Folks… listen to Brian Parker here….he knows what he is talking about. I had a case filed against me and I did a counter affidavit as Brian instructed. The plaintiff’s affidavit was full of false statements that I was able to point out in my counter affidavit that resulted in me winning the case and having my case dismissed with prejudice.

This was awesome! Thank you for sharing. I have sent 3 debt validation letters to an AMEX debt collector. They refuse to answer any of my questions. Gave them 7 days to respond to my 3rd letter and any communication other than answering my questions would be considered harrassment. If they end up sueing I now have a game plan! Thanks again.

I won my case, and actually had a really good conversation with the plaintiff's attorney afterwards... he congratulated me on self representation. I think it is amazing how many people don't try defense!

@@collectionstopper He said I seemed like the kind of person he'd like to represent some day. He is a genuinely nice guy. The crux was the lack of the purchase agreement. Even the Judge had to recess for maybe 15min to research the code I cited and then he referenced a federal case to the attorney and said he cannot give a judgment without that document. I never disputed the accuracy of any documents present, just the proof of who owned the debt.

@@collectionstopper Absolutely, I watched how he (Judge) handled the room and even how he respected the "civilians" before my case and I was somewhat relieved that he was fair. NOT favoritive at all, but honestly listened to everyone, and gave them a chance to speak. A stark contrast to my affidavit hearing, different Judge, very demeaning to anyone who was not an attorney. All this said, it didn't make me any less nervous about my first time... My advice is to talk with people, don't just leave when you're dismissed, stay and observe, learn more, pay attention and learn how everyone speaks, I did not hold anything against the plaintiff's atty, he was doing his job but I surprised him. I now have a very different outlook on the legal system here. The Judge himself commented that it is nice to recognise adversaries vs enemies, as within the trial you're trying to win but not everyone has to be an enemy. 2 steps out of the courtroom the plaintiff's attorney reached out to shake my hand. We exchanged information and I will most likely reach out to him when needed.

Question. I recently received a summons, responded with the request for trial and Bill of Particulars…the plaintiff didn’t respond to my request, so I had to file a “ motion to compel” …I haven’t been able to listen to all of your videos yet, but am I correct in assuming that the Counter Affidavit would be done after I receive the additional documents? I’m super stressed, so any information or direction would be greatly appreciated 😊

@@lisadt3042 counter affidavit is in your initial filing. If they don’t have the docs, that goes in your affidavit with your answer.

Can I use a counter claim to stop a judgement?

Generally, I know of no way to do that as if there is a judgment and you have no right to file anything as the case is closed. You can file a Motion to Set Aside the Judgment but a Motion is not a Pleading (a counterclaim is a pleading) open the case again. Again, I am not aware of your state or the differences that counter my knowledge base. My response is basic definitions that a lot of states follow. You gotta set aside the judgment first. Timing and reason for set aside rules here. Good luck.

I always mention in my Affidavit The Creditor sales there debts but never allows the buyer to sue for the debt only collect. . Trinsley v Pilagro basically nothing a lawyer says or presents in briefs are arguments rises to facts

First time ever seeing this video. I was struggling to find answers on a debt collection debacle. I had disputed the debt with Comenity bank in 2018 and then somewhere around 2020 Midland Credit somehow got a judgment against me. I couldn’t find anyone to help help me so I just recently was forced to pay that judgment through a refinance of my mortgage. I wanted to vacate the judgment so that I could defend myself, but I ran out of time. I recently made a complaint with the CFPB against both companies. Is it too late for me to claw back that money? Can I still sue them since I did not owe them the debt?

Hi, First off , this video like all your videos I have watched is Super-informative! I had a couple questions--- 1--Is there a course or a book , on how to analyze "chain of title"? I think that would be an awesome skill to have! 2---Instead of waiting for these clowns to sue you, How about just filing an FDCPA case against the debt collector, for not having the right to collect on the alleged debt.??? Then in discovery, it should become apparent if the collector has the proper chain of title. If by some miracle they do have the proper assignments, then just dismiss the case. Now, if they have a broken chain of title, you have them on impermissible pulls, and false reporting under the FCRA. This could set up even further lawsuits! I have felt for a long time, that there should be ways to go on the offensive with debt collectors! THANK YOU for all you do to help us!!!!!

Do you have solid affidavits templates for debt validation and cease and desist, pretty much the first round. There’s a collection agency that’s operating illegally I believe and doesn’t have a license to collect in my state . I looked them up . Nor did I see a registered agent 😅 lbvs

@@collectionstopper that’s my question. How can u prove securitization without the lawsuit. I’m fixing my credit. They have claimed to be the original creditor in a dispute letter. They have claimed they are attempting to collect a debt in a couple letters. They never say the word debt other than that . They only say the account is correct. The balance isn’t being reported differently but the payment history and some other things are not the same on all 3 bureaus and they refuse to fix or delete it. Even the cfpb is no help.

@@collectionstopper my problem with them is when I dispute everything wrong on the account they keep replying with the account is accurate. I never disputed the balance but the payment history is different across the board. I even have late payments after the account is closed they refuse to delete or fix it because Ik they don’t know what’s correct. They keep sending statements when I never disputed the balance. The cfpb was no help and cra won’t delete and Discover keeps sayin everything is good according to the FCRA.

@@jaysteph3167 The short answer is you set them up for when and if they sue you. Not providing what you ask for will go a long way to your defense. Look at the company 10k financial reports the year after your debt started. Search term securitiz (just like that to capture variations). That will show you proof of the securitization of it all depending on your search. Email me and I will send you a letter to send that you can add your stuff to and if they don’t answer or answer vaguely, it will be useful in the long run. That “debt” v “account” stuff seems simple but sometimes the answers are hidden in plain sight.
