I was fired for a medical disability and my employeer was dumb enough to say that in an email... If they didn't say why, it would have been hard/impossible to claim that was the reason which is where at will would benefit them.

The easiest way to describe "at will" employment is like this: you can quit or be fired for any reason at any time, without notice; however, you cannot be fired for a "bad reason" (membership in a protected class, retaliation, etc.).

@@fnnsjsnnejejdndnxhxjna Yeah, proving your case can be complicated, but a lot rests on temporal proximity. If you report your manager for sexual harassment and get fired the next day, it won't be too hard to prove that it was related, for example.

Except you totally can be fired for a "bad Reason" because the company always lies and states some bullshit reason it's okay for having fired you. Think I'm wrong? Go ask any black person who got fired from retail why they got fired shortly after a new manager was hired.

Jesus I'm forever glad this just isn't possible in my country. You can be fired for "gross misconduct" like you have to do something pretty awful to legally be fired on the spot. Otherwise there has to be a process, there has to be a formal discussion in person and writing, time and opportunity to improve your work and eventually then they can let you go. Restructures are a thing, but they're a separate process that requires reasons for each position that's disestablished, employees affected must have a chance to reapply for similar roles in the new structure and you can't cut your dev team in half then hire more devs without legal shit. Best one is that if I got into a full on shouting match with my boss (wouldn't, she's lovely) like proper going nuts and said "fuck you I quit I'm out", the legally cannot accept that as my resignation and must give me 5 days to "cool off" before doing it properly. Employee protections matter, don't allow this "at will" bullshit to carry on

In Poland usually you can either get someone's consent to be fired or reduce staff. The latter has the issue that fired employees can sue you to hiring them back if you start hiring just after reducing staff

As someone that’s worked with HR and management in multiple large Us corporations, wrongful termination suits are absolutely a thing. Pretty much any time someone royally F’s up and hurts someone or causes the company over 100k in damages resulting in them being fired, the company has very likely already started a discussion with lawyers that they have to keep on retainer. Pretty much a 99% chance of a retaliation suit nowadays that even if you win, you’re still out 20k minimum.

Linus: "How do things work then" Generally, it boils down to "get lost"... but with enough people getting let go at once, the US Worker Adjustment and Retraining Notification Act (WARN Act) takes effect. You have to give 60 days of notice or pay severance for that time. This severance needs to be no-strings-attached, meaning no NDAs, no non-competes, etc. I've heard from people I know that worked for twitter that the severance was conditional on signing a NDA and waving your rights to sue the company... which is definitely not legal.

Employers can fire for just about anything in pretty much all of the US, but generally speaking you can collect unemployment only if they fired you for specific reasons. Layoffs / mass layoffs are handled very differently per state with many requiring notice / severance etc. There ARE a few things they cannot fire for that are federally protected (Religion / Race / Age / disability ) but aside from that? "wore wrong color of shirt" is absolutely a legit reason to fire... and they could fight your ability to collect unemployment as well... the primary reason most places go through the hoops to fire people is because otherwise they are exposed to the federal protection lawsuit risks.

Most of this is true, even the 'wrong color shirt' comment. But while the employer can fight your ability to collect unemployment, that is up there with you can sue anyone for any reason in the US. True, but prone to failure. The issue is people accept these claims and don't even file when they have a good chance of getting the employer's rationale rejected. So while an employer can fire you for most causes, they have to be careful if they want to avoid the main reason companies pull sleazy maneuvers like this, the threat of increased unemployment rates. Unfortunately that's about the extent of penalties for canning someone for poor reason. As you said, even if you succeed in getting unemployment, most of this wouldn't extend to anything truly penalizing like a lawsuit or fine.

I use to work for a non-profit as a contractor in California I was a teacher that worked for them for years It was in their financial best interest to keep their workforce as contractors to avoid having to give benefits or pay overtime (you know, real scummy stuff) They promised a bunch of us full time employment with benefits for months until one day they sat a bunch of us down and said our services were no longer needed And because we were contractors we were technically "at will"

@@WitchMedusa Really the point was that they could technically end the contract at any point, it was written that way in the contract Kind of in the same vein as "at will" that Linus mentioned In this case the issue was they treated all the contractors like an internship program They used the promise of full time employment with benefits to make the workforce work longer and harder only to pull the rug in the end Cycle them all out for new eager workers so they could repeat the process They ended up getting slapped with a class action lawsuit and had to restructure the company There was a lot of shady stuff going on

I will never understand how people can keep working for those big companies anymore after being treated like disposable resources. Even if you don't get fired yourself, what sort of person would just be ok with 1/4 or 1/2 of their colleagues just going away over night? I will forever remember a woman that got fired from Facebook and was left without medical insurance 1 month before giving birth... who is going to hire her? How much will it cost her in usa to give birth... what a complete mess.

