Its stupid how this generation just babies their kids and when they grow up they are gonna struggle. Plus what's the worst thing thats gonna happen to your kid? my parents have never checked what i do online and nothing has ever happened to me. and no kid is stupid enough to go meet up with a pedophile in real life.

...and creators and viewers will be paying the price. When you obtained your account from google, you signed an indemnification agreement. You have agreed that if YT is sued for your conduct, you owe YT any amounts they have to pay as a result of an FTC lawsuit. 😢

I assure you that the parents could never watch over their children to prevent the type of data that is being taken from them. One digital marketer said “if most people understood how much data they lose every day, or could physically see it being taken, it would cause widespread outrage.” What the FTC is trying to do is- in theory- not a bad thing. But the heavy handed response and KZbin's apparent "self-destruct" response is extremely concerning. I'm not really sure how a lot of KZbin creators are supposed to continue. 😢

Imagine if we owned our data and was allowed even a small slither of the revenue from that pie. Wow, we’d all be rich. Data is the new currency. These big companies just do want the masses to know. They are mining it from us like liquid gold, but we get no cut 🤷🏻‍♂️.

That's exactly what I'm thinking. This wouldn't be an issue if kids followed the rules and didn't make accounts of they're not 13. And this wouldn't happen if parents actually cared about what their kids do online. The problem is that the current parents didn't grow up with the internet so many of them aren't fully aware of these rules, but that still isn't an excuse.

I think *KZbin* is being rather ridiculous and going overboard with this whole erasing comments mess. Like for instance deleting comments on a video just because some random little kid walked by the camera; and was never seen again while their parent was filming and talking about some thing else, and doing it to kids cartoons such as *Arthur* and the *The Chipmunks* . I just wish that it would go back to the way it was before. : /

Everybody is at fault here. The parents for letting their kids watch KZbin instead of using the kids app KZbin for collecting data on those kids. And the content creators for trying to exploit those kids and make money off of them by advertising to them.

@@iancorzine If I had a child who needed a phone I would simply either not make it a smartphone or make it completely impossible for the child to access the internet with that phone, if that were even technically possible. No child needs a smartphone for safety or to be able to reach their parents. And laptops etc. can either be locked away or be put in a room that is locked or the internet can be turned off on those devices as well, so your child who's at home alone can't watch everything and anything on the internet.

My thinking is Goverments should give everyone over 12 a unique passport code on their ID that Companys can just reference the Age from, only Age ofc. Then update that ID at 16 and 18 and 21. Account creation required and the ID to check the Age. But even Goverment wants that sweet Tax money from the Dataminers, so no way thats happening :D

"Unfair" and "inappropriate" are nebulous terms that don't belong in the law. "Fraud" does. If the FTC protected us simply from fraud, I'd be fine. "Unfair and inappropriate" is just big brother protecting parents from themselves.

I think some people are forgetting the absolute vile marketing campaigns by two big cigarette companies, Marlboro and camel, where they used an animated camel and a rough tuff cowboy to market their product as "cool and manly" to hook an underage market. Coppa seems to be in the same vein but written by people both before the internet matured, and by people who dont fully understand the internet. Honestly if youtube wasnt guzzling cum by the metric ton they could have and should have put in a rating system similar to the esrb with clear guidelines

Well stated, I'm going to start dismantling my channel today, I'm sure that since only my friends watch and those numbers are very low that I will be dumped as not financially viable anyway. At least I have a little time to save what I want before they dump my channel. I don't trust any of the entities running this farce. Vague rules and guidelines are there for a reason, loopholes to give them more latitude to mess with creators even if they think they are on top of it. If this lawyer isn't sure of it all ...... Great video. I can't believe how vague everything the FTC says is. ALL of the criteria for a "child directed video" are super vague. As an animation channel that mainly focuses on content for older teens, COPPA is scary. Especially if we're gonna have our videos analysed by out-of-touch boomers who don't understand the myriad of nuances many of the videos on youtube have. Signed the petition and am writing up a message to the FTC now.

If they really wanted to have children they should've understand the consequences of having a kid, they should have a child if they're not too busy with their job they should interact with their children and educate them very early instead giving them some damn electronics. My mom educated me even when I was an autistic baby. She took me to therapy and early education (I didn't go to preschool)

I see KZbin has it's contacts and meetings with several different authorities, and therefore it is a challenge to provide a good solution to protect children under the influences of the capitalistic world, where the provider of content for jung people have to get their income thru publications. As a musician playing improvised piano in styles of Keith J. , I would not get a worse bill to pay anyway, but I also like to do programming. So my idea is to build a new platform, where the kids can watch a video and until they are in the age of an adult, the list of watched content is transmitted to the parents, containing the answeres of any optional additions like contests in from of checklist. So in forms of teaching content the parents could see the efford in summary of their offspring. On a base of free will, they would have the choice of donate "for the good results" or give other feedback. There might be a point where creators can decide, that the parents need to pay a small amount bevore the kid can go to the site next time. ( A hell to code it seamlessly - but those affords I like to struggle with. On the other side I think, there's need of inverstors for the servers. My personal problem at the moment is being in Germany as a British Citizen without any passport , income , registered as homeless and have this room on courtesy bases till I can get a trolley standing around ) Thats how I play= kzbin.info/www/bejne/eH_Yq3enjp6fl7M Would kids like it ?

