Im an Associate Broker 32 years, and I also wholesale. I decide which hat I am wearing before I approach a potential client, I solve problems, and I have never had a seller complain ever. I am completely transparent, and if you are there should be nothing to fear, we provide a great service wholesaling. It wouldnt just hurt the wholesaler to ban it, it would hurt many sellers too.

Krap!! I don't believe so. They too I think can do what you are doing since wholesaling seems to require no licensing or accountability (on the side). However either way I don't think wholesalers (whether full time or part time) sld be allowed to make any more than a 5%, 6%, or 7% fee off any transaction.

@@mellasish Not to mention plenty of our own investments and investors who sell through us get deals from other wholesalers. I’m glad to have them and wear the hat if and when it fits for a persons particular situation. Also most of the properties that are wholesaled are off market and often distressed. It’s plenty fine.

@@mellasish Regulations for wholesaling should be based around ethics and putting a cap on commissions is irrelevant because the profit a wholesaler makes on a deal is not a paid commission. It's based on the terms agreed upon between parties. You might as well just get a regular 9-5 that pays commission and be okay with that cap. The beauty I see in wholesaling is to help people in non-traditional real estate distress move on from a situation that is not about money for them. That's why creative financing exists and non-public real estate transactions. Like Jerry said everyone doesn't want to sell that way.... The empathy and caring about helping a person get out from under that leaky roof and busted foundation or the home where their loved one died and is unbearable to go on, should take precedent and all else will follow. There are predators and unethical people in every industry, doesn't mean to throw the whole thing away. If that's the case, good bye to private day cares, and law offices and grocery chains, transportation etc...

Not surprised that NAR is coming for wholesaling. The Real Estate market is so crazy right now that there's not enough new/refurbished properties for agents and brokers to sell. But there's plenty of distressed properties out there.

@@mellasish This is inaccurate. Agents are not limited to 5-7%. Commissions are negotiable for each client. An agent could ask for much more but market standard is around 6%.

The NAR's a joke. By this logic, each state should ban Costco and Walmart because they do exactly what wholesalers do with their products. The reality is that the NAR's angry because people without a license are making as much money (if not more money) as those who are licensed.

Jerry, heres a thought. For those in the 10k club who are going to wholesale the property to you anyway, if you fund a property from the start, then with the 10 day inspection period, if the propert doent work for you, you tell the wholesaler, he cancels the contract, and you dont have to do any funding. So, in this model, you let the wholesaler put a property under contract in your name, and then you buy it if it fits your criteria and you compensate the wholesaler. If it doesnt fit your criteria, you tell the wholesaler, and the contract is cancelled. This would do away with assignments, and it does not increase your risk, and still lets you have people finding properties for you. See what you think of this idea.

I’m from a family of realtors, and am one myself. Apart from buying, selling, investing, and flipping, we also wholesale. We have helped so many people as a result. If we know we’re going to come out with 100k on a deal we fork out an extra 20-30k to the owner. We always give them the best price. Sometimes whole selling it isn’t the best route for them or us so we try to sell it, flip it, rent it, sometimes to them or owner finance. Why? Because it’s not just their house it’s their home that they’ve lived in for x years. It’s an investment they thought could protect them. Why cheat them out of money when you’re going to make a large sum as it is? Do right by them and others will do right by you. We’ve been doing business for over 35 years and yes there are plenty of bad apples, but there are those of us who do want to help. Agents who have a problem, get over your wholesale dilemma and educate yourself. You can do more good with more tools on your belt.

@@loryanninchrist6415 It seemed that way to me at first but in a lot of situations, selling at a higher price will take much longer and some people may not have the time to wait. Someone having to go into hospice care, or any variety of time sensitive situations. Just like anything else that goes on sale, it will move/be sold faster.

Yes 100% I'm a single parent, and I provide for my family via this means..we do serve a different client and as long as there's discosure to our intent and seller chooses. It should not be an issue. Flippers need us to do the grunt work. Agents like and make more money as the listing agent to retail homes...aka thats what we do provide development to neighborhoods aka...the agents do not understand the phycology of distress. We can work together and let the homeowner decide who to work with not NAR. PRoverbs 19:17. “He that hath pity upon the poor lendeth unto the LORD; and that which he hath given will he pay him again.”

The NAR trying to ban wholesaling is foolishness and jealousy. They hate competition but how do they expect to sell someone’s junky property for top dollar? There are a lot of run down homes that only investors will buy and fix up and these investors give the realtors the rehabbed homes to sell. I say live and let live.

Agents hate us because they simply don't make the money we make ,or have the same freedoms. But this law will not pass. Agents do not even reach the same people we do. They do retail deals ,while we look for motivated seller with damaged homes many times that they cant afford to fix up. So its really hate. But it will not pass. But I agree ,we as free wholesalers should have our own voice and lobby to fight against this nonsense.