Here in the UK, its pretty much impossible to fire someone that is pregnant. You can get away with nearly anything when pregnant. American employment law is awful, no idea why Americans put up with it

I could be wrong but my understanding is that with an at-will system there's no required due diligence before firing. But if there's wrongful termination litigation happens afterwards. Based on all applicable employment law. There's just comparably much less procedure before firing someone. That said, I never got too deep into it It's been a while since then so idk Okay, haveing gone further into the video and hearing what linus thought at will was holy shit. My guy that is the most catastrophically silly perception I have ever born witness too. People shit on America for not understanding how other nations work and then not taking the time to understand America aswell 😩 🦅🦅🦅

The more protection for employees are, the worse it is to hire ppl and less chances for the country to have investments and work for ppl. In argentina it's a fing nightmare to hire ppl. Factories rather pay 100% overtime fees than hiring 1 new guy.

At will employment is legal in the entire country (I'm pretty sure) but businesses get to choose if they want to put that in the contract. It's usually only non salary jobs that include it P. S. It's mainly because with at will employment, you can also leave without notice or any procedures

There's one state where at will employment is not a thing. Don't remember which one on the top of my head, but there's at least one with decent labor laws in that regard.

@@niedas3426 honestly I don't think at will employment is a bad thing, especially because you know when you apply for the job. And with most higher positions and skilled labor not being at will it's not like companies can just send someone from a mansion to the streets. I think for retail and other high stress jobs it's good for a person to be able to just leave, or for an employer to be able to get rid of someone who might be a hazard to others

@@Pokebilities Fwiw, even in countries where at-will employment isn't a thing, it's still possible to break a work contract in particularly egregious circumstances (sexual harassment, for instance). It just makes it ONLY possible in such circumstances, which naturally means that only happens if things are REALLY bad. I moved from the US to Germany (where having work contracts is a thing and the default is requiring 3 months notice from either employer or employee) and honestly I do think it's a lot better for the employee in most circumstances here. It doesn't mean you can't be fired or quit a job, but it gives you time to job-hunt while still having income and gives your employer time to train a replacement.

Either the platform breaking or the remaining people that are not "superstar developers", being inhumanely overworked because they don't have anywhere else to go or they will be indefinitely out of a job. Been there recently. I, luckily, had a nice job waiting for me, while my best friend is still hopping from job to job because his position was something very niche and specific to the company we worked for, and now, he doesn't seem to fit anywhere else. He went from a stable job with benefits, to a fixed income with debt - all for the sake of cutbacks. People that remained in this company are now miserable and work ungodly hours with zero days off out of fear of losing their jobs...

These are software, network engineers, probably the most in-demand field on earth, companies are chronically looking for them everywhere. There is not a chance they remain unemployed for long unless they want to.

@@MASJYT there is always a chance for things not to work the way you expect/hope they will. Nothing is guaranteed. Especially in a world as volatile as the one we are living in today. That's a lesson I learned early in life. They may find jobs right away, but then again, they might not. It's as simple as that.

At Will (known in the states as "right to work" laws) - is annoying, as long as you can't prove that it was discrimination/retaliation, you can be fired for a manager just not liking you, and have little/no recourse. And taxes in the US are a nightmare even for people that live here... especially if you're self-employed or a company...

She renamed it Dollywood and has made multiple appearances every year, especially at Christmas, to keep it going and her family, friends and neighbors employed. Years before, the local school district had no money for textbooks, Dolly stepped in and $100,000 to buy them for the kids. Elon Musk, a Trump and Ron DeSantis supporter, buys Twitter, fires 1/2 the staff, with no notice, which is illegal. If you have over 1,000 employees and fire over 10% of them at any one time, you are supposed to give your employees 60 days notice, so they can save money and begin looking for a job. For those who don't know, Elon Musk paid himself $54 Billion Dollars for working at Tesla last year. He is being sued by other stockholders for gutting Tesla for his own personal profit. I would work for Dolly Parton any day and would be loyal to her as a friend, though I might work for Musk, I would feel ZERO LOYALTY to this reptile who lives without a moral compass and no sense of human decency

13:13 I don't understand why people call this a meltdown. It's not a meltdown. It's aggressive cost cutting + rapid iterative changes to the production systems , which is something that you don't see at that scale and at publicly owned/traded company because the share price would be destroyed and the board of directors would not allow it. Now that it is privately owned and that he has carte blanche from the other co-investors (for at least 12 months), he does what ever he thinks needs to be done to right the ship.