Eventually, children would be treated as unwanted leeches if this law is implemented. It’s a lose-lose situation. Creators lose money or get sued for $42530, and children get exposed to non-kid friendly content, as well as get mass attacked and cyberbullied. Besides that, I have a few questions that I felt have not been covered about this issue. How would this affect international creators? How is it possible that they get sued by AMERICAN law? I don’t know how politics work, but there’s something wrong there.

It's the parents who don't care enough and hand them the phone to silence a child instead of showing patience and dealing with corrective behavior and or punishment. My niece is 5 years old and is glued daily to KZbin now because of her caretakers who were too impatient and irritable to be real guardians. She's been raised like this for 2 years now, I have no say to fix it but I know what the problem is, its irresponsible people to blame.

I don’t really consider myself an avid constitutionalist. But I’m pretty sure the FTC enforcing $42,000 fines upon users on social media platforms, including but not limited to KZbin, breaks the 8th amendment’s restriction of federal powers in imposing exorbitant fines for unclear reasons. COPPA conflates web cookies with private and personal data. Data that's site traffic isn't the same as dated hosted and stored on emailing and banking accounts. Advertisers aren't breaking laws. Advertisers aren't the same as invasive downloadable spyware which sifts through and collects data on a person's PC, no their web traffic. Obscuring cookies with private data is baseless and bunk, in all honesty: And done so on purpose through the FTC's rewriting of COPPA, without anyone's consent or knowledge of such, in order to have a reason to prosecute and fine people in court. The FTC imposing a fine by threatening lawsuits taken into US federal court is nothing but a criminal racket. It's extortion and theft. The 8'th amendment is violated. FTC's lawsuit shouldn't legally stand in court, at all.

It's not parents"can't," it's parents by and large "DON'T" monitor their children's online activity. Overall, children have WAY TOO MUCH/TOO EASY access to things that they shouldn't. A LOT of damage has been done, and is manifested in so many ways. Children also know when their parents are 'caught up' and don't really attend to their doings. And they (children) surely think that they are 'free' to let it all out on social media (with their secret/not-so-secret accounts) and they DO!!!

I remember watching stuff on youtube as a young teen in the mid 2000s, and my parents would go through my hostory, and make sure I wasnt watching anything bad, they would also pre-screen movies until I was around 13-15. Its unfortunaye that most parents want to pass this job off to the government which will be always ham fisted.

Other corrupt influences include some of a child's friends, who introduce them to filth (at sleepovers, outings, friends' homes, etc.). So sad!!! Plugs-wifi-data-enabled devices have defied the floodgates of corruption thus making it all so easy to access. Can't turn the clock back, but I do wish I could have had access to word processing on a computer in high school/college in the seventies. Papers could have been done SO MUCH FASTER!!

KZbin literally says to get monetized that you need to have videos friendly to people 13 or under. Then right next to that it says to avoid coppa by not making videos that appeal to people 13 and under.

I think the better question is, "Who couldn't it be enforced against?" Unfortunately, I'm guessing that's the point. It's far too subjective to really exclude anyone, which means they could bring in a lot of money with those fines. I've considered trying to build a channel for my four huskies, but never mind. There's no point. Pet videos would definitely be attractive to children, but, if there's no chance of building a community, what's the incentive? All that effort for nothing? Nah.

@Planet Claire Has Big Hair ok, so I don't see the problem. Creators should not suffer for that. There are all kinds of choices parents could have made. For example, the Amazom playtime app has a feature where you can approve or block video content for children. It's only $3 monthly. Let KZbin pay the fines, not creators.

That is why limitations should be put on kids with phones and access to the internet or don't let them access at all. Yes, but too many people on KZbin have made videos about this topic using 3rd/4th hand information with no knowledge on the subject. So the world is going into meltdown. It is KZbin/Google who are responsible for ensuring that children's data is not taken. I can imagine, of you don't label a video they will just boot you off the platform. I don't think the FTC will or can go after a content creator, seeing as YOU are not the one taking or selling their data, only making money from monetisation based on this sale. The easy solution for people is not to moan, but leave the platform. Or stay and stay within the rules that Google/KZbin outline. - it isn't the drama people make out.

