I believe they can, you see lot of the gameplay footage show weapons with almost exact motion as in TF2. If valve were to open a case I believe they could compare the games data and from there sue. This company have only as it seems re-textured most characters/removed some bits and added some. It would still be countable for copyright, if that's possible in China.

In order to make a good FPS you must cheat, and in order to cheat you must copy TF2! Final combat made that. And i'd say they know a little more about fighting than you do pal, because they copied that. And then they made it worse so that no one could best them in the ring of court.