Elon already improved Twitter for Japanese Twitter users, just by firing the moderators / censors. They stopped getting recommended enraging divisive topics like racism, communism, feminism, etc. And they got back anime, Manga, sports, movies, etc.

I'm not japanese, but i do keep up with japanese trends and news for a side gig, and it's funny how true this actually is. before elon, there used to be a "balance" between politics trends and pop culture trends on the trending page. which was weird, because the majority of japanese youth don't really care about politics, the engagement numbers makes no sense too. nowadays, the trending page is almost always about pop culture. there are some occassional regional trends and politics every now and then, but they don't last for long. today's trending page for example is filled with idols, vtubers, and gacha games.

In Australia, the only way you can be dismissed "at will" would be being employed as a 'casual' instead of 'part time' or 'full time'. Casual work basically means your rostered when the employer needs you, and can go weeks or months without work. And can be dismissed without reason, or without notice. They just stop giving you shifts and wait to see if you ask or not. In theory, casuals are "dismissed" from their employment every time they finish a shift (but not actually), they aren't guarenteed another shift... But Part Time and Full Time you need to be dismissed for a valid reason with notice. The only time you can be dismissed from work with immediate effect regardless of how you are employed is for serious breach of employment; theft, assault etc.

MAANG is a lot of jobs, but there are 1000s of medium software companies that have 100s or 1000s of positions. Our society literally uses software for everything, I change jobs every 3 years and I have never waited longer than 2 months start to finish to fine a new development position at higher wages. Also such high wage workers will likely have a lot of money for expenses on hand, 3 months severance is gravy but these devs probably have 6 months of savings top of it.

Every time I order something online, the companys seem to be able to calculate the shipping costs to every US ZIP code by up to a dozen different services, so I am skeptical that the "nightmare" of state and local tax compliance is insoluble, since the total number of jurisdictions is smaller. If it hasn't been done already, it's a business opportunity to create a B2B service around.

At will can be dismissal for any reason but you can also leave a company or job for any reason obviously anything in a contract would preclude this if written that way

I usually never one to make corrections, but when Linus said "to our American friends may not be familiar with the term 'at will' "... I was like whattt.... (This coming from a Canadian who has now lived and worked in the US for better part of 30 years). All States in the U.S., excluding Montana, are At Will employment FYI. You can be fired or let go or laid off from any company without cause at any time, even in CA where I am employed. Now, most do have exceptions to that rule, like one of the ones Twitter likely violated with the mass layoffs and possibly not following the letter of the law on the federal Warn Act giving 60 days notice before implementing that plan* (more complicated than just that though), and as you said there are many other exceptions that push back on the rule of 'at will' that vary by State and also some other Federal guidelines. The states of Florida, Alabama, Louisiana, Georgia, Nebraska, Maine, New York, and Rhode Island do not allow any exceptions. You are 100% correct though - 'at will' or not, every company that has something to lose crosses the T's and dots the I's to insulate against any legal or civil suit backdraft. As an employer at times, and having let people go, or straight up fired a couple for VERY legit causes - even then, pushback on filing unemployment benefits can be an issue as well. For example, US companies (rules as always vary by state) pay into the states "unemployment insurance" fund, and the rates a company pays start off being tied to a % of payroll and what industry they are in. But as former or laid off employees file UI claims, those rates the company pays can go up DRAMATICALLY. Now a few exceptions to that are if the former employee quits, or is fired for cause or was in a defined probation period. One former employee I'm familiar with was let go for not only deciding to stop showing up for work - but also for embezzling a couple of Mill' on the way out. Arrested and everything, they still filed for UI benefits, which was disputed to protect against the companies UI rates being increased even though former employee effectively quit and/or fired for cause. Like everything down south here... Its complicated :-)

At will or not, if employers want to fire somebody, they will always find their way…especially for such large company. Does individual workers really have time and money to fighting with them in court and under the table or they may just rather swallowing the salt and looking for a new job? The richer you are, the less consequences you need to face for your action in the free world. That’s how democracy and liberation works babe.

