Where's the Fair Use? - AlphaOmegaSin

AlphaOmegaSin talks about fair use on KZbin as a video response to Nostalgia Critic on Channel Awesome. KZbin / Google have cast aside fair use often lately with videos flagged or channels taken down entirely all the while they were obviously within their legal rights with the content they made. This is something that should be discussed and known by everyone who uses the site. This should be spread around and shared and discussed so we can potentially keep things from getting worse.

This is why I stopped making videos years ago because its tiring to fight youtube over and over. Back when I was making lets plays in 2006, I lost count how many takedowns and even strikes, so I stopped over the risk of losing my channel which is now nearly 10 years old.

I had several takedown requests on battlefront 2 LPs back then, I had alot of videos and only two remain, in fact one was essentially blocked worldwide a few weeks ago because the star wars theme and game music is 'copyrighted'

+Black Fire Dragon the 13th The only LPs I do now are PS4 livestreams of games very few care about :p I'd rather have my channel small and friendly than large and exposed these days, especially these days when false flagging, haters, big corporations waving their IP copyright wangs all over the place and like #alphaomegasin mentioned, some channels have absolutely no chance to fight back - fair use is more or less dead on youtube unless you want to try to fight back and risk losing your entire account in the process. Lets face it, if it came down to you vs Sony; the latter has almost unlimited funds to throw at lawyers and the average youtuber will just say, its just not worth it and back down through either fear, or they just don't want the aggravation. The latter is why I threw in the towel along time ago, because it wasn't worth for me - the stress and aggravation to deal with legal issues especially considering years ago before LPs was as popular as they are now, the legality of them was a really grey area.

Thank you so much for this Alpha. You're the best man! I recently received a copyright strike. However, it was a justifiable one. I will not pretend it wasn't. But, I did learn a lot of scary things throughout the process. The strike was on a 16 second teaser I posted with 300 views. It had been manually taken down. It had been claimed at first, which usually means I am in the safe zone because they get the money, and I keep the video up. 10 days later I receive a strike on it. Maybe the vid stopped making money and they just thought, "Screw you." What I don't understand is why someone would want to strike down a 16 second video with 300 views, that is basically advertising their show that I enjoy, to my subscribers. I usually stick with creating my own content, but just wanted to update my subs about the show. However, this isn't my point. The problem is with the process of my attempt at contacting the claimants. I sent multiple emails to the claimants address about retracting the claim with a response of me deleting the video if they did it. I received no response after days so I sent more emails. No response. I then sent emails to the main company's contact address. No answer again. I wrote my heart out and politely asked for a retraction. I just wanted the strike to be removed. I even tried explaining but all I get is no acknowledgement of even receiving the email. It just shows that even if you have fair use, companies wont answer emails or anything. You will most likely end up having to file a dispute, in which everything gets complicated with legal issues. Other than that situation, my content consists of fair use. However, I am worried about videos with pictures of the show, even though it is fair use with my commentary and criticism. You had a huge point about the little guys not having that much help too. Also, the reason I use images is because I feel more comfortable with not having to show my face. There is a big relief in coming home after a hard day and conversing with people on KZbin, along with creating content. I don't want that to end. Awesome video as always man!

They say you can use a certain song on a video then immediately after you make a video containing that song that you spend hours upon hours on and could be considered fair use, they remove it, block it, mute it, or give you a copyright strike. Here is a fun one about flags on content AlphaOmegaSin: A video of mine of Mario Kart 8 was flagged by Nintendo for copyright, however, it was uploaded through the "upload highlight to youtube" IN THE GAME. So basically they allow players to upload content to youtube only to flag it as copyright afterwards.

