I had a second impairment reading done by state appointed Dr she rated me a 5% . But prior to her visit I already had an impairment reading done also a 5% I was payed out that amount my question is I disputed the first 5% now the state Dr says she agrees with the first impairment score will I get a second settlement or will they say “No we’ve already payed you out that” idk what to expect need a little insight on what might happen . Thank you for your question. If the doctor had increased the rating from what it was before, they might owe you additional benefits. If both doctors gave you the same 5% rating for the same injury, I expect that they will not pay any additional benefits because that amount has already been paid.

Hello, I have some questions about a lien placed on my settlement. I must appear in court on June 21st. I dismissed my attorney of 3 years due to lack of communication, long periods without receiving medical help. They are wanting 15% of my settlement of which I don't believe they earned. I'd like to understand what my rights are in winning in court. I am willing to accept a smaller percentage paid to the attorney, but not the 15%. Thank you.

Hi Anita. Thank you for your question. Is this a Georgia workers’ compensation case? If so, your attorney is entitled to file a lien against settlement and a judge is the one who ultimately makes a decision about whether your prior attorney is entitled to the amount of the lien that was filed. Both you and your prior attorney would have an opportunity to present evidence at the hearing, so you need to know what evidence you would want the judge to consider and be prepared to present it. Since there are special rules about how the evidence needs to be presented, I would recommend that you consider hiring an attorney to represent you if you really want to fight the lien. If your workers’ compensation case was filed in another state, then you would have to check with an attorney who handles workers’ compensation cases in the state where your claim was filed to find out what that state’s rules are.

You would be doing yourself a huge disservice by not hiring a attorney. The insurance company has legal assistance. Why on earth would you go up against a Insurance company with unlimited funds and Attorney’s alone? The insurance companies won’t do jack shit unless they are forced. And the only way that happens is for your attorney to stop dicking around with them and start filing motions.