I was taught what predators were at twelve. I was taught not to trust anyone on the internet at twelve. I was told not to enter my personal information in a shady sight at *twelve.* The parents need to ban their kids off the internet if they are gullible. They need to teach them stuff if they want to be on the internet. They need to monitor them on the internet if they are under 12/13. We are NOT their baby sitters.

@@primarinegaming6761 Contrary to popular belief, there are other websites dedicated to videos; such as Dailymotion. The issue is, none of them are as large and well known as KZbin. At the end of the day, if KZbin does go through with this, it'll only be a matter of time until a new platform will be found for people to upload without fear of being sued.

There's two sides to this coin. The side of Google collecting Data on children under 13 knowingly and illegally. And the side of parents who allowed their under 13s access in the first place. So it's actually both big corp and stupid parents, but mostly big corp for being greedy in this case.

My little brothers used to have freedom on KZbin. I would catch my youngest brother looking at weird "kids" channels and snatch the table away beCAUSE WHY WOULD YOU LOOK AT THOSE WEIRD CGI ANIMATIONS!? I'd put on something more appealing to the eye like Peppa pig or Ryan's toy review. My step mom didn't like what my second lil bro was watching so he had his whole tablet snatched. I guess there was cussing? Idk. Btw, the youngest was on kids yt but still didn't save him :)

This change has inhibited me from making playlists of each subject (examples: One letter of the alphabet, Sign Language, or potty training songs) that HELP me to EDUCATE my child. If these channels made for my child can no longer make revenue for their hard work, then SO MANY CHILDREN will lose the ability to learn in fun ways! :( Personalized ads (for toys, games, etc.) towards MY child (who has MY permission to watch content on MY channel) is MUCH BETTER than the MATURE ads that I'd prefer her NOT to see. This "protection act" is NOT protecting my child. I'm having to protect my child from the unpersonalized MATURE ads that are now being exposed to her as a result of this change! I feel stripped of my right to parent my own child. Let me (the actual parent) determine what I let MY child watch. I hope you receive this well.

Yes but with technology and everything and the amount of people that know how to do programming KZbin is no longer a quarter horse pony show and if they show weakness and start to fall people just make a new program take over what KZbin was and just make another KZbin but with a different brand color scheme and name so if you to Falls another program will just pop right up and take over

Isnt the key here the fact that children need express consent of their parents to access the internet? If the kid is on KZbin then the account would most likely be a parent account, and therefore mean that they have parental consent? Doesn't that protect content creators? The child has parental consent to be using KZbin and viewing the subject matter? It's on the parents, not the content creators. I don't let my kids in KZbin ever. This is all because of lazy parenting. You have to watch what your kids are viewing online.

Sorry to pop your bubble, but the other option is having it not be a free service.... and having to pay for everything with money. Right now they collect that data to assure advertisers they will advertise to the right people, thus they get paid and you dont have to spend a dollar to search on google etc, though if this bothers you this much... use duckduckgo.com as a search engine, on firefox as the browsing software, with protonmail instead of gmail and dont use facebook or any other social media, or any website that uses ads. The only worrisome thing google does is they also sell your emails to whoever as "anonymous" information.

I have no clue where you got the idea of them being funded by the government, 2nd, yes they do get money from other corporations, the corporations that paid them to advertise their company/product to people... and google can ask more money due to them being able to show those advertisements to the right people.

I feel betrayed by KZbin... I really do. I LOVE watching KZbin videos, and seeing KZbin's new COPPA compliant policies almost made me quit watching KZbin videos for good. I HATE it... I really hate it. What's even worse is that the fine that you have to pay for breaking the law is just inconsiderate, ESPECIALLY for those who are poor. I feel humiliated and disgusted by KZbin's new rules. First, I need to get this out of the way... Mario is NOT just for kids. Sonic the Hedgehog is NOT just for kids (it never was, actually...). Most importantly, Kirby is DEFINITELY NOT just for kids despite having bright colors and cheerful looks; therefore, looks can be deceiving, as there are MANY dark moments in the video game franchise. I also need to point out that LEGO is NOT just for kids either. Heck, I've been collecting LEGO for nearly 15 years, and I still collect them. I watch LEGO videos on KZbin to gain ideas on what to build. I have no idea why most LEGO KZbinrs marked their channels as "made for kids" when really, LEGO is specifically made for everyone, NOT just kids. The new policy created by KZbin to comply with COPPA really gets under my skin. I really wish KZbin made a better strategy to comply with COPPA so that we don't get in trouble, but sadly, this is what we get, and now I'm ticked off. Yeah, it's been 6 months ever since it was put into effect, and I am still incredibly bitter about it. I still talk about it in anger and disgust, and man... I really wish we can go back in time and fix this issue, but since this is real-life, we can't and will have to live with it... :(

Pretty much, yes. The way it's written almost any video could be considered "kid friendly" and therefore content for kids. Even having an animated intro with just moving letters could "count", again, if someone interprets the new rules literally. I'm more concerned that some creators will accidentally mislabel a video and be financially ruined for that mistake. Will they fine only repeat "offenders"? Will they make an example of someone to prove a point? If you never monetize your video -thus you are not asking for ads or ad money- but KZbin plays ads before and/or after it automatically, does that still make you libel under COPPA? Apparently nobody knows. Here's a thought: how long until a kid uploads a video, doesn't mark it kid friendly, and gets a fine for it? Who pays then? The 8 year old? COPPA is a mess.

