurance adjuster is get mad or scream at the adjuster. Getting mad is not going to help. Just document in writing via fax or email what they’re doing. That is the way to build a case that they’re not working with you, not screaming at them.
The 5th thing you shouldn’t do with an insurance adjuster is trust them. They work for the insurance company and the insurance company’s goal is to pay you as little as possible. So I don’t care how nice these folks are being to you, they do not have your best interests at heart.
The 6th thing you should tell your adjuster - Get them the location of the vehicle - sooner you get the vehicle inspected the better. Especially if in tow yard because those storage fees of $40 a day or whatever are going to come out of your property damage settlement.
Number 7 - don’t give the adjuster a ton of information about your injuries. If you have injuries you should either 1. Talk to an attorney before calling the insurance company or 2. When the adjuster asks you about your injuries say you’re considering talking to an attorney and don’t want to get into injuries at that point.
Here are two questions you need to ask your adjuster:
First - it will be a lot easier on you later if you make sure you get your newly assigned claim number for your accident. And second, you should ask if an adjuster is automatically assigned to the claim and if so what is their name and contact info.
Ok having said all of that I need to caution you about 2 things:
First, a lot of what I’ve said in this video pertains to people who have suffered injuries in a car accident. If you just suffered property damage, have no injuries, you probably won’t need an attorney’s help and you can communicate with the adjuster to get the car appraised and repaired or totaled out.
Second, I mentioned it above briefly but again, generally speaking you have an obligation to work with your own insurance company. But beware, if you pursue damages against your own insurance company for UM or UIM, they become adverse. And you’re going to treat them that way.

Your advice is right on target! I have a perfect example of an insurance company not acting in "Good Faith"! They put PROFIT before PEOPLE! They are snakes in the grass. Good morning, not sure what to expect from your ins co - depends on the quality of the co and what’s in your ins policy. Generally speaking in an uninsured motorist claim you can try and make a claim for your injuries. You may be in a “no fault” state so you should research that. If you do get medical treatment for your injuries I would suggest you at least consult with an attorney - but I always recommend that. I’m biased, I’m a p.i. attorney….. As far as the limits on your policy you need to ask your ins co that question.

Hello sir, I unfortunately got in an accident yesterday. Tbone. It was a 4 way road. I was going north there was a stop Sign and I was going to turn to go west. Due to obstructed view I could not see In the westward direction so I scooted up slowly until I had a good viewpoint of making the turn of course I was at a complete stop. I went out of town a few days ago, my car was parked and my family and I were inside a restaurant, when we came outside I noticed a paper on my windshield wiper and it only provided the name and number of the man who hit my car. there was scrapes on the car and the man that hit us gave us his ins policy number. Hi, I'm not sure I entirely understand what you are asking. Generally speaking, they will do an appraisal of your vehicle and make a determination as to the actual cash value of your vehicle. So I'm not sure what you mean how much money you should claim from them - unless you suffered injuries as well.... But listen, your state may have different laws. I just got into an accident 4/19, driving on a main road in the left lane, and a driver coming from the intersecting road ran in front of me causing me to hit my brakes.. unfortunately I couldn't slow down fast enough to avoid collision. I made the mistake of giving my statement to his insurance adjuster (considering this is my first car accident I lacked the knowledge of not being required to give them my statement)..when I was done with my statement, the adjuster asked if I would like to add anything, I added that the other driver admitted fault at the scene and that the officer was a witness to that. She cut me off saying technically I hit his car so therefore it was my fault. After that I just requested to also add to my statement that I had the right of way, I was driving the speed limit, I had no stop light or stop sign, and that he did have a stop sign. She subsequently continued saying it was my fault. Will I have enough with the crash report from the officer to avoid having to hire a lawyer?

Hello, I was in a low-speed accident with no injury that took place on the parking lot of a restaurant which is private property. I was NOT at fault and so the at fault's insurance company adjustor has only admitted to being 80 percent at fault thus meaning I would be 20 percent at fault. Unfortunately, you're choices are to use your own ins co to get the prop damage fixed and let them go after the other side for reimbursement (if you have coverage that is) or you could file a lawsuit against the third party (possibly in small claims court depending on how much damage there is). Morning. Not sure I entirely understand. In terms of arbitration - you're referring to appealing your own ins co's decision? If so, I guess that could be an option. In terms of the other guy who was involved in the accident, if you really feel you were not at fault for the accident and their ins co denied your claim, your only choice against the 3d party would be to file a lawsuit against them. You might want to research how to file a claim in small claims court depending on how much $$ the damage is.

Hi, well, generally speaking if you've got a dispute with your own ins co, you need to appeal their decision asap. So call them and ask how to appeal the decision. Don't delay. And ask them for a copy of your policy so you can see how the appeals process works.

Hi, well, you can ask for whatever you want. But whether they will give it to you is a totally different story. But lost wages are reasonable. If you have receipts for Uber rides you might be able to recover some of that. Whatever you ask for, very generally speaking, you'll need to document it to recover for it.

If you really can't pay for it, write letters, send emails whatever you can to do get the message across to the adjuster to get that car out of storage. Or use your own insurance to get it out. You don't want to leave it there if at all possible.

On 3rd of March, I met with the accident, it was our new year and took one week off to take my families to see other relatives in Calgary( I am from red deer, Alberta) after one year and plan to take my kids for amusement park in Edmonton. First day of my vacation I met with the accident( my brother was driving). I have to cancel all my plan as I hurt my wrist, elbow, head, right ribs, cut tongue, neck and back pain and most important, fear. Here in IL, I would demand $5k reimbursement because in all likliehood, the med providers would seek reimbursement for the treatment they provided..... In terms of them moving quicker, go above your adjuster's head to their supervisor. And start documenting things in writing by fax or email.

I I'm still feeling the pain in my neck, shoulder and lower back the same pain for my husband. Headaches all the time and not able to get complete sleep. I had just come over train tracks and was crossing the street that ran parallel to the tracks, the other driver left their stop sign and ran into the side of my car. I reported the accident to my insurance provider, they told me that I didn't have collisonand that I was on my own and they didn't have to talk to me. Yes. Could also be a bad adjuster and when it gets to a defense attorney they see it realistically....

@@CopelandD Depends on the state. Here in IL we can discover before filing a lawsuit if we meet certain requirements. Need to ask an attorney in your state.