You said it! Your intentions are to sell the contract not close on the home, so by definition you are a broker bringing a buyer and seller together. I have no issue if you wholesale but the industry needs regulation. Maybe like here in Nebraska if you wanna sell a car you can sell like 4 a year without getting a dealers license. So maybe wholesalers should only get xyz number of transactions before getting a license (not real estate but something to regulate for consumer complaints). I have been an investor for 20 years and an agent for 17. My business has been about investors and distressed properties, so yes wholesale business has been a direct competition to me. And from the majority of my dealings with wholesalers they are dishonest (30 day inspection period and no earnest money so they can cancel the contract if they don't find a buyer). I'm not saying all are like this but that is my experience. I also know plenty of wholesalers that will close on a majority of their deals. Like with everything the government wants a piece of the action and to protect the consumer.

Assignments are a naturally occurring happening within the economy of real estate, or any contracted deals. For example: If I show proof of funds, and I have 100% cash to close on the deal, and I write the PSA in my personal name, and i want to close that deal under my llc, then I will assign that contract to my llc, which is my business... If you show proof of funds, and show that you are buying the deal, then there is no reason for NAR or anyone to say that you were never going to close on the house with your real cash if you end up assigning it. Exact buyer to be vested at closing can mean your llc, bobs llc, your neighbors llc, whoever.. If i write a PSA for a pair of your dirtiest socks, and I show proof of funds for those socks, and then I go assign that contract to my neighbor that also wants those socks, but is willing to pay more than i did; the only way for my neighbor to buy the socks is to use my contract. Because I HAVE THE CONTRACT FOR THE SOCKS. NO ONE ELSE. Anyone agree?

You’re focusing on your contractural right to assign which is 100% true. That’s not the point…NAR is focusing on the business model of intentionally assigning the contract to a 3rd party.

NAR will NEVER help a homeowner with cost of repairs! They will simply walk away! Then the homeowner will be left with no one to help! NAR should rethink this through.

Good Video Jerry. As we all know, there are No federal real estate laws that have jurisdiction on this topic.. We have to only be concerned about state laws governing title companies and be able to legally maneuver around them. I believe a wholesaler may be able to document his services as a fully disclosed " business consultant" to buyer and seller and bypass the upcoming state legislation. The wholesaler may be able to place a flat dollar fee on his consultation services in the contract between both parties with full written disclaimers protecting the wholesaler where all three parties agree up front on the flat dollar fee and super fast closing. As you mentioned these unique sellers require a unconventional consulting service that a typicial licensed realtor or broker are not able to perform. Not to mention many licensed agents are too busy to even pick up a phone on their own listings. I was originally licensed first year in college in 1985 in Ohio and was completly stunned on the work ethic of 80% of residential real estate agents. My experience is only 2 out of 10 agents are hard working good creative deal makers. I agree we can have a two tiered closing over a slightly longer period of time where wholesaler buys home from seller then closes with new buyer through same title company. This will require your est. 30 day "short term capital" to fund the deal between wholesaler and seller before buyer executes the second closing with title company, between investor/buyer and wholesaler. I believe your short term capital for wholesalers will eliminate this issue in these states. It's really no surprise see what states and political party appears to be pushing for this legislation.

Jerry, I love your videos and what you do for the online investor community. However, I have to disagree with you. As a Real Estate Agent myself, we most definitely can service a distressed seller, and sometimes even buy these properties as an investor ourselves. Use your old guy hoarder’s home as an example. An agent can still get that house on the MLS. It may be disgusting and hard to walk through, but we can still fulfill the role to get the house sold just as well as a wholesaler. The difference is we have to follow the code of ethics and protect the public (seller) throughout our process.

If I bring a buyer to the table that will get creative or saves you from foreclosure when your house has little or no equity, catches up your payments, gives you a little cash theni think I deserve more than a 3 percent commission as long as everyone is winning. DONT COUNT THE MONEY IN OTHER PEOPLES POCKETS. However alot of wholesalers and even agents dont have the sellers in their best interest. Its about helping them with what they are trying to accomplish.

I am a fan of Jerry and I’ve learned a lot from his channel. Super thankful for that! I’m a real estate agent in MN and focus on finding opportunities with distressed off-market properties. So I get where this video is coming from. That comment about BiggerPockets is not accurately representing that community as a whole. They’ve had a number of amazing podcasts from wholesalers that utilize very similar strategies Jerry uses. I’ve learned quite a bit from BiggerPockets in the context of wholesaling. I think it’d be smart to find ways to bridge your community with BP’s community via creative content and getting on their podcast 👍🏼

@@mellasish what difference does it make if everyone in the transaction gets the number they want and are comfortable with it. That’s the problem, people worry too much about what’s in other peoples pockets. NAR doesn’t care about the seller as much as they care about what the other person is making which maybe more than them. Nobody is putting a gun to anybody’s head, you get what you accept or negotiate.