"At will" does mean that California provides no recourse for terminated employees, but federal labor rights laws still apply, including many more worker protections than against just firing due to discrimination.

State rules can be different from company rules. So Kansas is “at will” as well, but there are tons of jobs with contracts and other sign-on bonuses and protections.

It's not just Ireland, the way he has fired people is horribly illegal in the entirety of the EU and UK (I'm sad I have to separate those. Watch this space as we in the UK steadily lose all those protections 😞)

It's not 3 months of severance that Twitter employees got. That's a lie that Elon has been tweeting and I guess it worked because everyone repeats it. California requires a 2-month notice for layoffs. Given that he didn't do that, the first 2 months from now you're a "non-working employee", THEN you get a ONE month severance. This may sound like I'm nit-picking, but the important thing to realize is that you're not allowed to get another job during the first 2 months, and also they can fire you during that period "for cause" (like if you disagree with His Majesty online) and then you're not part of the layoffs and you lose your severance.

I don't get it. If a 2 month notice is required by law, he has to pay them for that period. He can't fire them before that period expires. Otherwise the law would be utterly pointless.

@@seeibe the 2-month notice is required for these mass layoffs (I forget what #/% qualifies), not if you're personally fired for cause. I mean, they have to be able to fire you if, say, you steal something from the company during that 2-month period lol

@@JaviSoto Ah. In German law that's called "extraordinary dismissal", and the wording is chosen that way because you're only supposed to do it in extraordinary situations. I think Elon would have a very hard time proving before court that a) tweeting represents an immediate damage to his assets and b) a warning wouldn't have been sufficient to stop the behavior. Well I guess there's a reason German ex employees are suing right now.

The opposite to at will isn't just discrimination protection or the likes. In some european countries mass firing people basically doesn't exist. You can fire someone individually if they have committed an offense, like steal from the company, or if they are in their tryout period (3 - 6 months typically), but beyond that it gets more than hard. I am talking (local) government involvement hard. You need to prove that you cannot survive as a business, etc. In a typical situation, you are much more likely to get short work to get around short term recession or reassignment & training or voluntary resignment against a favourable severage deal, when a company dissolves a department that isn't working out, but is still overall profitable enough. Only when a company is in permanent decline, do you start to get into an area where this is really even considered, and at that point you have had people jumping the sinking ship or leaving because they don't like the likely worsening conditions, long term pauses in opening positions and payment rises, etc. that have likely naturally shrunken the business already, or the company has just sold a department. As long as the issue isn't an industry wide recession, that is usually possible, and not only removes employees, but also directly pays money.

My state is an at will employment state, you can be fired for any or no reason at all. At the same time you can also quit at any time without facing litigation. when is that a problem? ask the nurses who got court ordered to go back to work for a shittier, lower paying hospital once they found nicer jobs at a competitor.

Luke really needs to get out of his bubble. Not everyone at Twitter is a high value developer. Marketing employees for example will have more trouble getting a job since most companies are going with budget cuts.

This. I was an employee at Twitter and got caught up in the initial mass layoff. I wasn't a highly, highly skilled employee. I made ~$60,000 a year maintaining physical data infrastructure. I was lucky enough to have had multiple employment offers come through in the past week, but I know many of my old co-workers have not been so lucky. Not to mention we STILL haven't heard anything about severance, if we even get any (We were paid hourly, not salary).

Wrongful termination in California will lead to the employer paying upto 90% of the former employees unemployment checks. But it's up to the former employee to apply for unemployment. If they don't the employer could get away with some horrible behavior

Yeah my dad ran a Domino's Pizza I knew at ate what at will employment meant as long as you don't do it for a bad reason in public you can fire anyone at any time. Which is all that much worse when you work in minimum wage you're sexually harassed and your boss does nothing.

Unions provide protections for workers getting fired as well. I don’t know if Twitter is unionized but if they are before someone gets fired there is often a meeting between union leaders and company heads to discuss wether or not it was a legit reason for firing. If there was not and the company still fired the union will begin a legal battle on the employee’s behalf funded by union dues all of the employees pay

Yeah, California has rules. Companies can't just do mass layoffs without carefully planning who will be laid off. If a certain percentage of workers laid off are over a certain age, the employer is at risk of legal action. If an employee is "laid off" and they hire someone to replace them, that's illegal too. Also, many of these people have contacts. Elon likely violated hundreds of employment contracts. "One size fits all" terminations is not a thing.
