Not just employees. It could be a vendor. This happens for example when companies hire IT people.

Thank you for the info. As the business owner, is there anything negative about having multiple types of clauses in the same contract? For example a non-compete, a solicitation, and a disparagement clause. Also, do these agreements apply to independent contractors the same way that they do employees?

My wife is being sued for being a estimator at body shop. She sign a non compete. They are claiming that bouns she received was a comparison (I spelled that wrong), but no where in the non compete contract it mentions that. Is that normal for a non compete?

I have a friend that was laid off in April because of the Corona Virus. They are open again, and advertising for 'new' salesmen. He has re-applied, but they are ignoring his requests. He is afraid to try to work for a competitor because of a non-compete agreement. Would it still be binding on him?

I work for a glass company in CT , I'm an apprentice I've been working here for 5 months , I'm leaving the company but I did sign a non competition form. Now they want to take me to court. They none competition form shows 50 Miles around that's almost all state of CT

Not that I’m a lawyer, but that violates the public interest and is harder to uphold. Also, when you don’t have a high ranking position it’s also hard to uphold.

@@mistermister1541 Ya, not that it's going to help 3 years later... But a non-compete that limits 50 miles is not reasonable by any means. It would entirely depend of the court, but generally limiting small areas is about as much as you can do with a noncompete. I wonder if he ever went to court...

How the non-competed agreement work between employee "J" and employer "X", if a company "Y" bought company "X", asume that the owner on company "X" has shares on new company "Y". Do contract agreement between "X" and "J" can migrated to company "Y"? Do a new agreedment need to be sign between company "Y" and employee "J"? Best regards.