It's really funny how bureaucrats always fight against free market yet argue it the most when they want voters and "contributions". NAR is the largest lobbyist organization in the country. I'm not surprised that they're getting away with this while their own agents run wild and are caught with fines monthly due to their own faulty practices. On the wholesaler/investor side, we need our own large, non-profit organization that protect us and our interests. We need our own ethics board/organization so that the bad apples and sloppy wholesalers are punished without damaging the wholesaling/investing industry.

I think some type of standardized laws for wholesalers would be ok. Work out an agreement where everyone wins. Perhaps some simple rules to follow, and a low cost wholesaling license, instead of a full blown sales license? Perhaps when doing an assignment, 2% of the profit goes to NAR or local Realty association? This business is all about making agreements, so it should be fairly easy for all sides to reach an equitable agreement.

@@allenstewart5545 It’s a lot of title companies who do transactional funding or have lenders that’ll do them. As long as you have the end buyer in place. Some title companies will also let the end buyer fund the transaction first and close with you and the seller last

In my market and based on my 20 yrs experience a good realtor can satisfy all the issues a "wholesaler" can- based on your description. Here in BC assignments are considered predatory which is why they are only able to happen after a specific disclosures has been presented to the seller prior to entering into the contract. Prior to this disclosure period a few years ago, many sellers discovered they were selling under value in a rising market, only to find that their contract was being flipped for profit.

Wholesaling can never be illegal it’s a contract America is built off contracts if you go to a homeowner and the both of you have an agreement on price on paper then you have the right to do whatever you want with that property and deals are still getting done even in those other states with regulations so there’s nothing to be worried there’s tons of opportunities out there acres of diamonds

A smart Real Estate Agent would seek out wholesalers as clients and utilize the "double dip". 6% of 90,000 is the same as 3% of 180,000. In other words, if I offer you 90k for the home and allow you to represent me, another person who comes in and offers 140k would be paying you less money. It'd be smarter for you to take and work with my 90k offer. Your bank account will thank you.

But if you purchase the property, it will affect your wholesale cost because you then have to add your closing costs to your bottom line rather than just a flat 10k fee. When you do your deals now, do you factor in closing costs on the purchase/sells price? Or do you pass it to the buyer/seller in closing Depending what side of the sale you are on obviously

They feel threaten by wholesaling but if they look at the benefits that it has on the housing market they would reconsider that. Realtors and wholesaling work together everyday to solve many problem's. Wholesalers put houses back on the market that would never be able to be sold traditionally and realtors sell them just fine for a commission. As Wholesalers we have to tighten up the practice because they want to govern it really bad.

In past experience as a sales representative for track home builder some realtors are just to lazy to do any extra work on a regular client. Their ego is to big, they dont realize they would get easy commission if they work with wholesalers. Predatory and deceitful comes within the person not a title. Honest wholesalers and realtors should be here to help and find a better solutions for those that are in a bind aka helping those who cant help themselves, it's in the bible...... more and more it's about selfish power, and greediness. There is enough business for everyone. Some minds are so limited that is why they lack and find themselves fighting for something they won't be able to uphold in the long run nor make a difference in what they are currently doing or making money wise.

the people have 👉unalienable private property rights to have or sell which can not be infringed upon by any corporation or government no matter how much they may want to, it would be unconstitutional and thus illegal and 100% Null and Void and the first time any fine is put on someone and it goes to trial ANY new law or code that the wholesaler was alleged to have broken or violated can be 100% made null and void by the Jury of said trail to say "we invoke JURY NULLIFICATION". the jury has the final word, that's their job under law and it doesn't matter if the judge or lawyers agree with the Juries decision or not, the JURY has the power to null and void any law they deem to be unjust or unconstitutional. The people have the power and it will stay that way. ❤❤❤❤❤❤❤

It is LITTERALLY not a freaking real estate transaction. A contract is personal property. Furthermore, title companies aren't even supposed to dole out assignment fees, as it's NOT real estate. I would disagree that there are deals that couldn’t work for sellers with an agent. Realtors don’t just sell show homes. I see junk houses or horder houses all the time on the mls and if it’s priced right it still sells. I’ve even seen some that sell sight unseen with realtors. And the sellers can almost always get more than a wholesaler will pay.

@@JSCimmo yep, this is the kind of stuff that makes wholesalers look worse in my opinion. I’m all for getting good deals, but there are more honest ways to do it. I’d bet most sellers would be pissed if they knew upfront the wholesalers were turning around and flipping their contracts. That bigger pockets article he mentions in the video actually has a really good explanation for it. It’s basically the same as net-listings in real estate, which are illegal.