Yeah, basically. I concerned because on the document it says that words that kids use such as “cool” and “whatever” which a lot of young adults, teenagers, and others also say. They also include “bright colors” as something that would be considered as “for kids” they also suggest video games as for kids however a whole lot of adults also like. It’s just in general too vague.

@@blue_musicals I've got a couple of old videos on my channel that I made ages ago. I never bothered to monetize them as they're crap, but I wanted to keep them up for nostalgia's sake. I just went through and marked them as kids content to be safe, even though I never thought about my "audience" when I made them, and never intended to make money on them. I wonder how many abandoned channels have old forgotten vids on them made in grade school that could come back to bite the poster today? 'Tis nuts.

I'm not a creator; however, I signed the petition. All my children use KZbin under my account. As a homeschooling mom, I use all kinds of KZbin videos. We also watch kid friendly videos as a family. I think the government need to get out of the parenting business....

Let me know if I got it straight: For having targetted ads to kids by getting their information and breaking the law, KZbin is forcing everyone (after a fined settlement) to make kids content on the basis that the Federal TRADE commission has proof that KZbin is actually watched by more and more kids. How did creators break the law? "not kids content" is not the same as "Gathering kid's information" via cookies, which seems to be the actual problem here. That's what I don't get. Throwing the creators to the wolf because youtube/google broke the law is utterly ludicrous. IF targetted ads or recommended videos is the problem, because of data collection, just stop THAT.

Everybody is at fault here. The parents for letting their kids watch KZbin instead of using the kids app KZbin for collecting data on those kids. And the content creators for trying to exploit those kids and make money off of them by advertising to them.

Damn straight they owe every creator who has invested years into making a living, a community & a life using KZbin as a platform to access people all over the world. KZbin is the only “social media” I use, I have NO other accounts. These new rules mean I will lose not only comments on some of my own videos but entire communities I have grown to know, love & become a part of. KZbin was such an amazing to just be yourself & say whatever you think without anyone being able to stop you. This is an absolute travesty & they might not even stop here 😕

@@memegazer No, the important matter at hand is not that children won't be tracked, because KZbin has no technology or ability to tell who is under 13 or over aside from trusting that each account is telling the truth about their age. Any child who knows that saying they're under 13 online means they get punished will just lie and say they're older so they get away with it, and youtube has no way of legally finding out if they're telling the truth about their age. Not only that, but even if KZbin does have a good way to determine that (again, they never legally will), "child directed" content does not show up in suggestion feeds, it does not show up in youtube searches, and the videos cannot be found on the internet outside of manually going to a creator's channel and finding it there. Like what @theicedevil said, any and all "child directed" content will not be viewed by children because of this, ever, and I almost guarantee you that. And let me remind you, no ads on child friendly content means that the creators making that content receive almost nothing, nada, in revenue, since there are no ads and the video exists nowhere online except on their personal channel, which is tedious to access. What does this mean? Not only can't the videos marked "for kids" be seen by pretty much anyone, there is no incentive to make that content anymore, so, and I guarantee you, almost all of it will disappear. Over 90% of content on KZbin will become mature rated content if coppa gets passed as written right now, which puts everyone back at square one after ruining both the medium and the millions of lives who use youtube as a way to express their careers and passions.

Coming back to this video in 2021, I remember that with all of this going on in late 2019 and early 2020, 2020 was supposed to be THE WORST year for KZbinrs (according to the KZbin community). However, looking back, 2020 actually ended up being one of, if not, the BEST year for KZbinrs. Just ask any KZbinr whose channel has really grown in 2020.

Well, it seems like the COPPA law is not effective in the EU. The KZbin terms in Europe clearly states that children under 13 is not allowed and under 18 needs parents approval. Furthermore it's stated that it's the parents who are responsible.

Yup. I used to be a teacher on KZbin. I taught derivation and meshing skills for Autodesk software. But because avatars are normally used for display purposes I either had to label everything for kids or shut it all down. Guess what I did? Now students will be at a loss that went to me for help. That is not my problem anymore. I got rid of my entire teaching channel. I simply retained my videos on thumb drive since I put so much work into them to help people. I did not even monetize my videos. Now, on my main channel I have left I have to mark all my cat videos as kids only. It's definitely not worth anyone's time at this point. I will be searching for another place when I have time or look into my own website that does not run ads .