Happened to me just the other day I worked my ass off on a project to rescore a TV show I love. I gave copyright info, and said on the video description to support the official version, yet my time taking the music out of the original. And working tirelessly for my contribution to their franchise seems like hours wasted for absolutely nothing. I'm glad you made a video on this Alpha, I feel a lot of people SHOULD be aware of how much of a joke KZbin's Copyright system is. A friend of mine lost his channel entirely without any cause or notification, and even I myself, someone who's done KZbin as a hobby for 4 years now, just recently got completely fucked by copyright strikes on content I've had uploaded for months. this is to the point I've lost literally all of my partnership and even regular channel features. I sympathize for each and everybody affected by this, I'll definitely be sharing this with friends. Fuck KZbin.

5:18 Another thing that makes this pretty self evident is that I found your channel through a feature on youtube called "All Activity", where I could see what videos my subs were liking, what channels they were subscribing to, and through that things of interest to me. I found anywhere from obscure channels with literally like 20 subscribers to videos I never knew existed. When they removed it, it became pretty self evident how reliant I was on that to pass the time and find content relevant to my interests (Because fuck knows "Recommended for you" is _useless_), so I don't spend nearly as much time on youtube as I used to because what they did was removed it and replaced it with "Trending", when it was SPECIFICALLY SAID that the reason they removed all activity because it was taking up space they didn't have and saw "Low usage". What we need is competition to youtube, and competition fast, because they currently seem to be abusing their near monopoly of a video sharing website. I don't see youtube existing in any kind of reasonable form 10 to 20 years from now at this rate.

As someone who is going to start creating content for KZbin soon, this has been a concern of mine. I'm going to do pretty much all of my own music and sound effects just because of this reason, AND I'm already planning on having to restart my channel 2 or 3 times. I'm ready to fight. One more thing: to everyone else who may be new or small on KZbin. Fight. When our voices are raised together, I truly believe that they'll have to listen. Don't give up. Keep fighting. This is actually the reason why I'm not really video editing (vidding with tv shows with music) because they will strike on anyone even though I wasn't getting any money, and I don't wish to make any money off of it, its not my shit. I just create music videos because that's what I want to do after I'm done with college, I want to join the film industry and work with editing movies or television shows. This is a very scary problem and it needs to be fixed. Listen, video editing is my hobby I enjoy the living crap out of it and when I want to show it youtube just strikes me down from my creativity. Companies now only care about the mighty dollar, and they aren't as humble anymore. It sucks. This needs to change.

But it goes further than just Channel Awesome....as it would need to be Cinnemasacre, Boogie2988, AlphaOmegaSin, all of the reviewers from ThatGuyWithTheGlasses.com (before Channel Awesome happened), The Game Grumps, 8 Bit Eric, Epic Rap Battles of History, Matthew Lush, Davey Wavey, Gaming Historian, AlphaOmegaSin, Dark Matter 2525, and 3-5 more big channels to get it started, and then at least 7 or 8 dozen small youtubers willing to convert over to the new Channel Awesome. I can't see it working unless you get at least 30-50 bigger channels/creaters to leave youtube and enough room for at least 200 smaller channels to leave for this new site as a start up, and then allow for new channels to pop up as well. Everything that is good about youtube, twitch, daily motion or any other site like it....and let's get rid of the bullshit....start a new thing. I love many things about youtube....but if Channel Awsome and other sites were to come along that could host the content....I'd drop youtube in favor of the new thing. I'm trying to launch a show...I can delay it for awhile if I know I have a safer place to upload my videos for people to watch.

Because they make their revenue based on how many people are watching them, and most of their viewers are here on KZbin. Of course some people will follow them, but many won't, and many more will not even know about them because they are not on KZbin anymore.

