My wife did not disclose her entire bank accounts in the Assets n Liabilities form in the maintenance case. I investigated and found out the same. And pointed before the Court. The judge simply said - pura accounts information dalo naa !!! She said ok. Thats it. Want to say something? Aren't you astounded by the sequence of events? I was. If I had not pointed it out, the truth wouldn't hv surfaced. So much for judiciary and so much for justice....

The more important concern is wife claiming husband's property which he inherited from his parents. She has little to no right asking what she didn't earned. Also many people defend her and the counterargument is DOWRY! If dowry is illegal then taking husband's property should also be illegal. Indian judicial system is really blind though!

I am married, my income is way higher than my husband, i bought a house in Mumbai all by myself without a single penny from my husband. And on papers we both have our names. Inlaws too stay with us. Whole emi and downpayment is done by ny side. Husband takes responsibility of monthly expenses and no contribution of inlaws. Still I dont cry like how men are crying in comment section. 2nd thing tomorrow if my husband takes a break from the job just to manage home and child.l, i would be grateful and thankful to him, i will not mind if he is independent on me just to manage our home and chid. And in case in future we get separated i will not mind giving him allimony as he has wasted his years managing home, chores for me, just to make my life easy, my children life easy. Of husband has sacrificed his so many years of manage, isnt it my responsibility to give him conpensation so that he will not have to struggle and will get time to rethink on his carrier and settle?i cant leave him and say go stay on road. @@kishorevenugopal6191 basic law in Indian divorce settlement says that husband has to pay 25% of his earnings to his ex-wife as alimony plus some for child support (if they have kids). However, the alimony percentage can be reduced or reversed if the ex-wife is employed and/or makes more money than her ex-husband. If she makes more than her husband and the husband has no fixed source of income then the court takes that fact into account and if the judge is fair (if he hasn't been bought by the wife's side) he will reward the husband an alimony amount or percentage from the wife's income. Also, if this happens and if the couple has a kid then all the husband needs is to pay for child support and no alimony.

Practising advocate here - a lot is left out here, any client needs to know that according to new Supreme court verdict - Case Law Rajnesh vs Neha, the parties to a maintenance suit has to file affidavit of assets - understand that this format is very ellaborate and quite water tight at determining the status of parties - if there is any discrepancy - affidavits can be challenged - there is a way - file interrogatories - file a petition with questionaire - the other side will be forced to testify - remember it will be clear to the judge who has lied and that will reflect on the order sheet. It's too indepth to explain over a small video, but my friend there is a way.

It is expected that both the spouses irrespective of gender must bear the maintenance support during and after marriage. But in india women are expected ( forced) not to work and take care of family. After years of unemployment, nobody can just show up without experience and get job. Therefore women can't take care of themselves financially. Plus pregnancy takes toll on body. Weakening it. Multiple pregnancies can really damage it. The maintenance is like a pension scheme. ( I don't like the comparison) But it's similar thinking. Especially when there are no emotions left.

If the jury punishes the act of perjury, it will discourage the amount of lies in the cases before the Court. Since the judiciary does not punish the liar, it encourages more lies and then lengthening the period of the case. Its simple isn't it? But no one speaks about it.

Absolutely right..a case in india which is totally based on lies can remain alive in the system for decades.. we as a family are going through one such legal battle since last 4 years wherein my late brother's wife did a 100% wrong property case on my widowed mother.. but she and her lawyer is getting away with all their lies and intentionally delaying the case by doing foolish cases and complaints and not fighting the main case going on for 4 years .. my mother is 76 years old and when she deserved to live her old age in peace, my late brother's wife is making her life miserable in every way possible but still we hope that one day justice will be done..
