Sure I think so too. But think of the consequences. If witnesses knew they'd be put in jail for being wrong. How many people would come forward if they're not 100% sure of what they saw

shadow demon you bring up a very interesting point, it seemed like that lady was convinced by the police that that man is who she saw when she knew very well she couldn’t make out a face, all I’m saying is if she comes forward as a witness at least be honest that she could not make out a face and that it was just possible

ChaosChampion exactly what I thought, seems like she was influenced to have a solid false testimony or unstable testimony whether it was by the police or someone else but still she should of just been honest and for that, for lying and for treating someone’s life with so little care I believe she should get what she tried to give the man

That's the thing though. He *was* technically proven guilty in the first trial. The presumption of innocence flips then and now he has to prove he's not guilty.

Friday, March twelfth, 2021. He was finally freed at last. He was let out of jail and can hopefully rebuild what life he has left.

@@SteveCarras he was released from custody and and the higher courts are reviewing his trial, with the case against him flimsy at best and nonexistent at worst, and with no prosecution against him, it’s pretty safe to say he’s in the clear

This makes me sick. Can you imagine being in this poor poor fella's shoes? He had his life stripped from him. And I echo the sentiment of others in the comments section, those "witnesses" who lied need to face criminal repercussions for their role in incarcerating an innocent man. @@eyallev But he wasn't, this is proof and reason that witnesses are not concrete evidence and should not be the sole reason somebody is sent to jail without further reasoning. Without forensic tests or pleading guilty, witnesses are not enough because some random citizen that says they saw it can easily be wrong or lying.

This. Lying in court should get you the sentence the person you tried to get locked up would have got. Exceptions obviously for misremembering (it happens) but people like that lady who know they saw nothing and even had it proven to them still sticking to their guns and the other 'witnesses' should have trials and be put in for life when found guilty.

I was angry as well, and as I was watching the video, I was hoping that he may have been able to take that plea. I doubted it, but I was hopeful. That man’s life was over 30+ yrs ago.

Unfortunately this happens far more often then anyone is willing to accept. There's never any true justice in cases like this which is horrible. It makes me so sick and what's worse the majority of people think cases like this are 1 in a billion when it's far more often. It's a problem I don't even think you can truly fix

What makes it even worse is the fact that they pulled Double Jeopardy on him which is illegal. You can not be convicted for the same crime twice and they actually did that.

Our justice system is not about proving innocence, it is about proving guilt. The judge who said there wasn’t sufficient evidence to prove innocence has his head on backwards.

Yes, unfortunately for a re-trial (which means he was already proven guilty), he must now prove his innocence, this is different from the first trial, otherwise people could just keep having retrials over the same information and if a judge found a different result, it would spill the inefficiency of the system.

In America there is only 1 situation in which you are innocent until proven guilty, that is a wealthy, powerful, and very much white person with no priors, and maybe on a very rare occasion just plain lucky. If someone is missing any one of those traits or may a Supreme being help them if they're missing more than 1 of those traits, they will be considered guilty until proven innocent. The American justice system may have better living conditions than other countries but is a terrible system when it comes to providing "fair" trial...

He was finally released on March 12, 2021. Poor man, our justice system failed him. Can't imagine spending that many years of my life locked up based on nothing more than eyewitness testimony, despite having an alibi.

​@@noahjones9833 Once you're convicted of a crime, you're considered "guilty" no matter what the evidence is. Yeah, morally, he's not guilty, but legally he is. Once you're convicted and therefore (no matter the evidence) "proven guilty," the only way to get out is to prove your innocence.

U guys know you can be released after being convicted it has happened before. This is just a very rare case. Also the judge didn’t decide if he was guilty it was a jury. The jury may have had bias that the Defence didn’t realize when selecting the jury. Also this guy probably had a public defender for his case which may be why he lost an easy case.

Not really, it's innocent until proven guilty to a bunch of ordinary people who are conscripted to act as jury, and then you are guilty until you can prove your innocence unless a judge or governor realizes a gross miscarriage of justice and chooses to issue you a pardon.

@@mrluigi9923 if it isn't a for profit prison, the parole board will look at things like anger management, compliance with mental health medications, educational achievement, etc. If he spent all his time proving his innocence and didn't do any of that, the parole board will reject it. If it's a private prison, they will reject just to keep their numbers up and ensure profitability.

I was arrested for robbery because a blind man said he seen me do it. It’s still on my record even though the charges were dropped before I went to court. I still had to pay 6k bond and to this day can’t pass a background check to rent a place to live.

To me, a person must be assumed innocent until you prove they aren't. If the judge don't do that, they should be dismissed.

Seriously, what happened to innocent until proven guilty? The fact that he can't prove that he didn't do it is irrelevant, if the state can't prove that he did in fact commit the crime beyond reasonable doubt (which it can't). So he should be set free.