I have to admit, I've wanted to do a LP channel, but this has crossed my mind. Piece of advice: Always read EULA's thoroughly, and keep a copy. Companies love to slip in things to negate rights and prevent recourse in what's seemingly "retread" or "standard boiler-plate," because they know people don't read it. I love youtube as an entertainment format. I love tv programs and films of course, but I avail of youtube far more than anything else, even more than my games sometimes. Being able to listen to and watch people and things that are specifically chosen by me for their trait and qualities. I've just recently had my channel take 2 strikes from community flags for a podcast I host on youtube, apparently posting a podcast every fortnight is considered "spam or unwanted content" and offering viewers the option to download the podcast on soundcloud is considered "deliberately sending viewers to a website other than youtube", however other channels can post a video telling people their live on twitch?!?. This has forced me to stop putting my podcast on youtube and taken away my ability to stream on youtube. I tried to appeal and youtube took their stance and denied me. I'm livid. Just because I'm a small channel I have no say. edit: the flagged videos are from over 6 months ago too

The problem with the system is ACCUSERS AREN'T PUNISHED FOR FALSE CLAIMS! Possible fixes would be : - Money from ad revenue is withheld until claim is settled, rather than handing it over to the accuser. - Videos that had false claims that were repealed are given immunity from repeat claims made from the same accuser. - Users who mainly produce content that relies on fair use are given notice of claims rather than immediate take-downs, and accusers are given notice when flagging that the channel produces content that is covered by fair-use. - Accusers who make false claims are penalized in some form, possibly by locking out their ability to make claims for a period of time, forfeit of ad revenue for their channel, possible bans, etc.

A few years ago I posted a video related to the CFL (Canadian Football League). Less then a month later it was removed, and when I went to see why, the *NFL* claimed it violated their copyright. In some ways the way YT has gone reminds me of how ebay has gone. eBay use to be about anyone being able to sell their old crap. Now it feels like 90% of what's sold on there is by large companies, plus ebay caters to them instead of the 'little guys'.

Even though I've had gameplay videos flagged by companies that doesn't exist or do not own the right to any material shown it's not what takes home the cake. My friend composed a completely original grunge/stoner song, that we later recorded with our own equipment in his basement using NO pre-made sounds what so ever. Mixed it, and uploaded it to KZbin with album art that was made directly in art rage scribbled from nothing. Video was flagged just seconds after upload for containing material we apparently didn't own? I flagged and reported the shit out of that copyright claim, waited months for a response to our dispute just to find it denied and leaving us with OUR original song, on our account, be used for advertising by some random ass name we couldn't fight. Took down the video and it hasn't been up for anyone to listen to til this day. This is the KZbin we have to deal with.

You tube needs to 1. give better customer service, especially to the KZbinrs. not just the ones who are well known. human interaction is key. 2. Have a neutral third party involved in these disputes. 3. Do nothing to the creators channel until it is determined that they are in fact violating a copyright claim, or at least nothing severe, like a temporary hold and not for thirty days, a week at most. 3. Have them review claims of the content in question and determine whether said content is within the rights of fair use. 4. Instate severe punishments for the ones giving false claims, Like a counter strike, freezing their ability to file claims, after three shut them down. 5. Limit the number of claims on a channel at a time. These are a few ideas but something like this should deter those willing to abuse the system.

Beginning of your rant, you described my feelings towards making anything. The worry of getting flagged or a strike. I don't have much or close to no content. I have three videos that have copyrighted content and one video that is blocked in other countries (G'n'R song - My World). So far I'm okay because I'm not trying to make money off this stuff, just something thrown together for fun. But it does give one doubt in making videos. I'm a Transformers fan and as a kid I remember playing with Omega Supreme and hearing the Black Sabbath song Into the Void, and thought they went so well together. I'd like to make a stop motion video, but I'd probably get flagged or something by the music company(Virgin/Warner/Universal?? Forgot) or Hasbro. As you said, it's about money and power.

I made a really badly edited doom meets black ops 3 video, using the intro from the PSX version of DOOM. THAT intro (the song to be specific) received a copyright dispute instantly. I had 130 subscribers and it had hardly any views but I had to either remove that section of the video or activate monetisation in favor of the composer of this track. I get it, they made the track but it's a part of a bigger creative picture and it isn't even worth claiming against someone so small.
