Something is wrong with a system where a criminal can file a fraudulent deed with ease but the rightful owner has to go through a lengthy process to reverse it.

Very wrong here in South Africa you pay, transfer once it's 100% paid, the money or bond is held in trust and you only get your deeds once the deeds office has been sent proof , no chance of fraud there's 2 lawyers and. Convayencer to go through f it's a deceased estate the high court is in there too

There are lawyers specialized in stealing properties without even equating on them. They are in cahoots with people in real state, and rub shoulders with local judges, senators, and politicians.

The register of deeds is an essential part of local government as it also enables them to collect land and property taxes. We are talking millions of dollars or more in value for private residential homes, agricultural land and businesses. For there not to be systems in place to ensure that someone could do what this woman did is just ridiculous. The idea that the homeowner now has to spend thousands of dollars just to get the deed back in his name is just bonkers. At no point they didn't set up some sort of facility that would just simply cancel this deed as fraudulent and return to the previous deed on file which would still be on record?!? They really make thing difficult?!?!!

Let me get this straight: The Register of Deeds is obligated to register ALL deeds presented to them in accordance with NC state law, and have no process to check if the deed is legit? WOW unbelievable.

The registrar has no way to verify the identity or validity of signatures independently. They rely on the notarization of signatures by the notary public.

This has been happening all over the country, especially the south. Several people have lost their home because of deed theft. Some elderly GA (In Atlanta it's rampant) people living in their homes for 30 years plus have had their home outright sold from under because of this. We now have two step verification process for our emails, bank accounts, even to pay our light bill, but not for the outdated county clerk register of deeds office. In Georgia that can't even ask for ID. Here in NC you can sign up to be notified if your deed changes but that's only after the fact and by then it's too late. It's ridiculous and they are too lazy to change and criminals are taking advantage of this system in which the state and the courts are too oblivious to change it. Its been in news nationwide for a few years. States not reviewing outdated vulnerable policies.

Even if they are obligated to just "Scooby Doo" accept the documents, if the documents prove to be falsified, they should be able to just be removed. That's the even more stupid part of this in my opinion.

I’d like to thank the homeowner for coming forward with his story. Now, we all know to be extra careful in NC when putting a property up for sale. And, to only vote for state house candidates willing to fix the applicable laws. I hope that he is able to get this situation resolved quickly, and that somehow he able to get compensation for his troubles (although realistically, the perpetrator likely has no assets).

She claims that she thought it had been foreclosed on, and there was some erroneous indication of that. But a foreclosure is not the same as an abandonment. She would still be stealing from somebody. She will soon be in the big house.

Require id to drive, to cash a check, to register a vehicle, but not to file a deed? G.S..161-14 needs removed/amended to make theft of ownership by fraud impossible.

Fraud alerts do essentially nothing until after the damage is done. I keep hearing the fraud alert solution but this would not have changed the position that the dentist/Raleigh NC homeowner is in, that is, owing thousands and thousands in attorney fees and all of this stress in his life now. The owner essentially received his "fraud alert" through his HOA, but he still has to go through this awful mess "on his time and on his dime". And counties and government love to propose this "fraud alert" but it really has no teeth and is just lip service IMO. The owner may get a judgement for $$$ - but he will likely never collect anything from the fraudster, and he is stuck with the thousands in attorney fees and all of this emotional trauma, as she probably has no money and all she has is her national/international mug shot to her name. No net worth, a.k.a. "judgment proof" And she's looking at likely future incarceration so certainly she's not earning money in jail. Notary barcode is a somewhat okay idea -- but many people can get notary commission as it doesn't take much to get commissioned/very easy to get for most, so there are those who will get commissioned as notary and may not be honorable and can use their stamps to commit fraud. Our homestead is supposed to be Constitutionally protected -- and by allowing this nonsense, essentially the government/counties are complicit in allowing these fraudsters to seize properties simply by standing in a line at recorder's office, then filing a bogus quit claim deed, and paying the recording fees. All in the span of an hour or two at most to do this. (FYI - Quit claim deeds are so easy for fraudsters to forge and these need to be especially scrutinized at recorder office but of course they are not !!) We as the legitimate property owner should be able to file a "Notice of Intent" in the county recorder's office publicly stating our intent to freeze our property title - fully stating the owner's intent to keep the title in their name/"frozen" unless property is legally transferred by government adverse action (lien) or through death of property owner (legitimate estate documents/probate). If one intends to sell or transfer property, they should file a "Notice of Intent" to "unfreeze" their property to sell or transfer property. The Notice of Intent/"freeze" should indicate to the recorder office an extra layer of scrutiny with property transfer. In reality, the extra layer of scrutiny should always have been there, but apparently the "system" doesn't believe it needs extra security (even though to get a library card, one is required to show a proper ID - but to steal someone's home you just get "rubber stamped" /accepted for recording queue by paying the recording fee, all the while the county clerk probably hasn't even looked up from their paperwork to even look you in the eye, let alone properly ID you as the legitimate owner - which, appallingly, is not a legal requirement for the recorder office - apparently it is too much work for them).

