Most of my assets are non-probate, and at least currently I'm not concerned heirs not being able to handle the inherited assets. Therefore until that changes I"m going the route of TOD accounts and POD deeds. However, I suppose I need a will to specify burial and other lesser details?

Depends on the assets and the heir. Moreover, as Paul explained, in some circumstances you might not need either one to pass assets.

Got a letter from Parish stating no longer eligible for Homestead Exemption because grantor/prior homeowner is not the principal beneficiary of the Living Revocable Trust. Does having a Revocable Trust with children as principal outweigh the benefit of having Homestead Exemption? Should I make an amendment or should I revoke the trust and write another trust? What if only one heir is 48 yo Quadriplegic on Medicaid and disability? He lives with us in our home that is fully modified for his comfort and care. We need to make sure he is taken care of at home when we pass.

Probate isn't necessarily some nightmare. Depends greatly on the state laws, which vary a lot.

Can you do a video on Irrevocable Grantor Trusts and (i) implication of IRS Rev Ruling 2023-2 related to step up in basis of the trust assets at time of grantor’s death, and (ii) is including express language in the IGT that the trust assets, at time of grantor’s death, are part of the grantor’s estate adequate to assure step-up in basis.

Enjoy your videos….This can get complicated when children are involved! My husband and I want just simple wills. Our assets are equally divided. We want the living spouse to inherit everything at the time of death to do as we please. IRA’s beneficiaries are in place as we want them. Our children are wealthy and do not need our money. We would like to leave an inheritance to our 3 grandchildren. So…Based on what are saying a trust would be best!! What are your thoughts? We are an average middle class couple with no debt.
