Dershowitz is forgetting the criminal part of the prosecution. This is a standard technique he uses to get defendants off. The hush money payment isn’t the crime. It’s his lawyer’s services to cover it up which is an unreported illegal campaign contribution, and it’s Donald Trump filing false business records, recording the payoffs as a retainer payment to a lawyer, which he can then deduct from his taxes as a legitimate business expense. Again, note how Dershowitz ignores all of that and successfully distracts your correspondents from the actual crime.

Filing false business records is a misdemeanour and it isn't Federal. The prosecution are trying to turn it into a Federal crime by saying the purpose was to affect the election. That is why this can legitimately considered a political prosecution. It's a clear case of a DA having a target and constructing a novel means of prosecuting that target. If anyone other than Trump had taken the same actions it's unlikely they would be facing this prosecution.

5:39 your interviewer totally misunderstands the situation. Trump is not in trouble for having an affair or paying hush money. Both are perfectly legal in the US. Instead, he's in trouble because 1) rather than pay her himself, he had the lawyer pay her. If the purpose of the payment can be shown to have been to help the election (and we have testimony that Trump said to try to delay payment until after the election, at which point we don't have to pay, which appears to prove it), then making this payoff on BEHALF of Trump is an "in-kind", that is, not-cash-to-the-candidate, campaign donation. The US limits such a contribution to $3000, so the payoff was 50x over the limit. 2) donations must be reported, and this one wasn't. 3) to pay the lawyer Cohen back, Trump made "Legal Retainer" payments from his corporate ledger. This is classic money laundering, disguising the purpose and de facto recipient of the money. 4) it's potentially tax fraud as well, since legal expenses are pre-tax, when payoff should be paid out of post-tax profits. It's "only" a $40k or less tax cheat, but tax cheat it is. So in summary: 1) campaign donation 50x over limit 2) not reported 3) refunded to lawyer via money laundering 4) setting up the potential for a tax cheat That is the case. BTW Giuliani explained on live national television how the money laundering was meant to work, so it's going to be hard to argue it was anything else...

As a trial attorney: it’s is SO OBVIOUS Dershowitz has never tried a case when he said “…no [prospective] juror will ever say ‘I have such strong feelings, I can’t be fair to both sides in this case…’” Well, of the first 90 people they took, 60+ were immediately released for saying EXACTLY THAT; of the first 7 jurors picked for the petit jury the second day, one came back the third day and said “After going home and thinking about it, I can’t be fair to both sides” (everyone tried to blame this on Trump’s tweet(s) about jurors and the fact her family and co-workers had managed to deduce her identity, while a contributing factor I am SURE, was NOT the reason she gave, frankly, it was PRECISELY what Douchewitz claimed “no prospective juror would ever say;” and, lastly (and most importantly) 99.999% of jurors are doing everything they can to get out of jury duty; I don’t even BOTHER to ask the question that directly and in that manner, because the answer will be “NO, I ABSOLUTELY CANNOT BE FAIR;” the MOMENT they realize it will get them stricken from the panel.

Never heard anything about $ 700,000 with Fani Willis at all . Very small amounts of 3500.00 I think x 2 and it was re- imbursed was what I saw mentioned in the Fani Willis I believe appeal.