The funniest thing here I find is that it was easy for the lady to fraudulently switch the title over to her. But apparently it's "very expensive" to undo what she did. I think the solution is to resubmit new deed and just do what the lady did to right the wrong. I mean if it's that expensive to 'undo'.

Then the Register of Deeds needs to verify. What an excuse to use that they are not required to verify. Why are you not required to verify? When I sold my house in NC (small town) I was sent a form to complete and return. If you have a stupid rule then it is time to change. This should have never happened. This is on the Register of Deeds - so a suggestion - get it fixed!

They are without the tools to do research or verification, and the law does not require the verification anyway. This situation is not unique to Raleigh. It happens in lots of cities all over the country.

If I was the homeowner I'd make up the same documents and walk right in and register the deed back in my name. If they don't check validity then why can't he do the same to reverse it and he is the legal deed owner so nothing unlawful going on.

So the State has the responsibility of filing deeds, but no responsibility to do the job correctly by verify the actions aren't fraudulent. If and when fraudulent activity takes place, the victim is required to go through a long, expensive legal process (if they can afford it) to fix the State's mistake. Does this sound right to anyone? There should be some level of checks and balances for this. Maybe states should, at the very least, require title company involvement. Ideally, they already have protocols in place that should minimize this. Maybe add a waiting period that includes registered mail verification requiring the current owner to appear with ID. If there is a claim of death, proof with a raised government seal and a number/system to verify.

Investigate whether there is a “ring” of criminals involved in this fraud. Dawn hardly looks like someone who would have thought up this scheme on her own….esp on a multi million dollar property was still occupied. To ballsy IMO.

The Dawn woman originally stated that she thought the house went into foreclosure, so she submitted the app to "claim" the home. But the bigger question is why do we signs a ton of forms to purchase a house, and it just takes one form (and no ID) to steal it. So now we have to purchase Title insurance. Sounds like a scam. How about if someone applies for a deed change, the county registar sends a certified letter to the address to confirm the homeowner is aware of the request.

This is happening all over, specially in fla. A man was evicted of his own home in Miami. Whoever did the change of the deed, sold his home. That’s why he was evicted. I think he was also arrested for refusing to live his property. Scammer pay $ 10.00 for the copy of the deed😢

The whole system was designed like that to make it easier for family members (spouses) to register the home after someone dies. Not to break their bank. Faster so they can move on without it being dragged out after a death. All it takes is doing this once (after a parents death or a spouse) to realize how easy it is. Then just watch the ads. That’s why she has estate and trust added to the name. The best way to fix this is to require a death certificate if you’re going to use that termination. If they do, then it’s fraud and the cops can do something right away, the family doesn’t have to go through an expensive trial to reverse it. The state does have to prosecute and win though. Getting the person through that trial can take time. Unless the courts can expedite those kinds of case.

Most States have this very same law, you can't buy a can of paint without proving your over 18 but you can file false Deed transfers all day long and nobody gives a crap. Every State needs to fix this, everything should be validated before any change is made.

It’s one thing not to verify the paperwork but not that it’s confirmed fraudulent they must reverse the paperwork with no cost to the legitimate owner.

Maybe one step that could be taken is with the notary? usually a notary is required to record the transactions they approve so that record could be put into and verified from a digital database. If the transaction isn’t recorded the actual notary can be contacted for verification before any changes in the deed. Doing this may also catch falsified/stolen/fraudulent notary stamps or bad actors.
